Background in English<br />

(1) The Treaty <strong>of</strong> Waitangi (Te Tiriti o Waitangi), as set out in<br />

English and in Maori in the Schedule 1 <strong>of</strong> the Treaty <strong>of</strong><br />

Waitangi Act 1975, was signed in 1840:<br />

(2) Recitals (3) to (40) <strong>of</strong> this Preamble present, in summary<br />

form, the background to the Ngati <strong>Tuwharetoa</strong> historical<br />

claims that is set out in the deed <strong>of</strong> settlement entered into by<br />

Ngati <strong>Tuwharetoa</strong> and the Crown:<br />

Rohe <strong>of</strong> Ngati <strong>Tuwharetoa</strong><br />

(3) Ngati <strong>Tuwharetoa</strong> describe their rohe as running from<br />

Otamarakau following the Waitahanui Stream to Otari to<br />

Motuotara to Maungawhakamana to Ngarararua in<br />

Haehaenga territory to Kākahuoteritenga to Waikareao to<br />

Maraetahia to Monehu to Okorotere to Panepane to Pūtauaki<br />

to Tāhuna to Rakeihopukia to Wahieroa to Rurima to<br />

Otamarakau. The rohe <strong>of</strong> Ngati <strong>Tuwharetoa</strong> as described<br />

extends beyond the confiscation lines. The Rangitaiki and<br />

Tarawera rivers are the major rivers within the rohe. Significant<br />

tribal pūkorero are connected to these tribal landmarks.<br />

(4) As tangata whenua <strong>of</strong> the described rohe, places <strong>of</strong> historical<br />

and cultural significance to Ngati <strong>Tuwharetoa</strong> include<br />

Otamarakau, Otari, Motuotara, Maungawhakamana,<br />

Ngarararua, Haehaenga, Kakahu-o-te-Ritenga, Waikareao,<br />

Maraetahia, Te Monehu, Okorotere, Panepane, Putauaki,<br />

Tahuna, Rakeihopukia, Wahieroa, Rurima Islands,<br />

Otaramuturangi, Paniwhaniwha (Ngapariwhakairo), MaNgati,<br />

Tūwatawata, Te Waikoukou, Moturoa, Puketapu,<br />

Otukoiro, Te Kiore Pohoroa, Korotiwha, Otitapu, Paokoroiti,<br />

Te Pataua, Te Pakipaki, Tainapekapeka, Taumanawa,<br />
