Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

<strong>Claims</strong> <strong>Settlement</strong><br />

(a) sets out how the Ministry <strong>of</strong> Fisheries will interact with<br />

the governance entity on the matters specified in the<br />

protocol; and<br />

(b) provides for (Ngāti <strong>Tuwharetoa</strong>’s) the input <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) into the processes <strong>of</strong> that<br />

Ministry in relation to the matters specified in the protocol;<br />

and<br />

(c) is in the form set out in schedule 5.2 <strong>of</strong> the deed <strong>of</strong><br />

settlement<br />

fisheries protocol area means the area shown on the map<br />

attached to the fisheries protocol, together with the adjacent<br />

waters<br />

governance entity means the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>) <strong>Settlement</strong> Trust established in accordance with<br />

clause 2.1 <strong>of</strong> the deed <strong>of</strong> settlement<br />

Historic Places Trust means the New Zealand Historic<br />

Places Trust (Pouhere Taonga) continued by section 38 <strong>of</strong> the<br />

Historic Places Act 1993<br />

licensee, in relation to a Crown forestry licence, means the<br />

holder <strong>of</strong> the licence<br />

Struck out (unanimous)<br />

management plan, in relation to a national park, has the<br />

meaning given by section 2 <strong>of</strong> the National Parks Act 1980<br />

member <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) means every<br />

individual referred to in section 13(1)<br />

New Zealand Conservation Authority has the meaning<br />

given by section 2(1) <strong>of</strong> the Conservation Act 1987<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) and Ngāti <strong>Tuwharetoa</strong><br />

(<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) ancestor have the meanings set out in section<br />

13<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) area <strong>of</strong> interest means<br />

the area (<strong>of</strong> interest) identified in attachment 1.1 <strong>of</strong> the deed <strong>of</strong><br />

settlement as the area which Ngāti <strong>Tuwharetoa</strong> identifies as its<br />

area <strong>of</strong> interest, together with the adjacent waters and the<br />

Rurima Islands<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical claims has the<br />

meaning set out in section 14
