Acknowledgements and apology by the Crown to<br />
Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>), and<br />
preliminary provisions<br />
3 Purpose<br />
The purpose <strong>of</strong> this Act is to—<br />
(a) record the acknowledgements and apology given by the<br />
Crown to Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) in the deed<br />
<strong>of</strong> settlement dated 6 June 2003 and signed by the<br />
Minister in Charge <strong>of</strong> Treaty <strong>of</strong> Waitangi Negotiations,<br />
the Honourable Margaret Wilson, for the Crown, and<br />
by Rae Beverley Adlam, the Reverend Canon Robert<br />
David Schuster, Tai Tukiwaho Te Riini, and Ani Te<br />
Waikaretu Wickliffe for Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong><br />
<strong>Plenty</strong>); and<br />
(b) give effect to certain provisions <strong>of</strong> the deed <strong>of</strong> settlement,<br />
which is a deed that settles the Ngāti <strong>Tuwharetoa</strong><br />
(<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical claims.<br />
4 Act binds the Crown<br />
This Act binds the Crown.<br />
5 Outline<br />
(1) This section is a guide to the overall scheme and effect <strong>of</strong> this<br />
Act, but does not affect the interpretation or application <strong>of</strong> the<br />
other provisions <strong>of</strong> this Act or <strong>of</strong> the deed <strong>of</strong> settlement.<br />
(2) Part 1 includes the preliminary provisions relating to the commencement<br />
and purpose <strong>of</strong> the Act and records the acknowledgements<br />
and apology given by the Crown to Ngāti<br />
<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) in the deed <strong>of</strong> settlement.<br />
(3) Part 2 defines terms used in this Act, including key terms such<br />
as Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) and Ngāti<br />
<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical claims.<br />
(4) Part 3 provides that the settlement <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong><br />
<strong>of</strong> <strong>Plenty</strong>) historical claims is final, and deals with related<br />
issues, including—<br />
(a) the effect <strong>of</strong> the settlement on the jurisdiction <strong>of</strong> a court,<br />
tribunal, or other judicial body to consider the Ngāti<br />
<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) historical claims; and<br />
