Frank Palma Suit Heads
Back To Court
Small Claims Award Irks Pro Bono Lawyer:
Immediate Relief Sought By Grumpy Law Firm
By Ray Shine, Editor
When Frank Palma, Vice Crimes,
was awarded a modest civil judgment
against a local attorney who
nearly blinded him with a pocket
camera during a courtroom stunt, he
thought that would be the end of it.
Not so.
Now the lawyer, Andrew Monach,
wants another snapshot of Frank.
Backed by the deep pockets of
Morrison&Foerster, the downtown
law firm that employs him, Monach
is appealing the civil judgment in
San Francisco Superior Court.
Commentanj
In the December issue of the POA
Notebook we explained the incident
which injured Frank, and sent him
into small claims court to seek his
remedy. As you recall, Frank was a
witness testifying before the Police
Commission in the infamous
Harrison Street case of 1995. While
sitting on the stand, clever litigator
Monach shoved a camera in Frank's
face and set off the flash strobe.
Frank walked out of the chamber
with scorched retinas, and subsequently
sued.
That stunt was intended to prove
to the stunned Commissioners that
Frank was lying when he testified to
not seeing certain actions of police
scheduled each day from 4:15 to
Police-Fire Post 456 sponsors three
young men every year to Boys' State.
We already have two strong candidates
for Boys' State. If you know a
"squared-away" young man, who is
currently a Junior in High School,
who would be interested in being
sponsored to Boys' State by Police-
Fire 456, let me know as soon as
possible. You can contact me at the
Talk about the "new breed"! The
Army is switching to computerized
dog tags that contain the soldier's
medical records on a microchip.
What's up with that? Folk singer
and admitted communist for nearly
sixty years, Pete Seeger, delivered
the annual "Meaning of Freedom"
lecture to West Point's junior class.
West Point Superintendent Lt. Gen.
Daniel W. Christman invited Seeger.
When asked why Seeger was invited
officers because flash devices had
temporarily blinded him.
Incidentally, Monach and his associates
were representing the 0CC
in that case, working Pro Bono on
behalf of the agency. He was also not
very effective in that effort.
Although the presentation of an
appeal will cost considerably more
than the straight pay-out to Frank,
Monach intends to stand on his principles,
whatever those might be. What
that means for Frank is another goround
in court, another string of
witnesses and experts, another delay
in the justice that he seeks. Fortunately,
Frank has competent and
dedicated counsel in the person of
Dave Commins, a lawyer who doesn't
tuck-tail for the likes of
Morrison&Foerster.
What Frank will need the most is
a demonstration of support from the
rank-and-file of the Department. The
message he wants to send to the
Court is that San Francisco police
officers do not tolerate smears and
set-ups of conscientious officers by
Ivy-Leaguers with Attitudes.
Help Frank send that message.
Show up in Department #1, SF Superior
Court on the day the appeal
will be heard. It is tentatively scheduled
for Thursday, March 12, 1998
at 0900 hours. Contact Frank Palma
at Vice Crimes, or call the office of his
attorney, Dave Commins, (415)391-
6490, to confirm the date, time, and
place.
to teach cadets the meaning of freedom,
Gen. Christman replied, "Freedom
is a very complex concept, the
interpretation of which depends on
one's point of view." Seeger, who
never wore a uniform, received
$2,000.00 to enlighten the cadets.
One would think that there are many
disabled veterans better qualified to
teach the Army's future leaders the
"Meaning of Freedom."
We received a request that you
send your used commemorative postage
stamps (U.S. and foreign) to "Veterans
