(c) enable the taking <strong>of</strong> action under (section 108 or section<br />

110) sections 110 to 114.<br />

(2) This section does not limit sections 117 to 119.<br />

106 Agreement on protection principles<br />

The governance entity and the Crown may agree on specific<br />

protection principles that aim to avoid harm to, or diminution<br />

<strong>of</strong>, the Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) values in relation to<br />

the Owhakatihi.<br />

107 New Zealand Conservation Authority and Conservation<br />

Boards to have particular regard to Ngāti <strong>Tuwharetoa</strong><br />

(<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) values<br />

When the New Zealand Conservation Authority or any Conservation<br />

Board approves or otherwise considers any general<br />

policy or conservation documents in relation to the Owhakatihi,<br />

it must have particular regard to—<br />

(a) Ngāti <strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) values in relation to<br />

the Owhakatihi; and<br />

(b) any protection principles agreed between the governance<br />

entity and the Crown under section 106.<br />

108 New Zealand Conservation Authority and relevant<br />

Conservation Boards to consult with governance entity<br />

The New Zealand Conservation Authority or relevant Conservation<br />

Board must consult with the governance entity and<br />

have particular regard to its views as to the effect on Ngāti<br />

<strong>Tuwharetoa</strong> (<strong>Bay</strong> <strong>of</strong> <strong>Plenty</strong>) values in relation to the Owhakatihi<br />

<strong>of</strong> any general policy or conservation document referred<br />

to in section 107.<br />

109 Notification <strong>of</strong> Owhakatihi<br />

(1) The declaration <strong>of</strong> the Owhakatihi must be identified and<br />

described in all conservation documents affecting the site.<br />

(2) The noting <strong>of</strong> the Owhakatihi under subsection (1)—<br />

(a) is for the purpose <strong>of</strong> public notice only; and<br />

(b) is not an amendment to a conservation document for the<br />

purposes <strong>of</strong> section 17I <strong>of</strong> the Conservation Act 1987 or<br />

section 46 <strong>of</strong> the National Parks Act 1980.<br />
