divisions and tank and amphibious tractor battalions. This equipment<br />

provides the hardware for defense of advanced naval bases, limited war<br />

landing operations, and general land warfare.<br />

2. APPROPRIATION LANGUAGE.<br />

The Department of Defense Appropriations Act provides language for the<br />

PMC appropriation as follows:<br />

"For expenses necessary for the procurement, manufacture, and<br />

modification of missiles, armament, military equipment, spare parts,<br />

and accessories therefore; plant equipment, appliances, and machine<br />

tools, and installation thereof in public and private plants; reserve plant<br />

and Government and contractor-owned equipment layaway; vehicles<br />

for the Marine Corps, including purchase of not to exceed _____<br />

passenger motor vehicles for replacement only; and expansion of<br />

public and private plants; including land necessary therefore, and such<br />

lands, and interests therein, may be acquired and construction<br />

prosecuted thereon prior to approval of title, $_____, to remain<br />

available for obligation until September 30, 20___."<br />

3. LIMITATIONS<br />

a. Authorizing Legislation.<br />

As specified in 10 U.S. Code 114, the acquisition of tracked combat<br />

vehicles, missiles, other weapons, and other procurement to be<br />

financed by PMC must first be approved through authorizing<br />

legislation.<br />

b. Time Limitations.<br />

(1) Administrative.<br />

Obligation targets are established at the budget activity level for<br />

the PMC appropriation for obligation of funds for each program<br />

year starting with 1 October of each fiscal year. This limitation on<br />

the period of fund availability for obligation purposes is designed<br />

to accelerate obligation performance and reduce excessive carryover<br />

of unobligated funds in accordance with the expressed desires<br />

of Congress.<br />

(2) Statutory.<br />

The budget request submitted to the Congress for each fiscal year<br />

under the PMC appropriation is for a multiple-year appropriation<br />

to remain available for obligation for 3 fiscal years. Each fiscal<br />

year appropriation enacted is separate and discrete. Following the<br />

period of availability for incurring new obligations, the account<br />

remains available for use for 5 years for effecting authorized<br />
