Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />
<strong>Claims</strong> <strong>Settlement</strong> Part 2 cl 14<br />
(C) from fiduciary duty; or<br />
(D) otherwise; and<br />
(ii) arises from, or relates to, acts or omissions before<br />
21 September 1992—<br />
(A) by, or on behalf <strong>of</strong>, the Crown; or<br />
(B) by, or under, legislation; and<br />
(b) includes all claims to the Waitangi Tribunal to which<br />
paragraph (a) applies (and that relate exclusively to<br />
Ngāti <strong>Tuwharetoa</strong> (or a representative entity)), including<br />
the Wai 62 (claims) claim (Ngāti <strong>Tuwharetoa</strong> ki<br />
Kawerau Land Claim) made in February 1988 as<br />
amended by the following:<br />
(i) the undated statement <strong>of</strong> claims received by the<br />
Waitangi Tribunal on 19 October 1990:<br />
(ii) the statement <strong>of</strong> claim dated December 1990 and<br />
received by the Waitangi Tribunal on 12 April<br />
1991:<br />
(iii) the second amended statement <strong>of</strong> claim dated 16<br />
October 1995; but<br />
(c) does not include the following claims:<br />
(i) Wai 411 (Tarawera Forest Claim) filed with the<br />
Waitangi Tribunal on 14 June 1993 and amended<br />
on 26 April 2000:<br />
(ii) Wai 21 (Tasman Company Pollution Claim) filed<br />
with the Waitangi Tribunal on 26 April 1985 and<br />
amended on 23 October 1992 (except any further<br />
amendment to the Wai 21 claim to the extent that<br />
the further amendment is a claim referred to in<br />
paragraph (a)):<br />
(iii) any claim that a member <strong>of</strong> Ngāti <strong>Tuwharetoa</strong><br />
(<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>), or a hapū, group, family, or<br />
whānau referred to in section 13(1)(b)((ii)) had at, or<br />
at any time before, the settlement date, or may<br />
have at any time after the settlement date, that is,<br />
or is founded on, a right arising from being<br />
descended from an ancestor who is not a Ngāti<br />
<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) ancestor:<br />
(iv) any claim based on descent from a recognised<br />
ancestor <strong>of</strong> Te Tawera to the extent that (any) the<br />
claim is, or is founded on, a right arising from<br />
being descended from Awanuiarangi II:<br />
