coverage in the time and manner described and as limited by the<br />

provisions <strong>of</strong> this section unless a party to the proceeding<br />

objects in writing and shows to the satisfaction <strong>of</strong> the<br />

presiding judge that special circumstances exist that make<br />

audio-visual coverage <strong>of</strong> the proceeding qualitatively different<br />

from other types <strong>of</strong> news coverage and that make such coverage<br />

undesirable. Any news agency intending to provide coverage<br />

shall be afforded an opportunity to be heard with respect to any<br />

such objection.<br />

5. Factors to Consider. In determining pursuant<br />

to subdivision 4 <strong>of</strong> this section whether audio-visual coverage<br />

<strong>of</strong>' a particular proceeding would be qualitatively different from<br />

other types <strong>of</strong> news coverage and undesirable, the presiding<br />

judge shall take into account the following factors:<br />

(a) the type <strong>of</strong> case involved:<br />

(b) whether such coverage would cause harm to any<br />

participant in the proce,eding or otherwise interfere with the<br />

fair administration <strong>of</strong> justice, the advancement <strong>of</strong> a fair trial<br />

or the constitutional rights <strong>of</strong> the parties: or<br />

(cl whether such coverage would interfere with any<br />

law enforcement investigation.<br />

6. Limiting Restrictions. In the event that the<br />

presiding judge finds that special circumstances warranting<br />

restrictions on audio-visual coverage exist, he shall limit such<br />

restrictions so as to allow for the maximum amount <strong>of</strong> such<br />
