Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

<strong>Claims</strong> <strong>Settlement</strong><br />

(b) consequential amendments to the Treaty <strong>of</strong> Waitangi<br />

Act 1975; and<br />

(c) the effect <strong>of</strong> the settlement on certain resumptive<br />

memorials; and<br />

(d) miscellaneous matters relating to the settlement, such as<br />

the exclusion <strong>of</strong> the law against perpetuities(,) and the<br />

timing <strong>of</strong> actions or matters(,) provided for in the Act.<br />

(5) Part 4 includes provisions relating to the following matters:<br />

(a) the issue <strong>of</strong> protocols to the governance entity by the<br />

Minister <strong>of</strong> Conservation, the Minister <strong>of</strong> Fisheries, and<br />

the Minister for Arts, Culture, and Heritage; and<br />

(b) the vesting in the governance entity <strong>of</strong> the fee simple<br />

estate in 5 cultural redress properties; and<br />

(c) an acknowledgement by the Crown <strong>of</strong> the statements<br />

made by Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>of</strong> their<br />

cultural, spiritual, historical, and traditional association<br />

with 7 statutory areas, with provision for entering into<br />

deeds <strong>of</strong> recognition in relation to 5 statutory areas,<br />

together with provisions as to the effect <strong>of</strong> these instruments;<br />

and<br />

(d) an acknowledgement by the Crown <strong>of</strong> the statements<br />

made by Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>of</strong> their<br />

cultural, spiritual, historical, and traditional association<br />

with the geothermal energy and geothermal water<br />

located in the Kawerau Geothermal system, together<br />

with provisions as to the effect <strong>of</strong> this instrument; and<br />

(e) the establishment <strong>of</strong> a joint advisory committee to perform<br />

specified functions in relation to 3 cultural redress<br />

properties and retained sites; and<br />

(f) the grant <strong>of</strong> renewable Nohoanga entitlements over a<br />

Nohoanga site; and<br />

(g) an acknowledgement <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />

<strong>Plenty</strong>) values in relation to the site declared as<br />

Owhakatihi in the Parimahana Scenic Reserve.<br />

(6) Part 5 sets out provisions relating to the transfer <strong>of</strong> commercial<br />

redress properties and related matters.<br />

(7) There are 9 schedules that—<br />

(a) describe the cultural redress properties; and<br />

(b) describe the areas over which statutory acknowledgements<br />

are made, and set out the texts <strong>of</strong> the statements<br />
