82 Period <strong>of</strong> occupation <strong>of</strong> entitlement land<br />

(1) The governance entity may permit members <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) to occupy the entitlement land for<br />

any period or periods in a calendar year that do not exceed 210<br />

days in total.<br />

(2) The governance entity must not permit members <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) to occupy the entitlement land in<br />

a calendar year during the period beginning on 1 May and<br />

ending at the close <strong>of</strong> 15 August.<br />

83 Right to erect temporary dwellings<br />

(1) The governance entity may permit members <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>), while occupying the entitlement<br />

land under a Nohoanga entitlement, to erect camping shelters<br />

or similar temporary dwellings on the land.<br />

(2) The governance entity must ensure the removal <strong>of</strong> camping<br />

shelters or similar temporary dwellings erected on a entitlement<br />

land whenever the right to occupy the entitlement land is<br />

not being exercised.<br />

84 Condition <strong>of</strong> land when occupation ceases<br />

(1) The governance entity must, whenever members <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) permitted to occupy entitlement<br />

land under section 81 cease to occupy the land, leave the site in<br />

substantially the same condition as it was in at the beginning<br />

<strong>of</strong> the period when the governance entity was last entitled to<br />

permit members <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) to<br />

occupy the site.<br />

(2) The requirement to leave the site in substantially the same<br />

condition under subsection (1) includes the obligation to remove<br />

rubbish and waste from the entitlement land and any adjacent<br />

reserve.<br />

(3) Subsection (1) does not apply to temporary effects normally<br />

associated with occupation <strong>of</strong> entitlement land under a<br />

Nohoanga entitlement.<br />

85 Activities on entitlement land<br />

(1) This section applies subject to section 83.<br />

(2) The governance entity may, with the consent <strong>of</strong> the land<br />

holding agent, undertake other activities on entitlement land<br />
