126 Redress licensed land ceases to be Crown forest land<br />

On the redress licensed land settlement date the redress<br />

licensed land ceases to be Crown forest land.<br />

The redress licensed land ceases to be Crown forest land<br />

immediately on registration <strong>of</strong> the fee simple estate in the<br />

governance entity.<br />

127 Governance entity confirmed beneficiary in respect <strong>of</strong><br />

redress licensed land<br />

(1) On and from the redress licensed land settlement date, the<br />

governance entity is, in relation to the redressed licensed<br />

land,—<br />

(a) the confirmed beneficiary under clause 11.1 <strong>of</strong> the<br />

Crown forestry rental trust deed; and<br />

(b) the representative referred to in clause 11.5(c) <strong>of</strong> that<br />

deed.<br />

(2) On the redress licensed land settlement date, the Crown must<br />

give notice under section 17(4)(b) <strong>of</strong> the Crown Forest Assets<br />

Act 1989 in respect <strong>of</strong> the redress licensed land as if that<br />

section applies to the redress licensed land, even though the<br />

Waitangi Tribunal has not made a recommendation under<br />

section 8HB(1)(a) <strong>of</strong> the Treaty <strong>of</strong> Waitangi Act 1975 for the<br />

return <strong>of</strong> the redress licensed land.<br />

(3) Notice given by the Crown under subsection (2) has effect as if<br />

the Waitangi Tribunal had made a recommendation under<br />

section 8HB(1)(a) <strong>of</strong> the Treaty <strong>of</strong> Waitangi Act 1975 for the<br />

return <strong>of</strong> the redress licensed land and that recommendation<br />

had become final on the redress licensed land settlement date.<br />

(4) In this section, Crown forestry rental trust deed means the<br />

trust deed made on 30 April 1990 establishing the Crown<br />

forestry rental trust under section 34 <strong>of</strong> the Crown Forest<br />

Assets Act 1989.<br />
