Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>)<br />

<strong>Claims</strong> <strong>Settlement</strong><br />

(i) that relate to the time, location, or manner <strong>of</strong><br />

access; (or) and<br />

(ii) that are reasonably required for public safety or<br />

for the protection <strong>of</strong> land, improvements, flora<br />

and fauna, plant, equipment, (or) and livestock,<br />

or for operational reasons.<br />

(3) In this section, protected site means any area <strong>of</strong> land situated<br />

in the redress licensed land that—<br />

(a) becomes a registered place within the meaning <strong>of</strong> the<br />

Historic Places Act 1993; and<br />

(b) is wāhi tapu or a wāhi tapu area with the meaning <strong>of</strong> that<br />

Act.<br />

130 Right <strong>of</strong> access subject to Crown forestry licence<br />

(1) The right <strong>of</strong> access conferred by section 129 is subject to the<br />

terms <strong>of</strong> any Crown forestry licence in relation to the land,<br />

except where the licensee has agreed to an exercise <strong>of</strong> the<br />

right.<br />

(2) An amendment to a Crown forestry licence, or the grant <strong>of</strong> a<br />

new licence, is <strong>of</strong> no effect to the extent that it purports to—<br />

(a) delay the date from which a person who has a right <strong>of</strong><br />

access under section 129 may exercise that right; or<br />

(b) otherwise adversely affect the right conferred by section<br />

129.<br />

131 Right <strong>of</strong> access must be noted on title<br />

A memorandum <strong>of</strong> transfer referred to in section 120 in relation<br />

to the redress licensed land must include an application to the<br />

Registrar-General to note on the computer freehold registers<br />

specified in the memorandum <strong>of</strong> transfer that the land is subject<br />

to the right <strong>of</strong> access conferred by section 129.<br />
