Clearly, the number <strong>of</strong> "uneventful" EMC proceedings<br />
far outnumber those having some obvious or perceived<br />
problem. The frequency and nature <strong>of</strong> these problems<br />
have been identified in this evaluation as input to<br />
the forthcoming decision on; continuation <strong>of</strong> EMC. The<br />
evaluation uncovers the rate at which these problems<br />
occur and provides a basis for determining the proba-<br />
bility <strong>of</strong> more serious' problems occurring.<br />
3. Summary <strong>of</strong> Attitudinal Data<br />
.<br />
Attitudinal data, presented in Section V and summarized<br />
below, present a considerably more skeptical though<br />
mixed picture than event specific'data. However, shifts<br />
in attitude due to time and experience are almost always<br />
in a direction more favorable towards EMC.<br />
The following summary statements about the attitudes <strong>of</strong><br />
-* judges, attorneys, and jurors should be viewed in combin-<br />
ation with the comparative perspective <strong>of</strong>fered earlier<br />
by the event-specific data. When considered together,<br />
these data provide a more definitive answer to the eval-<br />
uation questions posed than provided by either data<br />
group viewed in isolation. .<br />
0 As <strong>of</strong> July, 1981 judges (61%), prosecutors (79%),<br />
and defenders (90%), all strongly disagree with .<br />
the removal <strong>of</strong> the party consent requirement as<br />
a condition for EMC <strong>of</strong> criminal proceedings.<br />
0 As <strong>of</strong> July, 1981 judges (69%)and prosecutors (70%)<br />
approve <strong>of</strong> EMC for appellate proceedings. Only<br />
30% <strong>of</strong> defenders approve <strong>of</strong> appellate EMC.<br />
l & <strong>of</strong> July 1981, 58% <strong>of</strong> judges, 43% <strong>of</strong> prosecutors,<br />
and 20% <strong>of</strong> defenders approve <strong>of</strong> EMC for civil<br />
proceedings.<br />
