Chapter XI — Measures and Remedies Undertaken by <strong>the</strong> Government<br />

1675. The GoB has also prepared a new article 169 bis to ensure that <strong>the</strong><br />

provisions <strong>of</strong> <strong>the</strong> Penal Code that relate to <strong>the</strong> exercise <strong>of</strong> <strong>the</strong> freedom <strong>of</strong><br />

expression, as well as o<strong>the</strong>r laws relevant to freedom <strong>of</strong> expression, shall be<br />

interpreted in light <strong>of</strong> what is needed in a democratic society, and that<br />

practising <strong>the</strong> right to freedom <strong>of</strong> expression in this manner precludes<br />

punishment. The provision would read as follows:<br />

Restrictions defined in this or any o<strong>the</strong>r law on <strong>the</strong> freedom <strong>of</strong><br />

expression shall be construed as limited to those which are<br />

compatible with <strong>the</strong> values <strong>of</strong> a democratic society. The exercise<br />

<strong>of</strong> <strong>the</strong> freedom <strong>of</strong> expression can only be punished through<br />

restrictions that are so limited.<br />

1676. A number <strong>of</strong> o<strong>the</strong>r individuals were convicted for violating article<br />

214 <strong>of</strong> <strong>the</strong> Penal Code, which criminalises insulting <strong>the</strong> King, flag or national<br />

emblem. On 28 August 2011, HM King Hamad gave a speech to <strong>the</strong> nation in<br />

which he announced, “There are those who were charged with abusing us and<br />

senior <strong>of</strong>ficials in <strong>Bahrain</strong>, and we today announce that we forgive <strong>the</strong>m as we<br />

hope that <strong>the</strong>y understand that abusing us and o<strong>the</strong>rs in fact <strong>of</strong>fends everyone<br />

and achieves nothing.” 830<br />

G. Establishment <strong>of</strong> <strong>the</strong> National Fund for <strong>the</strong><br />

Reparation <strong>of</strong> Victims<br />

1677. In response to <strong>the</strong> allegations <strong>of</strong> human rights violations that emerged<br />

as a result <strong>of</strong> <strong>the</strong> events <strong>of</strong> February/March 2011, HM King Hamad issued<br />

Royal Decree Law No. 30 <strong>of</strong> 2011 establishing <strong>the</strong> National Fund for <strong>the</strong><br />

Reparation <strong>of</strong> Victims on 22 September 2011. In <strong>the</strong> preamble <strong>of</strong> this Decree<br />

Law, reference is made to <strong>Bahrain</strong>’s obligations under <strong>the</strong> ICCPR as well as<br />

<strong>the</strong> Basic Principles and Guidelines on <strong>the</strong> Right to a Remedy and Reparation<br />

for Victims <strong>of</strong> Gross Violations <strong>of</strong> International Human Rights Law and<br />

Serious Violations <strong>of</strong> International Humanitarian Law. 831 The Decree Law<br />

states <strong>the</strong> rights created under it are in addition to those already existing under<br />

<strong>Bahrain</strong>i law.<br />

1678. The Fund was created to provide remedies for those that have<br />

suffered any type <strong>of</strong> material, psychological or physical damage as a result <strong>of</strong><br />

infringement <strong>of</strong> <strong>the</strong>ir rights, ei<strong>the</strong>r at <strong>the</strong> hands <strong>of</strong> a public security <strong>of</strong>ficer or<br />

ordinary citizens. Article 3 <strong>of</strong> this Decree Law identifies <strong>the</strong> following<br />

categories <strong>of</strong> victims who may make claims for reparations from <strong>the</strong> fund after<br />

<strong>the</strong>re has been a final judgment rendered by a court convicting a person <strong>of</strong> a<br />

crime:<br />
