New (unanimous)<br />

(C) a whāngai <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>); and<br />

(b) includes—<br />

(i) the hapū <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>);<br />

and<br />

(ii) any hapū, group, family, or whānau composed <strong>of</strong><br />

individuals referred to in paragraph (a)(ii).<br />

(2) In this section and in section 14, Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>) ancestor means a person who exercised customary<br />

rights—<br />

(a) by virtue <strong>of</strong> being descended from—<br />

(i) <strong>Tuwharetoa</strong>:<br />

(ii) a recognised ancestor <strong>of</strong> any <strong>of</strong> the hapū <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>); and<br />

(b) predominantly in relation to the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong><br />

<strong>of</strong> <strong>Plenty</strong>) area <strong>of</strong> interest at any time after 6 February<br />

1840.<br />

(3) In this section,—<br />

customary rights means rights according to tikanga Māori<br />

(Māori customary values and practices), including the following<br />

(rights)—<br />

(a) rights to occupy land; and<br />

(b) rights in relation to the use <strong>of</strong>:<br />

(i) land:<br />

(ii) natural or physical resources<br />

hapū <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) means the following<br />

9 hapū being—<br />

(a) Umutahi:<br />

(b) Te Tawera:<br />

(c) Ngāti Peehi:<br />

(d) Ngāi Tamarangi:<br />

(e) Te Aotahi:<br />

(f) Ngāti Poutomuri:<br />

(g) Ngāti Iramoko:<br />

(h) Ngāti Irawharo:<br />

(i) Ngāti Manuwhare<br />
