industry were also stated to be grievances <strong>of</strong> Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>):<br />

(41) Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) and the Crown signed<br />

terms <strong>of</strong> negotiation on 8 September 1998 which specified the<br />

scope, objectives, and general procedures for negotiations:<br />

(42) Under the terms <strong>of</strong> negotiation, the mandated negotiators<br />

confirmed to the Crown that they had a mandate to represent<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) in negotiations with the<br />

Crown for settlement <strong>of</strong> all the historical claims:<br />

(43) Substantive negotiations between the Crown and Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) began in October 1998. These<br />

negotiations addressed all the historical grievances raised by<br />

Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) including the native land<br />

laws, individualisation <strong>of</strong> title, and public works legislation.<br />

The Crown and Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) agreed on<br />

the scope <strong>of</strong> the total redress package in December 2000, and<br />

the Crown made a settlement <strong>of</strong>fer in January 2001:<br />

(44) The Crown and Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) initialled a<br />

deed <strong>of</strong> settlement on 22 October 2002. Ngāti <strong>Tuwharetoa</strong><br />

(<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) ratified the Crown’s settlement <strong>of</strong>fer and<br />

entered into a deed <strong>of</strong> settlement on 6 June 2003 recording<br />

matters to give effect to a full and final settlement <strong>of</strong> all the<br />

historical claims <strong>of</strong> Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>):<br />

The Parliament <strong>of</strong> New Zealand therefore enacts as follows:<br />

1 Title<br />

This Act is the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) <strong>Claims</strong><br />

<strong>Settlement</strong> Act 2004.<br />

2 Commencement<br />

This Act comes into force on the day after the date on which it<br />

receives the Royal assent.<br />
