Tasman Pulp and Paper Company Enabling Act 1954<br />
authorised the discharge <strong>of</strong> waste from the mill into the<br />
Tarawera River in accordance with Pollution Advisory Council<br />
guidelines.<br />
(35) With the passing <strong>of</strong> the Geothermal Energy Act 1953, the<br />
Crown established for itself, without the consent <strong>of</strong> Ngati<br />
<strong>Tuwharetoa</strong>, the sole right to the geothermal energy resource.<br />
In relation to the Kawerau geothermal field, this has resulted<br />
in Ngati <strong>Tuwharetoa</strong> losing control <strong>of</strong> and access to geothermal<br />
resources in the area.<br />
<strong>Settlement</strong> negotiations<br />
(36) Ngati <strong>Tuwharetoa</strong> submitted a deed <strong>of</strong> mandate to the Crown<br />
in January 1998 and the Crown recognised the mandate in<br />
March 1998. Negotiators were mandated at a hui-a-iwi at<br />
Umutahi marae, Matata, and negotiations with the Crown<br />
commenced.<br />
(37) In August 1998, Ngati <strong>Tuwharetoa</strong> presented the Crown with<br />
a detailed statement <strong>of</strong> all the historical grievances <strong>of</strong> the iwi<br />
prior to 1992 to be addressed alongside the Wai 62 claim. The<br />
grievances that Ngati <strong>Tuwharetoa</strong> presented included the<br />
ongoing impact <strong>of</strong> the raupatu on Ngati <strong>Tuwharetoa</strong>, subsequent<br />
alienation <strong>of</strong> wrongly confiscated lands, the loss <strong>of</strong> use,<br />
control, and benefits <strong>of</strong> these lands and resources including<br />
waterways. The drainage <strong>of</strong> the Rangitaiki wetlands, loss <strong>of</strong><br />
geothermal resource (a key taonga <strong>of</strong> Ngati <strong>Tuwharetoa</strong>), and<br />
the impact on Ngati <strong>Tuwharetoa</strong> <strong>of</strong> the development <strong>of</strong> the<br />
Kawerau township and the pulp and paper industry were also<br />
stated to be grievances <strong>of</strong> Ngati <strong>Tuwharetoa</strong>.<br />
(38) Ngati <strong>Tuwharetoa</strong> and the Crown signed terms <strong>of</strong> negotiation<br />
on 8 September 1998 which specified the scope, objectives,<br />
and general procedures for negotiations.<br />
(39) Under the terms <strong>of</strong> negotiation, the mandated negotiators<br />
confirmed to the Crown that they had a mandate to represent<br />
Ngati <strong>Tuwharetoa</strong> in negotiations with the Crown for settlement<br />
<strong>of</strong> all the historical claims.<br />
