‘‘(25) Despite anything in this Act or in any other enactment or rule<br />

<strong>of</strong> law, on and from the settlement date (as defined in section 12<br />

<strong>of</strong> the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong><br />

Act 2004), the Tribunal does not have jurisdiction (including,<br />

without limitation, the jurisdiction to inquire or further inquire<br />

into, or to make a finding or recommendation) in respect <strong>of</strong>—<br />

‘‘(a) any or all <strong>of</strong> the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

historical claims, as defined in section 14 <strong>of</strong> the Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong> Act<br />

2004; or<br />

‘‘(b) the deed <strong>of</strong> settlement, as defined in section 12 <strong>of</strong> the<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong><br />

Act 2004; or<br />

‘‘(c) the redress provided to the governance entity (as<br />

defined in section 12 <strong>of</strong> the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong> Act 2004) under the deed <strong>of</strong><br />

settlement or under the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong> Act 2004; or<br />

‘‘(d) the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>Claims</strong> <strong>Settlement</strong><br />

Act 2004.<br />

‘‘(26) Subsection ((24)) (25) does not exclude the jurisdiction <strong>of</strong> the<br />

Tribunal in respect <strong>of</strong> the interpretation or enforcement <strong>of</strong> the<br />

deed <strong>of</strong> settlement or the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

<strong>Claims</strong> <strong>Settlement</strong> Act 2004.’’<br />

(1) Nothing in the enactments listed in subsection (2) applies to a<br />

cultural redress property or a commercial redress property.<br />

(2) The enactments are—<br />

(a) sections 8A to 8HJ <strong>of</strong> the Treaty <strong>of</strong> Waitangi Act 1975:<br />

(b) sections 27A to 27C <strong>of</strong> the State-Owned Enterprises<br />

Act 1986:<br />
