<strong>Claims</strong> <strong>Settlement</strong> Part 4 cl 21<br />

(a) prescribe or restrict the period during which the governance<br />

entity may—<br />

(i) exist in law; or<br />

(ii) deal with property (including income derived<br />

from property); or<br />

(b) apply to a document entered into to give effect to the<br />

deed <strong>of</strong> settlement (including the deeds that grant (a<br />

right) rights <strong>of</strong> first refusal referred to in clauses 6.4.2<br />

and 6.5.1 <strong>of</strong> the deed <strong>of</strong> settlement) if the application <strong>of</strong><br />

that rule or the provisions <strong>of</strong> that Act would otherwise<br />

make the document, or a right conferred by the document,<br />

invalid or ineffective.<br />

Date when actions or matters must occur<br />

20 Timing <strong>of</strong> actions or matters<br />

(1) Actions or matters that occur, or are treated as if they had<br />

occurred, or are required to occur under this Act occur or take<br />

effect on the settlement date.<br />

(2) If a provision <strong>of</strong> this Act requires an action or matter to occur<br />

or take effect on a date other than the settlement date, that<br />

action or matter occurs or takes effect on that other date.<br />

General provisions<br />

21 Authority to issue, amend, or cancel protocols<br />

(1) Each responsible Minister may—<br />

(a) issue a protocol to the governance entity in the form set<br />

out in Schedules 5.1 to 5.3 <strong>of</strong> the deed <strong>of</strong> settlement;<br />

and<br />

(b) amend or cancel that protocol.<br />

(2) A protocol may be amended or cancelled under subsection (1) at<br />

the initiative <strong>of</strong> either—<br />

(a) the governance entity; or<br />

(b) the Minister who issued the protocol.<br />
