Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

<strong>Claims</strong> <strong>Settlement</strong> Part 2 cl 12<br />

(i) the schedules <strong>of</strong>, and attachments to, the deed;<br />

and<br />

(ii) any amendments to the deed (or to the attachments<br />

to the schedules <strong>of</strong> the deed), the attachments,<br />

or the schedules<br />

Director-General has the meaning given by section 2(1) <strong>of</strong><br />

the Conservation Act 1987<br />

DOC protocol means a protocol issued under section 21 by the<br />

Minister <strong>of</strong> Conservation that—<br />

(a) sets out how the Department <strong>of</strong> Conservation will interact<br />

with the governance entity on the matters specified<br />

in the protocol; and<br />

(b) provides for (Ngāti <strong>Tuwharetoa</strong>’s) the input <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) into (certain departmental)<br />

processes <strong>of</strong> the Department in relation to the matters<br />

specified in the protocol; and<br />

(c) is in the form set out in schedule 5.1 <strong>of</strong> the deed <strong>of</strong><br />

settlement<br />

DOC protocol area means the area shown on the map<br />

attached to the DOC protocol, together with the adjacent<br />

waters to the extent that they are administered by the Department<br />

<strong>of</strong> Conservation<br />

effective date means the date that is 6 months after the settlement<br />

date<br />

encumbrance means a tenancy, lease, licence, licence to<br />

occupy, easement, covenant, or other third party right that—<br />

(a) (whether registered or unregistered,) affects a cultural<br />

redress property and is listed in column 3 <strong>of</strong> Schedule 1; or<br />

(b) affects a commercial redress property and is part <strong>of</strong> the<br />

description <strong>of</strong> the commercial redress property in<br />

Schedules 6.1 and 6.2 <strong>of</strong> the deed <strong>of</strong> settlement<br />

fisheries legislation means—<br />

(a) the Fisheries Act 1983:<br />

(b) the Fisheries Act 1996:<br />

(c) all regulations made under either or both <strong>of</strong> those Acts<br />

that remain in force<br />

fisheries protocol means a protocol issued under section 21 by<br />

the Minister <strong>of</strong> Fisheries that—<br />
