(1) upon commitment for appropriated funds available to the<br />

prisoner's commanding officer;<br />

(2) resupply during confinement in a United States military<br />

institution from appropriated funds available to the commanding<br />

officer operating the confinement facility;<br />

(3) resupply during confinement in domestic nonmilitary or<br />

foreign penal institutions from funds available to the prisoners'<br />

designated commanding officer.<br />

075156 COMMISSARY STORES<br />

1. AUTHORITY.<br />

Pursuant to provisions of 10 U.S. Code 7601, 7602, and 7603, commissary<br />

stores may be established at the request of the Department of the Navy<br />

(DON) to sell food items to members and authorized dependent personnel.<br />

Commissary stores approved for establishment by the Defense<br />

Commissary Agency (DeCA) are operated on a self-sustaining basis<br />

except for appropriated fund support specifically authorized by statute.<br />

2. BUDGET <strong>POLICY</strong><br />

a. General.<br />

The financial operations of commissary stores at DON activities are<br />

governed by statutory authority (see the General Provisions of the<br />

annual Department of Defense Appropriations Act and FY 1992<br />

Authorization Act, P.L. 102-190 Sec. 316). Additionally,<br />

commissaries at DON activities operate as tenants of those activities,<br />

and therefore follow DON host-tenant relationship guidelines (For<br />

further information on the relationship between commissary stores and<br />

DON activities, see the sections relating to host-tenant relationships<br />

outlined in this manual.)<br />

b. Stock, Supplies, and Equipment.<br />

As a result of the FY 1992 consolidation of commissary operations<br />

under the Defense Commissary Agency, the Working Capital Fund<br />

(WCF) finances the procurement of stock, operating supplies, and<br />

equipment for commissary stores. The WCF is reimbursed from<br />

operating capital of the commissary store as items are expended.<br />
