on television or their concern about being viewed by the general public<br />

(including acquaintances) outside the courtroom as participants in a<br />

publicized legal controversy. There is also a more frequent necessity<br />

for sequestering jurors, which can markedly increase the personal<br />

15. Minn. Stat. § 631.04 a<br />

w s cited to the Commission by one <strong>of</strong> the I<br />

witnesses speaking in opposition to video and audio coverage <strong>of</strong> trial<br />

court proc edings. It provides as follows:<br />

No person under the age <strong>of</strong> 17 years, not a party to<br />

witness in, or directly interested in a criminal prosecution<br />

or trial being heard before any district, municipal, police,<br />

or justice court, shall attend or be present at such trial;<br />

and every police <strong>of</strong>ficer, constable, sheriff or other <strong>of</strong>ficer<br />

in charge’ <strong>of</strong> any such court and attending u$n the trial <strong>of</strong><br />

any such criminal case in any such court shall exclude from<br />

the room in which such. trial is being had everv such minor<br />

except when he is permitted to attend bv order-<strong>of</strong> the court<br />

before which the trial shall be had; and every police <strong>of</strong>ficer,<br />

constable, sheriff, or deputy sheriff who shall knovinglv<br />

neglect or refuse to carry out the provisions <strong>of</strong> this seition<br />

shall be guilty <strong>of</strong> a misdemeanor and punished by a fine <strong>of</strong> not<br />

less than $10 .nor more than $25,<br />

It was pointed out that telecasting part or all <strong>of</strong> criminal proceedings<br />

would permit them to be viewed outside <strong>of</strong> the courtrocm by persons within<br />

the purview <strong>of</strong> the statute.<br />

As <strong>of</strong> &gust 6, 1981, thirty-three states permitted some kind<br />

television and audio coverage. ?lost <strong>of</strong> these states require some kind<br />

consent or approval. Six <strong>of</strong> these states, including <strong>Minnesota</strong>, permit<br />

coverage only at the appellate level. Of these thirty-three states,<br />
