Subpart 5—Nohoanga entitlements<br />

76 Interpretation<br />

In this subpart, unless the context otherwise requires,—<br />

entitlement land means a site over which a Nohoanga entitlement<br />

is granted<br />

land holding agent means the Minister <strong>of</strong> the Crown responsible<br />

for the department that manages the entitlement land, or<br />

the Commissioner <strong>of</strong> Crown Lands, as the case may be<br />

Nohoanga entitlement means an entitlement granted to the<br />

governance entity—<br />

(a) under this subpart; and<br />

(b) over the site described in Schedule 2, or a site granted as a<br />

replacement site under section 94 or section 95; and<br />

(c) on the terms and conditions referred to in section 77(3)<br />

Nohoanga site means a site—<br />

(a) described in Schedule 2; or<br />

(b) granted as a replacement site under section 94 or section<br />

95.<br />

77 Grant and renewal <strong>of</strong> Nohoanga entitlements<br />

(1) The Crown must, in accordance with this subpart, grant to the<br />

governance entity a Nohoanga entitlement over each<br />

nohoanga site.<br />

(2) The grant <strong>of</strong> a Nohoanga entitlement must be for an initial<br />

term <strong>of</strong> 10 years beginning on the settlement date.<br />

(3) The grant referred to in subsection (1) must be made on the<br />

terms and conditions referred to in Schedule 5.18 <strong>of</strong> the deed<br />

<strong>of</strong> settlement, or as varied in accordance with section 79.<br />

(4) Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) may renew a Nohoanga<br />

entitlement for further terms <strong>of</strong> 10 years unless the entitlement<br />

is terminated under section 94 or section 95.<br />

78 Notification <strong>of</strong> Nohoanga entitlement<br />

(1) The land holding agent must notify the grant <strong>of</strong> a Nohoanga<br />

entitlement in the Gazette.<br />

(2) The chief executive <strong>of</strong> Land Information New Zealand must<br />

note in his or her records the grant <strong>of</strong> an entitlement and the<br />

notice in the Gazette relating to it.<br />
