that Ilk, by virtue <strong>of</strong> a brief,<br />

is served in a reasonable tierce <strong>of</strong> the five-merk<br />

lands <strong>of</strong> Barns, and <strong>of</strong> the half <strong>of</strong> the lands <strong>of</strong> Burnetland, before the sheriff <strong>of</strong><br />

Peebles, and these gentlemen their neighbours, viz. William Fraser <strong>of</strong> Fruid, Alexander<br />

Veitch <strong>of</strong> Dawick, Gilbert Baird, John Govan <strong>of</strong> Cardrona, James Sandilands .<br />

<strong>of</strong> Bold, David Tait <strong>of</strong> Pirn, Thomas Dickson <strong>of</strong> Ormiston, &-c. And in the year<br />

1505, William Inglis <strong>of</strong> Murdiston, and Mr John Murray, are tutors dative to Wil-<br />

liam Burnet <strong>of</strong> Burnetland, grandchild and heir to John Burnet <strong>of</strong> Burnetland.<br />

Which William and his successors were afterwards designed <strong>of</strong> Barns ; as by the<br />

writs <strong>of</strong> the family, which I have seen in the custody <strong>of</strong> the late William Burnet<br />

<strong>of</strong> Barns. The arms <strong>of</strong> the family are blazoned, argent, three holly leaves vert,<br />

and a chief azure; crest, a hand with a knife pruning a vine tree, proper: motto,<br />

Virescit vulnere virtus. N. R.<br />

Of this family was descended the pious and learned Doctor ALEXANDER BUR-<br />

NET, Archbishop <strong>of</strong> St Andrews in the reign <strong>of</strong> King Charles II. who carried the<br />

same.<br />

ROBERT BURNET, Writer to the Signet, and Commissary <strong>of</strong> Peebles, a younger<br />

son <strong>of</strong> Barns, carried the same arms; but for his difference embattled the chief;<br />

crest, a vine branch slipped: motto, Tandem Jit surculus arbor. N. R.<br />

The other principal family <strong>of</strong> the name is BURNET <strong>of</strong> Leys, in the county <strong>of</strong><br />

the Merns, honoured with the title <strong>of</strong> Knight-Baronet in the year 1626. This<br />

family, says Sir George Mackenzie, got a charter <strong>of</strong> the lands <strong>of</strong> Lees from King<br />

Robert Bruce, and carries argent, three holly leaves in chief vert, and a huntinghorn<br />

in base sable, garnished gules ;<br />

crest, a hand with a knife pruning a vine tree,<br />

proper: motto, Virescit vulnere virtus. N. R.<br />

Sir George Mackenzie, in his Science <strong>of</strong> <strong>Heraldry</strong>, page 3. says, the family car-<br />

ties the hunting-horn, and a highlander in a hunting-garb, and a greyhound, for<br />

supporters ; to show that they were the king's foresters in the north, as<br />

foresters in the south carry three hunting-horns, to show their employment.<br />

this family <strong>of</strong> Leys are very considerable cadets, whose arms are matriculated in<br />

the New Register.<br />

THOMAS BURNET <strong>of</strong> Innerleith, descended <strong>of</strong> Leys, argent, three holly leaves in<br />

chief, and a hunting-horn in base sable, garnished gules, within a bordure indented<br />

<strong>of</strong> the second, and a crescent for difference; crest, a holly branch, proper: motto,<br />

Vlrtute cresco. Ibid.<br />

ALEXANDER BURNET <strong>of</strong> Craigmelie, whose father was lawfully procreate between<br />

James Burnet <strong>of</strong> the House <strong>of</strong> Leys, and Elizabeth* Burnet, heiress <strong>of</strong> Craigmelie,<br />

and representer <strong>of</strong> Craigmelie <strong>of</strong> that Ilk, bears two coats, quarterly, first and<br />

fourth Burnet <strong>of</strong> Leys; second and third azure, two garbs in chief, and a crescent<br />

in base or, for Craigmelie: crest, a dexter hand holding the branch <strong>of</strong> a palm tree;<br />

with the motto, ^uee vernant crescunt. Ibid.<br />

ALEXANDER BURNET, Merchant in Aberdeen, Gentleman, argent, a battle-axe<br />

pale-ways, between three holly leaves in chief, and a bugle in base vert, garnished<br />

gules : motto, >uidni pro sodali. Ibid.<br />

ROBERT BURNET, Procurator-Fiscal <strong>of</strong> Aberdeen, descended <strong>of</strong> Leys, carries as<br />

Leys, with a billet azure in the centre, for his difference; crest, a hand with<br />

a cutlass cutting through a vine branch, proper: motto, Tandem Jit surculus arbor.<br />

Dr THOMAS BURNET, Physician in Ordinary to his Majesty,<br />

descended <strong>of</strong> a<br />

third son <strong>of</strong> the family <strong>of</strong> Leys, carries as Leys, with a mullet for difference : And<br />

his brother,<br />

Dr GILBERT BURNET, late Bishop <strong>of</strong> Sarum, carried the same,<br />

as in Dale Pur-<br />

suivant's Catalogue <strong>of</strong> the Nobility <strong>of</strong> England, where he blazons the holly leaves,<br />

Buniet-leaves.<br />

Mr ANDREW BURNET <strong>of</strong> Wariston carries the arms <strong>of</strong> Leys, as descended <strong>of</strong> Leys,<br />

within a bordure indented vert; crest, a branch <strong>of</strong> holly; with the motto, Virtute<br />

cresco. L. R.<br />

JOHN BURNET <strong>of</strong> Dalladies, descended' <strong>of</strong> the family <strong>of</strong> Leys, carries as Leys,<br />

within a bordure compone, argent and vert;, crest, a branch <strong>of</strong> holly slipped, pro-<br />

per: motto, Nee flitctu nee flatu. Ibid.
