G. Requires concrete beams to be installed with less than 17' vertical clearance<br />

over a state highway.<br />

H. Changes the design <strong>of</strong> overhead sign supports <strong>and</strong> breakaway sign supports.<br />

I. Changes the type <strong>of</strong> noise barriers.<br />

J. Changes the type or buildup <strong>of</strong> permanent pavement.<br />

K. Changes prescribed sequence <strong>of</strong> operations for the work as originally<br />

contemplated <strong>and</strong>/or the method for maintaining traffic.<br />

L. Compromises controlling design criteria or would require a design exception<br />

as discussed in Volume I, Section 100, <strong>of</strong> the Location <strong>and</strong> Design Manual.<br />

M. Includes cost savings based on revisions <strong>of</strong> utility relocations or other similar<br />

items to be done by other non-contract parties.<br />

N. Causes additional work, increases the cost, or causes modifications to<br />

adjacent projects.<br />

Engineering <strong>and</strong> drawing development <strong>and</strong> implementation costs for the VECP<br />

are not recoverable.<br />

The Contractor shall have no claim against the <strong>Department</strong> for any costs or<br />

delays due to the <strong>Department</strong>’s review or rejection <strong>of</strong> the initial VECP.<br />

If the <strong>Department</strong> already is considering revisions to the contract which are<br />

subsequently proposed as a VECP, the <strong>Department</strong> may reject the Contractor’s<br />

initial VECP or portions there<strong>of</strong> <strong>and</strong> may proceed with such revisions without any<br />

obligations to the Contractor.<br />

106 CONTROL OF MATERIAL<br />

106.01 Source <strong>of</strong> Supply <strong>and</strong> Quality Requirements. Notify the Engineer <strong>of</strong><br />

the proposed sources <strong>of</strong> supply before the delivery <strong>of</strong> materials. The Engineer may<br />

approve materials at the source <strong>of</strong> supply before delivery. If the proposed sources<br />

<strong>of</strong> supply cannot produce the specified material, then furnish materials from<br />

alternate sources without adjustment to the Contract Price or Completion Date.<br />

106.02 Samples, Tests, <strong>and</strong> Cited <strong>Specifications</strong>. The Engineer will inspect<br />

<strong>and</strong> determine whether the materials comply with the specified requirements<br />

before they are incorporated into the Work. The <strong>Department</strong> may sample <strong>and</strong> test<br />

materials or require certifications. Unless specified, the <strong>Department</strong> will pay for<br />

<strong>and</strong> test materials according to AASHTO, ASTM, or the methods on file in the<br />

<strong>of</strong>fice <strong>of</strong> the Engineer. A qualified representative <strong>of</strong> the <strong>Department</strong> will take test<br />

samples according to <strong>Department</strong>al procedures. Read any reference to other<br />

specifications or testing methods to mean the version in effect at the pertinent<br />

Project Advertisement date. All materials being used are subject to inspection,<br />

test, or rejection at any time before their incorporation into the Work. The<br />

<strong>Department</strong> will furnish copies <strong>of</strong> the tests to the Contractor’s representative upon<br />
