118 Rights not affected<br />

(1) Sections 103 and 104 do not affect the lawful rights or interests<br />

<strong>of</strong> any person who is not a party to the deed <strong>of</strong> settlement.<br />

(2) This section applies subject to the express provisions <strong>of</strong> this<br />

subpart.<br />

119 Limitation <strong>of</strong> rights<br />

(1) Sections 103 and 104 do not have the effect <strong>of</strong> granting, creating,<br />

or providing evidence <strong>of</strong> any estate or interest in, or any<br />

rights <strong>of</strong> any kind relating to, an Owhakatihi.<br />

(2) This section applies subject to the other express provisions <strong>of</strong><br />

this subpart.<br />

Part 5<br />

Commercial redress<br />

Transfer <strong>of</strong> commercial redress properties<br />

120 Transfer <strong>of</strong> commercial redress properties<br />

(1) To give effect to clause 6.3 <strong>of</strong> the deed <strong>of</strong> settlement, the<br />

Crown (acting through the Commissioner <strong>of</strong> Crown Lands) is<br />

authorised to do 1 or more <strong>of</strong> the following:<br />

(a) transfer the fee simple estate in a commercial redress<br />

property to (the trustees <strong>of</strong>) the governance entity:<br />

(b) sign a memorandum <strong>of</strong> transfer or other document, or<br />

do any other thing to execute such a transfer.<br />

(2) In exercising the powers conferred by subsection (1), the Crown<br />

is not required to comply with any other enactment that would<br />

otherwise regulate or apply to the transfer <strong>of</strong> a commercial<br />

redress property.<br />

(3) Subsection (2) applies subject to section 123(2).<br />

121 Minister <strong>of</strong> Conservation may grant easements<br />

(1) The Minister <strong>of</strong> Conservation may grant any easement over<br />

conservation land required by clause 6.3.6 <strong>of</strong> the deed <strong>of</strong><br />

settlement.<br />

(2) An easement granted under subsection (1)—<br />

(a) is registrable under 17ZA(2) <strong>of</strong> the Conservation Act<br />

1987 as if it were a deed to which that provision<br />

applied; and<br />
