<strong>Claims</strong> <strong>Settlement</strong><br />
New (unanimous)<br />
whāngai <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) means a<br />
Māori who is recognised as Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />
in accordance with Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) tikanga<br />
(customary values and practices).<br />

(4) For the purposes <strong>of</strong> the definitions <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> and<br />
Ngāti <strong>Tuwharetoa</strong> ancestor, a person is descended from<br />
another person if the person is descended from the other<br />
person by—<br />
(a) birth; or<br />
(b) legal adoption; or<br />
(c) Maori customary adoption in accordance with the custom<br />
<strong>of</strong> Ngāti <strong>Tuwharetoa</strong>.<br />

14 Meaning <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical<br />
claims<br />
In this Act, Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical<br />
claims—<br />
(a) means every claim (whether or not the claim has arisen<br />
or been considered, researched, registered, notified, or<br />
made on or before the settlement date) that Ngāti<br />
<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) (or a representative entity)<br />
had at, or at any time before, the settlement date, or may<br />
have at any time after the settlement date, that—<br />
(i) is, or is founded on, a right arising—<br />
(A) from the Treaty <strong>of</strong> Waitangi (Te Tiriti o<br />
Waitangi) or the principles <strong>of</strong> the Treaty <strong>of</strong><br />
Waitangi (Te Tiriti o Waitangi); or<br />
(B) under legislation or at common law<br />
(including in relation to aboriginal title or<br />
customary law); or<br />
