(v) any claim that a representative entity may have to<br />

the extent that the claim is, or is founded on a<br />

claim referred in subparagraph (iii).<br />

Part 3<br />

<strong>Settlement</strong> <strong>of</strong> historical claims and<br />

miscellaneous matters<br />

Subpart 1—<strong>Settlement</strong> <strong>of</strong> historical claims<br />

Jurisdiction <strong>of</strong> courts, etc, removed<br />

15 <strong>Settlement</strong> <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

historical claims final<br />

(1) The settlement <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical<br />

claims effected under the deed <strong>of</strong> settlement and this Act is<br />

final, and on and from the settlement date the Crown is<br />

released and discharged from all obligations and liabilities in<br />

respect <strong>of</strong> those claims.<br />

(2) Subsection (1) does not limit the acknowledgements expressed<br />

in, or the provisions <strong>of</strong>, the deed <strong>of</strong> settlement.<br />

(3) Despite any other enactment or rule <strong>of</strong> law, on and from<br />

settlement date, no court, tribunal, or other judicial body has<br />

jurisdiction (including, without limitation, the jurisdiction to<br />

inquire or further inquire into, or to make a finding or recommendation)<br />

in respect <strong>of</strong>—<br />

(a) any or all <strong>of</strong> the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

historical claims; or<br />

(b) the deed <strong>of</strong> settlement; or<br />

(c) the redress provided under this Act or under the deed <strong>of</strong><br />

settlement; or<br />

(d) this Act.<br />

(4) Subsection (3) does not exclude the jurisdiction <strong>of</strong> a court,<br />

tribunal, or other judicial body in respect <strong>of</strong> the interpretation<br />

or implementation <strong>of</strong> the deed <strong>of</strong> settlement or this Act.<br />

Treaty <strong>of</strong> Waitangi Act 1975 amended<br />

16 Jurisdiction <strong>of</strong> Tribunal to consider claims<br />

Section 6 <strong>of</strong> the Treaty <strong>of</strong> Waitangi Act 1975 is amended by<br />

inserting, after subsection (24), the following subsections:<br />
