(2) The fee simple estate in Te Atua Reretahi vests in the governance<br />

entity, subject to the conservation covenant referred to in<br />

clause (4.2.2) 4.2.4 <strong>of</strong> the deed <strong>of</strong> settlement.<br />

(3) The conservation covenant referred in subsection (2) must be<br />

treated as a conservation covenant for the purposes <strong>of</strong> section<br />

77 <strong>of</strong> the Reserves Act 1977.<br />

30 Te Kaukahiwi o Tirotirowhetu<br />

(1) The reservation <strong>of</strong> Te Kaukahiwi o Tirotirowhetu as a scenic<br />

reserve subject to section 19 <strong>of</strong> the Reserves Act 1977 is<br />

revoked.<br />

(2) The fee simple estate in Te Kaukahiwi o Tirotirowhetu vests<br />

in the governance entity.<br />

(3) Te Kaukahiwi o Tirotirowhetu is declared a reserve and classified<br />

as a scenic reserve subject to section 19 <strong>of</strong> the Reserves<br />

Act 1977.<br />

(4) Despite section 16(10) <strong>of</strong> the Reserves Act 1977, the scenic<br />

reserve created under subsection (3) is named Te Kaukahiwi o<br />

Tirotirowhetu Scenic Reserve.<br />

(5) The governance entity is the administering body <strong>of</strong> Te<br />

Kaukahiwi o Tirotirowhetu Scenic Reserve for the purposes<br />

<strong>of</strong> the Reserves Act 1977.<br />

31 Otitapu Lookout<br />

(1) The reservation <strong>of</strong> Otitapu Lookout as a scenic reserve subject<br />

to section 19 <strong>of</strong> the Reserves Act 1977 is revoked.<br />

(2) The fee simple estate in Otitapu Lookout vests in the governance<br />

entity, subject to the protected private land agreement<br />

referred to in clause 4.4.4 <strong>of</strong> the deed <strong>of</strong> settlement.<br />

(3) The protected private land agreement referred to in subsection<br />

(2) must be treated as an agreement for the purposes <strong>of</strong> section<br />

76 <strong>of</strong> the Reserves Act 1977.<br />

(4) The Registrar-General must note a memorial on the computer<br />

freehold register <strong>of</strong> Otitapu Lookout that it is subject to a<br />

protected private land agreement.<br />

(5) If the parties agree to terminate the protected private land<br />

agreement referred to in subsection (2) the Registrar-General<br />

must, on receipt <strong>of</strong> notification to that effect from the Minister<br />
