c. Base Realignment and Closure Account, Part III.<br />

"For deposit into the Department of Defense Base Closure Account<br />

1990 established by section 2906(a)(1) of the Department of Defense<br />

Authorization Act, 1991 (Public Law 101-510), $_____ to remain<br />

available until expended: Provided, That not less than $______ of the<br />

funds appropriated herein shall be available solely for environmental<br />

restoration, unless the Secretary of Defense determines that additional<br />

obligations are necessary for such purposes and notifies the<br />

Committees on Appropriations of both Houses of Congress of his<br />

determination and the reasons therefore."<br />

d. Base Realignment and Closure Account, Part IV.<br />

3. LIMITATIONS.<br />

a. Authorizing Legislation.<br />

Pursuant to 10 U.S. Code 114, the program financed by the BRAC<br />

appropriations, which are included in the Military Construction<br />

Appropriations Act, must first be approved through authorizing<br />

legislation.<br />

b. Time Limitations.<br />

Funds appropriated to the BRAC accounts are issued as no-year<br />

appropriations, and are available to carry out all BRAC closures and<br />

realignments. Note, that all closures and realignments are to be<br />

complete no later than the end of the six-year period beginning on the<br />

date on which the President transmitted the report to Congress<br />

containing the recommendations for such closures and realignments.<br />

The recommendations of the 1995 Commission were transmitted by<br />

the President on 13 July 1995. Therefore, after 13 July 2001, funds in<br />

the DoD Base Closure Account 1990 shall be available only to incur<br />
