W "Covert or undercover capacity" shall mean law<br />
enforcement activity involving criminal investigation by peace<br />
or police <strong>of</strong>ficers who usually and customarily wear no uniform,<br />
badge,' or other <strong>of</strong>ficial identification in public view.<br />
2. Authorization. Notwithstanding the provisions<br />
<strong>of</strong> section fifty-two <strong>of</strong> the civil rights law and subject to the<br />
provisions <strong>of</strong> this section, all state civil and criminal court<br />
proceedings open to the public, including but not limited to<br />
trials, pleas, arraignments, motion practice and hearings, and<br />
sentencings, shall, upon written request .presented to the<br />
presiding judge, be subject to audio-visual coverage as provided<br />
for in this section.<br />
3. Notice <strong>of</strong> Intent to provide audio-visual<br />
coverage. Any news agency planning to provide audio-visual<br />
coverage'<strong>of</strong> a court proceeding or any part <strong>of</strong> a<br />
court. proceeding<br />
shall give reasonable and written notice to the presiding judge<br />
<strong>of</strong> its intent to provide such coverage. The notice need not be<br />
in any particular form, but shall specify the type <strong>of</strong> coverage<br />
to be provided and identify the. proceeding <strong>of</strong> which the news<br />
agency intends to provide audio-visual coverage. The presiding<br />
. judge shall then inform the party or parties to the proceeding<br />
<strong>of</strong> the news agency's intent to provide coverage.<br />
4. Objections to Audio-Visual Coverage. Once<br />
notice has been given pursuant to subdivision'3 <strong>of</strong> this section,<br />
the news agency giving notice shall have the right to commence<br />
