eprogramming purposes and any reprogramming above threshold<br />

must be approved by Congress.<br />

(3) Leasing.<br />

The DON must notify both the House and Senate Military<br />

Construction Appropriations Subcommittees of its intention to<br />

enter into domestic leases costing over $12,000 per year at least<br />

period of 21 days prior to entering into any such leases. This<br />

notification requirement applies to foreign leases costing over<br />

$20,000 per unit per year.<br />

c. General and Flag Officer's Quarters.<br />

(1) Section 128 of the FY 2000 Military Construction<br />

Appropriations Act, and Section 8114 of the FY 2000 Department<br />

of Defense (DOD) Appropriations Act mandate that the Family<br />

Housing, Navy and Marine Corps appropriations are the exclusive<br />

source of funding for maintenance and repair of all family housing<br />

units, including general and flag officers' quarters (GFOQ). No<br />

funding contained in the DOD Appropriations Act may be used for<br />

performing repairs or maintenance to family housing units<br />

including areas in such units used for the purpose of conducting<br />

official DOD business. Specialized communication equipment that<br />

is required by the occupant to perform his or her mission is not<br />

considered repair maintenance. This type of equipment is<br />

primarily for secure communications, but could include a<br />

computer, video teleconferencing capability, or other similar<br />

requirements. Any costs for infrastructure that is built-in and<br />

becomes part of the housing unit, such as wiring or fiber optics<br />

associated with the specialized communication equipment, is<br />

charged to the Family Housing appropriation. Only the specialized<br />

communication equipment and its associated installation costs may<br />

be charged to another appropriation. Specialized communication<br />

equipment does not include normal telephone requirements.<br />

(2) Section 127 of the FY 2002 Military Construction<br />

Appropriations Act mandates that not more than $35,000 per unit<br />

may be spent annually for the maintenance and repair of GFOQ<br />

without 30 days advance prior notification of the appropriate<br />

committees of Congress.<br />

(3) Section 127 of the FY 2002 Military Construction<br />

Appropriations Act also requires an annual report to the Congress.<br />

Guidance governing submission of this annual report is contained<br />

in the DOD Financial Management Regulation, Volume 2B,<br />

Chapter 6.<br />
