Payment will be made for every eligible day beyond the original<br />

contract completion date at the rate determined by 109.05.D.2.f.i. Payment for<br />

eligible days occurring during an unanticipated construction period will be<br />

calculated in accordance with 109.05.D.2.f.ii. Payment for eligible days occurring<br />

during an unanticipated winter period will be calculated in accordance with<br />

109.05.D.2.f.iii.<br />

(i) Home Office Overhead Daily Rate<br />

Calculate the home <strong>of</strong>fice overhead daily rate using the following<br />

Daily HOOP = (A × C)/B<br />

Where:<br />

A = original contract amount<br />

B = contract duration in Calendar Days<br />

C = value from Table 109.05-5<br />

Contract duration term, B, includes every Calendar Day from the<br />

execution <strong>of</strong> the Contract, unless otherwise specified by the Director, to the<br />

original Contract Completion Date.<br />

When the Contractor requests home <strong>of</strong>fice overhead<br />

compensation for a subcontractor, use the above formula to calculate the<br />

subcontractor’s Daily HOOP; however, in the subcontractor calculation, A is equal<br />

to the subcontractor’s portion <strong>of</strong> the original contract amount as determined by the<br />

sum <strong>of</strong> all approved C-92’s issued for the subcontracted work.<br />

(ii) Home Office Overhead Payment for an Unanticipated<br />

<strong>Construction</strong> Period<br />

Calculate the home <strong>of</strong>fice overhead payment for an unanticipated<br />

construction period occurring between May 1 <strong>and</strong> November 30 using the<br />

following formula:<br />

CP HOOP = Daily HOOP × D<br />

Where:<br />

D = sum <strong>of</strong> all excusable, compensable delays in Calendar Days minus the<br />

sum <strong>of</strong> all delays due to 108.06.D.1 <strong>and</strong> 108.06.D.4 in Calendar Days<br />

Daily HOOP = daily home <strong>of</strong>fice overhead rate
