<strong>Report</strong> <strong>of</strong> <strong>the</strong> <strong>Bahrain</strong> <strong>Independent</strong> <strong>Commission</strong> <strong>of</strong> <strong>Inquiry</strong><br />

and interrogate employees on work premises, at times resulting in<br />

mistreatment in <strong>the</strong> form <strong>of</strong> physical and verbal abuse.<br />

1452. Employees were <strong>of</strong>ten questioned about opinions and activities<br />

protected under <strong>the</strong> Constitution <strong>of</strong> <strong>Bahrain</strong>, <strong>Bahrain</strong> civil law and<br />

international conventions.<br />

1453. Shia employees were <strong>of</strong>ten treated differently from similarly-situated<br />

employees who were not Shia, thus creating a reasonable presumption that<br />

many were subjected to discrimination. This is <strong>the</strong> case especially in<br />

circumstances where <strong>the</strong> employer admitted not dismissing Sunni employees<br />

who had been absent during <strong>the</strong> events <strong>of</strong> February/March 2011. This<br />

indicates an assumption that Shia employees who missed work during <strong>the</strong><br />

events <strong>of</strong> February/March 2011 participated in <strong>the</strong> demonstrations and were<br />

subject to disciplinary action. The disparity with which Shia employees have<br />

been treated in this context indicates that <strong>the</strong>y have been discriminated against<br />

in contravention <strong>of</strong> <strong>the</strong> Constitution <strong>of</strong> <strong>Bahrain</strong> and ILO Convention No. 111.<br />

1454. According to <strong>the</strong> latest information provided to <strong>the</strong> <strong>Commission</strong> by<br />

<strong>the</strong> CSB, <strong>of</strong> <strong>the</strong> 2,075 public sector employees who were dismissed, 1,682<br />

were reinstated. 180 employees remain dismissed with rights <strong>of</strong> appeal. In<br />

addition, 219 employees were referred to <strong>the</strong> Public Prosecution but were not<br />

suspended and are still receiving full pay.<br />

1455. The MoL is working to have dismissed private sector employees<br />

reinstated following HM King Hamad’s speech on 28 August 2011. The<br />

<strong>Commission</strong> recommends that <strong>the</strong> GoB use all its powers to ensure that public<br />

corporations and o<strong>the</strong>r employers who dismissed employees for failure to<br />

appear for work at <strong>the</strong> time <strong>of</strong> <strong>the</strong> demonstrations treat <strong>the</strong>m no worse than <strong>the</strong><br />

Government has treated its own civil servants.<br />

4. Recommendations<br />

1456. The <strong>Commission</strong> urges <strong>the</strong> GoB to ensure that <strong>the</strong>se remaining<br />

dismissed employees have not been dismissed because <strong>of</strong> <strong>the</strong> exercise <strong>of</strong> <strong>the</strong>ir<br />

right to freedom <strong>of</strong> expression, opinion, association or assembly.<br />
