(b) is enforceable on its terms despite Part IIIB <strong>of</strong> the<br />

Conservation Act 1987.<br />

(3) In this section, conservation land means land held under the<br />

Conservation Act 1987.<br />

122 Creation <strong>of</strong> computer register<br />

(1) This section applies to a commercial redress property to the<br />

extent that—<br />

(a) the property is not all <strong>of</strong> the land contained in a certificate<br />

<strong>of</strong> title or computer freehold register; or<br />

(b) there is no certificate <strong>of</strong> title or computer freehold register<br />

for all or part <strong>of</strong> the property.<br />

(2) The Registrar-General must, on written application by an<br />

appropriate person, comply with subsection (3).<br />

(3) The Registrar-General must, in accordance with the application,<br />

create 1 or more computer freehold registers in the name<br />

<strong>of</strong> the Crown subject to, and together with, any encumbrances<br />

that are registrable or notifiable and that are described in the<br />

written application.<br />

(4) A computer freehold register created in accordance with subsection<br />

(3) must be created in the name <strong>of</strong> the Crown without<br />

any statement <strong>of</strong> purpose.<br />

(5) The appropriate person may grant a covenant to arrange for<br />

the later creation <strong>of</strong> 1 or more computer freehold registers for<br />

a property that is to be transferred to the governance entity.<br />

(6) Despite the Land Transfer Act 1952,—<br />

(a) the appropriate person may request the Registrar-<br />

General to register a covenant referred to in subsection (5)<br />

under the Land Transfer Act 1952 by creating a computer<br />

interest register; and<br />

(b) the Registrar-General must register the covenant in<br />

accordance with paragraph (a).<br />

(7) In this section, appropriate person means the person who is<br />

authorised by the chief executive <strong>of</strong> the transferor agency (as<br />

defined in clause 11.1 <strong>of</strong> the deed <strong>of</strong> settlement).<br />

123 Application <strong>of</strong> other enactments<br />

(1) Nothing in section 11 or Part X <strong>of</strong> the Resource Management<br />

Act 1991 applies to—<br />
