THE GOOD LIFE IN THE FAST LANE
I was at a 70 th birthday party recently (not mine,
for God’s sake) where some earnest folks were
waxing poetic about age and sage and slowing
down and savoring not having to be competitive
anymore. Each time I awoke from a nod, I
wanted to jump to my feet, tell a raunchy joke
and castigate them for wanting to freewheel to
the end. Me, I’d rather race to the end, whenever
that comes, and I sincerely hope it’s not soon. I’m
sorry, but there’s too much to do and too much
fun to have to lumber about contemplating my
mortality.
It seems the older I get, the more I crave speed.
I’ve always been a sailor and I do like what displacement
speeds do for my blood pressure, but
there’s nothing like flying across a mirrored bay
at sunrise, gulping the gale and closing fast on
my destination. I’ve been on some senselessly
fast boats in my time and done some imprudent
things, but I’ve never for a moment regretted
those adventures.
In my early days as a marine journalist, I tested
a boat called a Hustler. Honestly, trying to stand
up in the cockpit holding a radar gun on a buoy
as the numbers on the readout bounced off 70
knots was scary and borderline violent, but it was
fun. I wrapped up that day feeling alive—and
really kind of happy to still be that way. I was also
happy I wasn’t sitting in a kayak with that thing
bearing down on me at highway speeds.
I ran a bass boat one time—not the classic, classy,
striper-hunting New England version with the
auxiliary tiller, rather, the classic speckle-skinned
kind the good old boys chase largemouth in on
rivers and lakes. First I fumbled about looking for
the throttle only to find it was a foot pedal. Then,
I quickly discovered the thing only ran on about
the aft six inches of bottom. It skittered around
like a snowboard on an icy Vermont slope. Being
of at least average intelligence, I concluded flying
along on a choppy spot on the ICW at 50 knots
in the thing wasn’t really a smart plan. It made me
think of the bubbas, with senses and skills heightened
by a few too many Bud Lights, doing their
thing on my local reservoir. No kayaking for me
when the fish are rising.
Then there was the time I drove an airboat
through some narrow “trails” in the Everglades
at speeds I must have blocked out. Suffice to say,
I was hauling ass. I remember asking the boat
wrangler what the dark things that looked like
logs were that we kept driving over. He told
me they were gators. At least we weren’t fileting
them with conventional props, although several
likely woke up the next morning with massive
reptilian migraines.
I’ve also had some more sedate speed runs,
like the time I circled Conanicut Island in
Narragansett Bay on a 132-foot Diaship/Heesen
called Mirage. With a trio of 3,500-horsepower
MTUs pumping 18,000 gallons of bay water a
second through the yacht’s jet drives, we bounced
off 40 knots at times. It was great fun moving
that fast in such a big boat. I vaguely recall the
Champagne literally blowing out of my glass as
we passed several sailboats whose occupants were
pointing at something in the sky.
In this issue, Alan Harper describes his experiences
going fast on the Mangusta 94 (“Passage
Aggressive”), the Pershing 82 (“The Ultimate
Driver’s Machine”) and the Baglietto MV13
(“Retro Rocket”). Judging by the performance
of these three boats, it seems the Italians haven’t
lost their lust for going fast. It’s also clear from
his reports that Harper has no time for life in
the slow lane.
There’s plenty to love about taking the slow boat
to wherever, hoping to get there whenever. No
offense if that’s you, but I’d really rather be flying
by you to leeward with the wind peeling back my
hair like a retriever with his head out the moon
roof on the expressway. While you’re sipping
chardonnay and savoring your shrimp cocktail,
I’ll be racing toward the end, savoring every second
I have left. Apologies for the wake.

A Submersible Superyacht?
For more than a century, naval architects have demonstrated the viability of sustaining human life beneath the ocean surface. Ex-submarine navigator/
futurist Harley O’Neill of SuperyachtME and Dutch designer/conceptualist Edwin van der Mark have taken the notion of life underwater to new
heights—or depths, as it were—with an inventive 335-foot (102-meter) superyacht submarine concept appropriately dubbed Nemo. Should it ever
see light of day, the design calls for some radical innovations such as double waterlines and submersion capabilities, magnetic motors, elimination
of reduction gears, a collapsible and retractable infrastructure, energy-absorbing and self-fixing coatings, environmentally conscious semiconductor
paneling, interchangeable battery cascades on induction pads and electrical generation dynamometers throughout the vessel’s moving parts. “With a
top speed of 25 knots on the surface and 7 knots submerged, this new breed of superyacht pushes the boundaries of the submarine concept with
two operating depths,” says O’Neill. “Imagine a sunset dinner above water, then relaxing with a good book just under the surface, all in the same salon.”

Maxi Dolphin Splashes FC3 100
Designed by French naval architects Finot-Conq and derived from their
experience in offshore racing boats, the 100-foot (30-meter) FC3 is Maxi
Dolphin’s latest splash in the luxury sailing market. The full-carbon build was
designed for an owner who, after an extensive search, contracted the Italian
company to build a light, stylish and comfortable sailing vessel. The design boasts
a 151-foot (46-meter) mast and 7,427 square feet (690 square meters) of sail
area. A 15-ton lifting keel reduces draft from 18 feet to 9 feet to permit shallowwater
passage. Her roomy interior offers an attitude of simplicity. The décor

Mares Releases New 45
Flybridge Catamaran
Catamarans are known for speed and
smooth, light lift. For its new 45 Flybridge,
Mares created asymmetrical hulls, tapering
from bow to stern. The width differential
forces air under the hulls that compresses

CRN Showcases Conero and
Super Conero Projects
Recently celebrating its 50 th anniversary, the Ferretti Group’s superyacht builder
CRN has launched a preview of some of its newest models. With names meant
to evoke the shipyard’s tradition, the new yachts are positioned as “entry level”
models that possess amenities and characteristics of design usually only available
on larger superyachts, says CRN Chairman and CEO Lamberto Tacoli. The
40-meter (131-foot) project’s name comes from CRN’s Conero line of the
1970s. The new Conero is a displacement yacht made of steel and aluminum.
Developed by CRN Engineering and designed by Studio Zuccon International
Project, the Conero includes features commonly found on CRN superyachts:
transatlantic range, RINA and MCA certifications, large internal volumes and a
balcony off the owner’s suite. The 44-meter (144-foot) Super Conero offers
a balcony that can be enjoyed while under way, a beach club and a floodable
tender bay—a concept employed on the 197-foot (60-meter) J’ade.

Reynaud have transformed the French builder’s fast military boat, the
Plascoa FIC (Fast Interceptor Craft), into an aggressive, high-tech pleasure
boat with an attitude. In a marriage of Couach’s trademark deep-V hull,
Rolla propeller system and Arneson drive shaft, the 44-foot (13-meter)
Hornet makes a unique tender option with high-speed seaworthiness.
Twin 800-horsepower MAN R6 diesels add the necessary muscle to
break 50 knots. Aesthetically, her design team took the military concept
all the way down to hull’s paint finish, which is an aggressive blue-gray

New Riva Flagship Nears Completion
Construction is on schedule at Italy’s CRN shipyard for Riva’s new
flagship: the 122-foot (37-meter) Mythos model. She is the builder’s
largest yacht to date and its first built completely of light aluminum
alloy. Riva’s diversified range spans 12 models between 27 and 122 feet,
including open, coupe and flybridge yachts. The Mythos model is the
culmination of a longstanding partnership between two historic Ferretti
Group brands: Riva, which in 2012 celebrated its 170 th anniversary, and

Italian boatbuilder Rio Yachts has crossed the Atlantic for the first time to
unleash its latest model upon the Miami boat show masses. Blending Italian
design with American engineering, the Rio 56 GT comes with electrical

plan. Rio Yachts began building boats in northern Italy in 1961 with a 27-foot

A heavy dose of relentless tropical rain couldn’t dampen the festive spirit of the 52 nd
annual Antigua Charter Yacht Show in December. Antigua is the premier winter charter

iIT WAS BLOWING AND HAD BEEN FOR SOME TIME—
a stiff southwesterly had the flags snapping to attention and sailboat
halyards in the crowded harbor clanging like cacophonous
metronomes. It was typical winter weather, but it was still only
September. I’ve had sea trials cancelled in better conditions, and
on boats far bigger than the Baglietto MV13. As I watched, the
boat was being made ready for sea by a shipyard crew encased from
head to foot in heavy foul weather gear. Just for me.
I felt a pang of guilt, but it soon passed. This was going to be fun.
I wasn’t expecting to see the MV13 at the show, and I’m not
sure anyone else was either. The previous year, I had interviewed
Beniamino Gavio, the new owner of Baglietto, and
he’d mentioned a still-secret boutique project—a limited edition
of small, simple craft designed to attract attention and
celebrate the venerable shipyard’s rich naval heritage. While

Boat Company motor torpedo boats, the Italians hold the name of
Baglietto in the highest esteem. Long before the superyacht era, its
fast boats fought with panache and distinction in two world wars and
became the stuff of legend.
So I’d told Gavio I thought it was a splendid idea, and I thought no
more about it. Knowing now what he was thinking then, I might have
pressed a bit further for details.
You can tell the MV13 was built by a superyacht yard. The finish—
tactile matte-gray paint, glowing teak and flawless welding—gets
better the closer you look. This boat is a beautiful object. An Italian
design magazine dubbed it gioiello di alluminio, an aluminum
jewel. But in the best traditions of its naval predecessors, it is also
entirely functional. Fully half the hull’s length is taken up with the
machinery space—engines and tanks—accessed through big stern
hatches. The 800-horsepower MANs drive aft on straight propeller
shafts angled at 11.5 degrees. Accommodations consist of a double
bed, a small galley and a large head. For a $1.75 million powerboat,
it’s resolutely no-frills.
That, of course, is only half the story. The MV13 is also a high-concept
project from Baglietto’s regular man of the last 20 years, Francesco
Paszkowski. Based in the hills outside Florence, the Milanese designer
has actually been sketching this idea for six years. Only when Gavio
bought the yard and commissioned the build could the drawings

become reality. The interior of the MV13 looks, at first glance, authentically
1940s. Then you notice that the hull frames and deck beams are
clad in stitched leather, and the tongue-and-groove planks lining the
hull sides are lusciously lacquered. Details like leather locker handles and
tailored galley stowage add luxury, while the folding table and worktop,
and the deep hanging locker, are reassuringly practical. Sensible space
planning ensures that whatever else the MV13 might be, it is a comfortable
two-person dayboat. Headroom is a generous 6 feet 3 inches, and at
6 feet 6 inches long by nearly 7 feet at its widest, the bed is huge.
Once clear of the Old Port of Marseilles breakwater, we threaded our
way through the flotilla of anchored yachts pitching at their chains and
took the first real wave on the starboard bow. It was a short, but heavy
punch that immediately raised a solid sheet of spray, which hung in the
air and then descended with pitiless inevitability. We were drenched.
It was good to get it out of the way. The seas were 4 to 5 feet, short
and steep. Spray blew overhead and seawater streamed across the boat’s
long, pugnacious snout as we battled at 30-plus knots. The ride was surefooted
and the deep-V ironed out the seas like a thoroughbred offshore
racer. There was plenty in reserve, but it was far too rough to open the
throttles wide. Apart from one hint of chine riding while running fast
downwind—quickly solved by throttling back—the hull was completely
uncowed by the conditions, and perfectly content to take the fight to
the elements.
I knew it was going to be fun, but the ride was fantastic. It was a battle,
and we were winning.

FAVORITE SCIENCE FICTION WRITER IS ROBERT
Sheckley. He was always a bit of a cult figure, but his stories are wise,
witty, intriguing, surreal and often hilarious. One of my favorite
Sheckley stories concerns a young man in Manhattan who is being
stalked by an invisible thrang. His psychic protector, a validusian
derg, just has time to shout a warning before it succumbs to the jaws
of the intruder: “Don’t lesnerize!” Of course, the young man has no
idea what “lesnerize” means, just that to do so will be fatal.
I was reminded of that tale aboard the Pershing 82. I sat down in
the yacht’s center helm seat. I noted the excellent visibility and took
in the layout of the controls: paired nav screens on either side of
the closed-circuit monitor, engine screens down by the wheel, and
trim controls and their attendant display right there, front and center.
With those priorities in evidence, clearly I was aboard a highperformance
machine.

Then there are the throttles. They’re not mounted on the console,
but right by the seat, under your right hand. The wheel occupies an
inconvenient position—effectively out of reach unless you’re standing.
But forget about that, because there on the left, at your fingertips, is
the joystick. It’s only about 4 inches long.
Let’s be clear: This is 60 tons of high-energy missile, with 4,870
horsepower packed into the stern, hooked up to ZF SeaRex surface
drives. In a straight line, this oceangoing ICBM is capable of more
than 46 knots. To make it turn corners, you waggle the little stick. Just
make sure you don’t lesnerize as you do so.
A replacement for the Pershing 80, the new 82 offers various
improvements over its predecessor, including an excellent sundeck
where an optional upper helm station folds away when not in use.
You access the deck from a smart set of carbon fiber steps that drop
down out of the deckhead.
With the galley down in the crew area and low-level furnishings
throughout the main deck, the salon is surrounded on all sides by
glass. When the sunroof opens up and the cockpit doors slide down
and away, the entire main deck becomes one huge living room, with
an extending glass-and-steel dining table forward, a silver-lacquered
cockpit table aft, and between them an enormous and luxuriously
upholstered leather sofa.
Down below, a four-cabin, three-head layout is standard, but you
can have just three cabins if you prefer, with a cozy TV lounge on the
starboard side. In either case, the master suite is amidships, spacious
and beautifully designed.
Pale teak joinery and contrasting, dark-stained oak floors give the 82
a modern but quietly restful interior, which is something of a Pershing
hallmark. The quality of the fit-out is exemplary. The engineering in

the machinery space is equally impressive. Although cramped by the
intrusion of the tender garage, there is good low-level access between
the engines and full standing headroom in front.
Like most of her stablemates, the Pershing 82 proved herself to be
a phenomenal driver’s machine. We clocked her on a two-way run
at 46.5 knots, and acceleration was extraordinary. Such is the angle
of heel that the best way to see where you’re going in a hard turn is
through the sunroof. The electronic throttles were beautifully light
and translated torque into instant, effortless motion, while in a light
chop over a long swell, the hull felt reassuringly solid—as you might
expect from balsa-cored e-glass laminates up to 1½ inches thick.
And as for that little 4-inch toggle switch under your left hand: It
doesn’t look like it could control a windscreen wiper, but I’m here
to tell you that it’s the best way to control the Pershing 82, at any
speed. The joystick is computer controlled. Just as raceboats have
rev limiters to stop the gearboxes from exploding, the Pershing has
a helm-angle limiter to prevent any heavy-handedness from having
unintended consequences. With that and the automatic trim system
engaged, driving this massive, muscular, deep-V missile is actually
pretty straightforward.
Limiter or no, the 82 still handles like an F-16. It’s a Pershing, after
all. So try to make sure you don’t lesnerize. The young man in the story
fretted about what it meant, but found out eventually.
“I’ve caught up on some back sleep and nothing happened, so that’s
not lesnerizing,” he says to himself. “I went out and bought food, paid
for it, cooked it, ate it. That wasn’t lesnerizing. I wrote this report. That
wasn’t lesnerizing. I’ll come out of this yet. I’m going to catch a nap. I
think I have a cold coming on. Now I have to sneez—”

IT IS PROBABLY SAFE TO ASSUME THAT MANY READ-
ERS of this magazine are able to distinguish at first glance an
American production yacht from a European one, not to mention
the stylistic distinctions between German, Dutch and Italian
designs. But these differences become more difficult to spot when
we move into full-custom territory. A discussion of American versus
European yacht design naturally invites any number of subjective
and sweeping generalizations. With this proviso in mind,
however, it would seem there are certain design motifs that point
to the nationality and cultural background of the designer, the
owner or the builder—and sometimes all three.
Setzer Yacht Architects, a U.S.-based design studio with offices in
Antigua, recently released sketches of a series it calls New American
Motoryachts. The concepts put a new spin on designs that studio principal
Ward Setzer views as distinctly American.
“The goal for the series is to freshly redefine several longstanding
yacht categories that have strong American roots, but are clearly
looking tired,” says Setzer. He boldly describes the series as “a vision
for a new era of American custom yacht design.”
Since founding his eponymous studio 23 years ago, Setzer has
collaborated with leading American brands Trinity (with at least a
dozen of his designs on the water), Christensen, Delta, Broward,

“There is certainly a North American aesthetic,” Setzer asserts. “It is
something learned the hard way with years of drawing by hand, with

by the study of the classic lines of Herreshoff or J.B. Hargrave, who I
worked for as a young naval architect. It is found in the styling of classic
Burgers from the early 1900s onward, the classic fantails of Henry
Morgan’s vessels belonging to the New York and Palm Beach set, or the
rum runners from the Prohibition era.” He also cites the influence of
the American automotive industry, which is itself shaped by fashion and
innovation. “Even naval and commercial vessel design and construction
has played a role in shaping the look and feel of yachts,” he says.
Gregory C. Marshall, the Canadian naval architect based in Victoria,
British Columbia, believes the American aesthetic has traditionally
been defined by its innate conservatism. Much as Henry Ford sold
cars in any color as long as it was black, most U.S. shipyards have
tended to build boats in any color as long as it is white. But the issues
are more than just skin deep. Marshall proposes that most American
owners are driven primarily by function rather than form, with practical
matters such as berthing facilities influencing the design of their
yachts.
“Outside of Florida, there is generally a lack of marinas suitable for
large yachts,” he says. “This means you see a lot of floating docks
requiring low-level, step-off access from the boat. On the other hand,
we have a lot of sheltered bays where we can anchor, so tenders need
to be launched and retrieved quickly and easily. Whereas European
owners like to hide tenders from view in garages for aesthetic reasons,
American owners often prefer to keep their tenders on deck and
launch them using cranes or davits.”
This focus on function over form carries through to the interior
with traditional layouts that tend to favor simple, square spaces and

fitted—as opposed to freestanding—furniture. There have been occasional
attempts to remedy what might be seen as an uninspired and
even pigeonholed approach to interior design. When Trinity launched
the 196-foot (59.7-meter) Bacarella in 2009, for example, it was touted
as proof that American yards could build European-style yachts, in part
because London-based Bannenberg & Rowell came up with the interior
design, which was manufactured and fitted out by Metrica in Germany.
“We’d always been accused of not being able to execute a northern
European-type boat,” said John Dane III, president and CEO of Trinity
Yachts, when Bacarella made her debut in Fort Lauderdale. “So with the
original owner, we finally found an American who was prepared to pay
the up-charge for a London designer and a European interior supplier.”
It is somewhat ironic that Dickie Bannenberg himself described the
yacht as having “a Californian, natural, low-key vibe.” What he was
implying was that the interior design, although smart and chic, was
still eminently livable: “You can come in wearing your swimmies and
feel at home, rather than perching nervously on the edge of your seat.”
This observation had a direct impact on the 112-foot (34.1-meter)
VvS1, designed by Marshall and launched by McMullen & Wing in
2007 for Kiwi owner Michael Hill. In addition to the faceted planes
and vaguely military lines of the exterior styling—a look more often
associated with European designs—Marshall revisited the interior layout
at the owner’s request.
“He couldn’t understand why he had to come out of the water and
walk dripping wet through the main salon, the most formal space
on the boat, if he wanted to prepare a sandwich in the galley,” says
Marshall. “This governed the position of the aft galley and the rest of
the interior layout. The salon is in the middle of the yacht for use at the
end of the day, while the galley and aft deck serve as a daytime space.”
Compared with other nationalities, Americans (and Australians and
New Zealanders) shy away from the kind of service mentality that
leads to the strict separation between crew and guest circulation. This
is likely a consequence of a more relaxed and casual lifestyle, which
is reflected in a preference for the country-style kitchens they often
have at home. An extreme example of this is Tamsen, the 171-foot
(52.1-meter) ketch launched by Perini Navi in 2007 for the Firestone
family of California. The yacht has a huge galley space on the forward
main deck where the extended family—children, grandchildren,
aunts, uncles and cousins—can all pile into at mealtimes. “Everybody
cooks and cleans,” says owner Steve Firestone. “There are a lot of kids

and wet bathing suits. The design reflects that.”
Marshall refined a similar concept aboard the hugely influential
Big Fish, the 147-foot (44.8-meter) expedition yacht launched by
McMullen & Wing in 2010 for Englishman Richard Beattie. This
time, the layout included a breakfast corner in the galley, so owner
and guests could interact with the chef without getting in his way.
But when the yacht was being chartered, especially with South
American or Asian clients on board, the area could be closed off to
function as a straightforward workstation.
Undoubtedly, there is a growing band of North American designers
whose work has crossed the Atlantic divide and enjoys a truly
international following. At the vanguard of this movement is Tripp
Design of Norwalk, Connecticut, whose sailing superyachts built
by the likes of Wally, Vitters, Baltic and most recently Arzanà Navi
represent the cutting edge of sailing superyacht design. Such is the
extent of Bill Tripp’s European commitments that he has opened
an office in Amsterdam, where he spends at least half of his time.
The modern big-boat culture does not always sit well with the more
puritanical yachting mentality across the Atlantic, so it is surprising
that it has taken a North American naval architect to help define
some of today’s most avant-garde sailing yachts. “I find I can drink
the Kool-Aid,” is Tripp’s laconic reaction.
Marshall’s 180-foot (54.8-meter) Project 6183, with its radical use
of glass and asymmetric windows, has preliminary design contracts
from excited European as well as American and Canadian clients.
Following a positive reception of his New American Motoryachts
series at the Fort Lauderdale International Boat Show, Setzer reports
that he is in discussion with six major builders, only three of which
are in the United States.
“I cannot speak for other American design studios, but I can say ours
is simply curious about the future and grounded in the past,” Setzer
says. “The key is they have to be buildable and not just sculptures
on the water that do not function well in bluewater conditions. Any
design house like ours has unknowingly shaped a look and feel based
on the realities of actual construction limitations. These realities have
combined to shape our American roots.”

IT SEEMS LIKELY THAT YEARS FROM NOW, WHEN ART
historians and analysts of artistic invention offer their pronouncements
on the eternal parade of design trends up until their time in the
future present, they’ll be less likely to dwell on the transitory caprice
of glitzy swoops and embellishments, and more likely to acknowledge
the longer-lived achievements that owe their relative permanence to
more substantive attributes. These, in turn, may well be universally
grounded in earlier (read: proven) influences, physical imperatives
and the human scale, and most likely will themselves prove to serve as
worthy precedents to trends that follow.
And whenever these same historians and analysts look to the evolution
of nautical design, they inevitably must recognize Invictus,
Delta Marine’s newest entry in its portfolio of custom motoryachts.
A large vessel by any measure, the 216-foot by 43-foot Invictus offers
a full-displacement hull form with a substantial 12-foot 8-inch draft
to maximize interior volume. The resulting arrangement accommodates,
in addition to the owner couple, 12 guests in six double
staterooms and a crew of 22. Notwithstanding her overall conservative
look, Invictus presents an appropriately imposing demeanor, the
result of an emphasis on scale and proportion commensurate with
her superyacht-caliber dimensions and the enhancement of countless
functional details born of meticulous selection and arrangement of
visual elements. Central to the yacht’s design brief is the comfortable
accommodation of a variety of guest complements, from large social
groups to more intimate gatherings, and of itineraries ranging from a
half-day dinner cruise or dockside reception to transoceanic passages
spanning weeks or even months. Accordingly, the design team has
taken full advantage of length, breadth and depth to accommodate
activities from active watersports and al fresco relaxation to indoor
entertaining and socializing.
First and foremost, Invictus is a serious, globe-girdling vessel whose
ice-class steel hull and 7,000-nautical-mile range leave virtually no
destination beyond her reach. But her style is every bit as impressive
as her substance. As a developer and owner of high-end commercial
and retail properties, the yacht’s owner has made a career of creating
attractive, inviting and comfortable environments for his discerning
public, and Invictus represents a natural extension of those same attributes
as they apply to his private life. In order to create an appropriate
seagoing equivalent for his new yacht, he naturally enlisted the talents
of Diane Johnson, a southern California-based interior designer and
author of multiple residential and business-related projects for this
selfsame client.
“The owner,” says Johnson, “is a very visual person with a fine eye
for detail. His priorities for Invictus are all about family and friends,
about creating environments that nurture the senses without overwhelming
them.”
With beauty and human comfort as cornerstones of her design brief,

Johnson set about fashioning a disciplined overall theme grounded in
classical styles, but offering a distinct personality in each living space,
and just for fun, here and there, an engaging surprise or two.
With the aim of delivering a comfortable residential feel throughout
the yacht, the owner specified few built-in furnishings, instead
favoring a selection of sofas, chairs and tables, secured in place in
people-friendly arrangements. Other elements of visual continuity
include a curving central staircase whose metal, wood and leather finishes
carry through each interior level, and a muted, yet rich palette
of fabrics, stone and joinery. Within that context, each living space
offers a distinct personality, notably in the variety of cabinetry (much
of it from Delta’s own carpentry shop) and stone design (executed
by Seattle’s Jeff Homchick) inspired by Johnson’s research in Tuscany,
and her discovery of a rare marble species used in 12 th - to 15 th -century
Florence. Among the more intriguing surprises are the judicious
placement of Lalique crystal pieces in wall sconces, powder room
fixtures and a handsome chandelier suspended over the 22-place table
in the main dining room aft on the owner’s deck. And even the most
casual observer could be forgiven for half expecting, upon entering
the dramatically Art Deco-themed bridge deck skylounge bar, to run
smack into a tuxedo-clad Frank Sinatra or any of his Rat Pack cronies.
It’s an almost inescapable image, and that same observer would have
to wonder if, just maybe, it was planned that way, all part of the fun.
Actively engaged in the project, Invictus’ owner made frequent trips
to Delta Marine’s Seattle yard during the build, bringing a perspective
that meshed agreeably with that of the builder’s design team.
“His own personal sense of aesthetic,” says the project’s senior
designer, Christian Oliver, “made him sensitive to all aspects of the
design, exterior and interior. In particular, he was very aware of the
yacht’s size in relation to the human scale.”
Nowhere is that relationship more evident than in the main-deck
common areas, where exceptionally tall curved-glass sliding doors

offer passage between the aft exterior lounge area and a salon whose
8-foot 4-inch overhead height and nearly floor-to-ceiling view windows
on either side—a feature repeated throughout the yacht’s living
areas—further enhance the sense of space within.
The private owner’s suite commands the forward portion of its own
deck one flight above the main level and includes an entry corridor
that leads forward from the main stairway past a starboard-side office
and between his-and-hers baths, opening onto a bedroom and sitting
area encircled by a curved expanse of glass offering a 180-degree view
ahead and to either side. Just forward is a broad private lanai partially
sheltered by the coachroof overhang. Guest accommodations include
six en suite staterooms arrayed along a grand hallway leading forward
on the main deck. A vestibule at the lower terminus of the central
stairway opens to two additional double suites, each with a pull-down
Pullman berth, designed to serve as either staff quarters or supplemental
guest space.
Overall exterior breadth and height are immediately apparent to a
visitor boarding at the stern, by way of an expansive beach/cabana area,
reaching aft beyond the nominal swim grid from a teak-surfaced party
platform located below the aft main deck. The extension is formed
by deploying an enormous transom door that swings down to augment
the lounge area and, when departing a mooring or berth, hinges
upward to merge with the gently contoured curve of the transom,
while at the same time offering an extra measure of security against
unauthorized access. This deck, to the surprise of no one, has earned
immediate favor among owner and guests alike as a venue for sunning,
socializing or access to tenders and water toys. From this level, a single
enclosed stairway on the port side leads to a covered exterior lounge
area on the main deck one flight above, where an arrangement of fixed
and occasional seating is oriented toward the view astern.
The division of interior spaces offers a balance of guest and service
areas to allow efficient, unobtrusive service and vessel operations,
essential to a salutary onboard experience for passengers and crew
alike. The main, owner and bridge decks all feature a centrally located
pantry allowing convenient refreshment service in all living spaces.
Separate crew access to and from all levels keeps traffic in common

areas to a minimum. Similarly, a stairway from the lower-deck crew
area leads up to a service door forward on the main deck to facilitate
stateroom make-up. Located on the lower deck, the galley features a
full complement of commercial-grade appliances and fixtures worthy
of a master chef. Well aft on this level, adjacent to the cabana beach
area, is a tender stowage space equipped with hullside doors and dual
gantries for deploying a 28-foot (8.5-meter) Comitti sport runabout,
a 27-foot (8.2-meter) Novurania, personal watercraft and other requisite
watercraft. For après-sport relaxation, Invictus also offers, on the
main deck, a 14-seat cinema showing first-run films in addition to
old favorites, and adjacent to the skylounge bar a well-equipped gym
promises an invigorating workout for those so inclined.
Since her late-summer 2013 launch, Invictus has played host to a
nearly nonstop series of cruises and dockside events, from Desolation
Sound in the fabled Canadian Inland Passage and port calls along the
North and Central American Pacific coasts, to a growing litany of
Gulf and Caribbean destinations. Given this yacht’s range and global
capabilities, no one should rule out a schedule of voyages to more
distant venues as well. In any case, her arrangement, fit-out and finish
is a sure bet to make anyone’s time aboard worthwhile.

YI: What’s the state of the superyacht market as we head into
the Miami show?
“The market is firming up. Owners know that demand is
surpassing quality inventory, so those great deals where
clients were able to negotiate millions off an asking price
are gone. The ‘economy’ end of the superyacht market is
seeing a lot of movement, with the $8 million to $12 million

The 107-foot (32.6-meter) NAC sailing catamaran La Sella del Diavolo
will be easy to spot thanks to her 41-foot beam, while the 150-foot
(45.7-meter) Richmond Excellence will be showing off the 9-foot-1-
inch headroom in her pilothouse, which features a domed overhead
studded with fiber-optic lights arrayed like the night sky. The 154-foot
(46.9-meter) Delta Usher will be available for tours that include the
chic Polynesian décor you may remember from when she was called Mr.
Terrible, and the 126-foot (38.4-meter) Norship Impulsive will be showing
off her fun-filled sundeck, which includes an outdoor plasma TV.

‹YI: How can consumers get the most value out of a
brokerage yacht this spring?
“As you trust your Realtor, attorney or stock advisor,
find a broker you are comfortable with to apprise
you of the strengths, weaknesses, and historic and
current pricing of the yachts you’re interested in. Your
broker should direct you to yachts that fit your criteria
and also offer alternatives.” —Kevin Merrigan, CEO of

Clarke: “Shop around. There are always deals to be
had at a boat show—that’s why owners put their
boats in the show—and there’s always room for
negotiating. Some of the best deals happen at the
show, not after it.”
YI: What are some highlights attendees can expect this
year at the Miami Yacht & Brokerage Show?
“There will be plenty of events and seminars to attend
at the show. We have revamped our transportation
system to make getting around the various locations
easier for attendees. The water taxi is a new shuttle
option this year, and we’ve expanded the show into
Miami Beach Marina with a new ‘Superyacht Miami’
exhibit—a collection of yachts over 150 feet. Our
MyBoatShow mobile app is a great tool to help
attendees navigate the show.” —Vladimir Danylyshyn,

Merrigan: “An excellent selection of product, many of
them aggressively priced for sale. Miami is an appealing

YI: What’s new and exciting in the market this year for
consumers?
Clarke: “We’re noticing a few cool new trends.
High quality 30-, 40-, even 50-foot RIB tenders are
hitting the U.S. luxury market, a testament that
Mediterranean-style, open-layout cruising is gaining
popularity here in the States.”
Hamilton: “Builders are finding ways to use less fossil
fuels while providing increased performance and
incredible onboard experiences conceived around the
personality of the individual owner.”

WHEREAS OTHER SUPERYACHT BUILDERS ARE APT TO
shout about their new products, the family-run Codecasa company
in Viareggio, Italy, prefers to whisper. This low-key approach is in
direct contrast with the high-profile status of many of the builder’s
clients, such as Prince Albert of Monaco, Giorgio Armani, Domenico
Dolce and Stefano Gabbana. On the other hand, such restraint may
be the very reason celebrity owners are so enamored of the brand. Hull
F75, the second in the 140-foot (42.5-meter) Vintage series, mirrors
Codecasa’s discreet approach to yacht marketing by choosing classic
simplicity over vulgar ostentation.
“The exterior design began with the vertical bow stem, a design feature
borrowed from the yachts of the past, which was the starting
point for the superstructure styling,” says project manager Antonio
Giorgetti. “We believe her steel-and-aluminum construction, combined
with the traditional profile, provides a sense of reassurance and
seaworthiness, especially in today’s economic uncertainty.”
Speaking of economic uncertainty, Codecasa is one of the few shipyards
in the world today prepared to complete a superyacht on spec
without a signed contract—an indication of its supreme confidence in
its product. This was the case with both Hull F75 and her predecessor,
Magari, the first in the Vintage series. This doesn’t seem to faze the
shipyard’s patriarch, Fulvio Codecasa, and his family, who are happy
to finish the interior to their own tastes and use the yacht for a season
or two before a buyer comes along.
In the case of Hull F75, launched last summer, these tastes are soberly
elegant to complement the exterior styling. The interior design, based
on white-painted joinery, Carrara marble, Majilite fabric wall panels
and a mahogany parquet sole, is by architects Anna Maria and Franco
Della Role, who work exclusively for Codecasa when it comes to yacht
projects. Bold artwork commissioned by Fulvio Codecasa punctuates
the muted color scheme.
“Our long collaboration with Codecasa means we understand their
needs and tastes,” says the designer duo. “Fulvio Codecasa explained
step-by-step the kind of interior he had in mind in line with the classic
lines of the hull and superstructures, which we reproduced in the
furniture, detailing and materials.”
As luck would have it on this day, Magari (launched in 2011 and owned
by another prominent Italian entrepreneur) was moored at the Codecasa
dock while undergoing warranty work. This provided an opportunity to
go aboard both yachts to observe how the semi-custom series has evolved
and can be adapted to owners’ individual requirements.
A significant practical—as opposed to an aesthetic—difference can
be found in the galley layouts. The first yacht, which won a Nautical
Design Award for her interior, features a door from the galley so crew
can directly access the corridor leading to the owner’s suite on the forward
main deck. This may have been a convenient feature for servicing,
but it limited the space available for kitchen equipment. On Hull F75,
it has been done away with to improve the functionality of the galley

and provide space for a larger pantry serving the dining room.
Another variation appears in the upper deck lounge. On Magari, the
sky lounge is shortened to provide a semi-open, air-conditioned “conservatory”
space on the aft deck, with teak decking that continues into
the lounge to blur the distinction between interior and exterior. On the
second hull, the sky lounge has resumed its original proportions, but
still leaves space for 12-person dining on the open aft deck. An added
detail is the two bench seats molded out of the engine room ventilation
cowlings on either side of the aft deck—a simple solution that makes
good use of an obtrusive, but necessary, technical feature.
In the engine room, the equipment specs are unchanged, but on
Hull F75 the hydraulic pumps for the zero-speed Quantum stabilizers
have been relocated farther away from the bulkhead adjoining the aft
guest cabins to reduce noise. When anchored, with generators and stabilizers
in operation, Hull F75 has noise levels of less than 40 decibels
in the guest suites, according to the yard.
These and other design tweaks are being introduced as the series develops.
A third 42 Vintage in build, for example, extends the owner’s suite
on the forward main deck into a full-beam cabin. One consequence
of the retro exterior styling is that windows are quite small by modern
standards, especially in the owner’s suite. So on a brand-new 164-foot
(50-meter) edition of the Vintage, also under construction, the windows
have been increased in size and the exterior bulwarks lowered to provide
more natural light and better sea views. This larger yacht will also
include a spa tub forward on the sundeck. Codecasa carries out its own
naval architecture in-house, resulting in yachts that are extremely wellengineered
with safety features that often exceed class requirements.
Comfortably classy and reassuringly reserved, the Vintage series is
for owners who prefer leisurely cruising at displacement speeds on
oceangoing yachts that are immutably elegant.

founder Fabio Perini was at a loss in the early 1980s when he was
unable to find a singlehanded sailing yacht with the aesthetics and
comforts he was seeking, so he designed and built his own boat.
“I have always been after high sailing performance and simplicity,”
Perini says.
Those values have carried through the 53 sailing yachts and two
motoryachts the company and its divisions have delivered since 1984.
Many of the sailing systems and much of the firm’s innovative technology
and engineering have been developed in-house, and it’s all on full
display with Seahawk, the first of a new 60-meter (197-foot) series.
Seahawk, with her aluminum hull created by Perini Navi and Ron
Holland Design, is decidedly recognizable as descending from the company’s
popular 56-meter (184-foot) series. However, according to build
captain and project manager David “Hutch” Hutchison, Seahawk is not
number 11 in the 56-meter series, but is virtually a new yacht featuring
many improvements and innovations. For starters, the hull shape has
been refined and optimized for performance. The proportions between
the yacht’s waterline and beam render a sleeker appearance, and her new
lifting fin keel lets her sail not only faster, but more efficiently.
Seahawk is her owners’ first sailing yacht. They also own a 1922 commuter
and an 85-foot motoryacht built by the Italian shipyard Arcadia,
known for its extensive use of solar panels. In the same spirit of ecological
consciousness, they decided to create a wind-powered yacht—
and they were adamant that their boat be a performance design. Their
first taste of competition was the Perini Navi Cup in Sardinia last fall.
Since the yacht was brand-new, they chose not to compete, but they
did sail along with the fleet. According to Hutchinson, performance
met everyone’s expectations.
When I stepped aboard, I was immediately impressed by the yacht’s
serene beauty, inside and out. Hutchinson credits the owners for

demanding a particularly high level of detail. The exterior design varies
considerably from the 56-meter series, revealing a smaller superstructure
and coachroof, as well as expanded outdoor living spaces. The aft
cockpit on the main deck can be fully enclosed and air conditioned,
which is a first on a Perini sailing yacht. The flybridge deck is organized
for comfort with foot and grab holds for security while heeling.
Forward of the bridge is a private cockpit area which, combined with
the foredeck, offers a vast amount of space for entertaining, especially
since the two 21-foot tender wells are built flush to the deck. To keep
things tidier still, the headsail furlers at the base of the main mast have
their motors hidden beneath the deck.
The interior is a clean, modern creation by renowned Parisian designer
Christian Liaigre. According to Melanie Martel, Seahawk’s chief stewardess,
who assisted in the interior planning, the owners wanted guests
to experience the magic that is a sailing yacht. They did not want
Seahawk to replicate a Park Avenue penthouse. Much of the curvature
of the hull structure is visible, and the marine feel and nautical notes
complement the contemporary design and furnishings.
On the main deck, the living area revolves around a central staircase
that leads up to the flybridge and below to the guest accommodations.
The main salon, with its array of leather couches, is situated off-center
so when guests enter from the aft cockpit, the salon is not directly in
the path of foot traffic. An L-shape glass vitrine behind the main salon
sofa provides a visual, yet transparent room divider. A game table set

up for chess is off to one side, and the dining table runs longitudinally
rather than athwartships.
While there are defined areas for lounging, eating, playing and relaxing,
there is also a flow and connection on this entire deck level. A
major focal point are two deep-red painted nautical maps on the forward
bulkhead, fashioned in what is referred to as Art Deco Dunand
after a Swiss lacquer artist from the early 20 th century. Carefully placed
pieces of art from Polynesia and Indonesia add more visual interest
to the yacht’s rather homogeneous color palette, which is deliberate.
Bleached teak is utilized on the floors and ceilings, and everything else
is a version of red, white, silver and black. In fact, most items aboard
the yacht are designated with RAL color-chart numbers, including in
the engine room.
The lower deck has four en suite double guest cabins and a full-beam
master suite. The master has an unusual arrangement with two queensize
beds on opposite diagonals, facing each other. The room can be
partitioned into two cabins by using a center wall, which is ideal for
charter. In the master, the bed bases and small side cabinets are ebony.
The only splash of non-standard color is on the wraparound bed headboards
upholstered in Hermes-orange leather. Modern stainless-steel
sinks in marble countertops make for chic heads. The interior décor is
understated, but extremely elegant.
Not only is the boat beautifully appointed and easy to live in for
the owners and guests, but also for the captain and crew. The galley
is spacious and the crew quarters include laundry facilities, extra
refrigerators and plenty of stowage. There are five double cabins for
the 10 crewmembers, plus a captain’s cabin. The glass bridge is the
captain’s pride and joy. He can choose to navigate from here or the
flybridge. With all the innovative sailing technology installed on the
boat, Seahawk promises to be one of Perini’s easiest yachts to sail—
maybe not singlehanded as Fabio Perini intended for his first yacht,
but a dream sailing yacht nonetheless.

What is the arrangement on Seahawk?
DH: The furlers have been completely redesigned to be more
powerful, and their motors are now underneath the deck. They were
designed with a hydraulic ram to be able to regulate stay tension and
another to manage luff tension.
What is new about Seahawk’s sail plan?
DH: There is a lot of sail area, 2,125 square meters [22,873 square
feet]. The main mast is 62 meters [203 feet] high and the mizzen is 52
meters [170 feet]. Their combined weight is the equivalent of what the
main mast alone weighed on the first 56-meter. More weight saving
occurred with the use of a carbon fiber boom, spreaders, headstays
and, for the first time, for the standing rigging. This weight savings
necessitated less ballast, so Seahawk is especially lightweight for a boat
of her size. Her displacement is 570 tons, yet her living spaces are still
under 500 gross tons.
What other hardware innovations were designed for Seahawk?
DH: Faster captive reel winches to create faster maneuvering and
more reeling power. Innovative sensors measure the loads and
regulate the reeling speed. The reeling speeds for this yacht versus the
latest 56-meters have been lessened by well over a minute. All this is
really crucial when tacking, particularly in a race.

moving between oceans. Now cruisers
are finding the slim sliver of land between
continents an appealing destination.

PANAMA TRADITIONALLY HAS BEEN A PLACE FOR YACHTS
to pass through as they move between oceans. Transiting the canal has long
been on the bucket lists of many owners. But the country has never caught
on as a popular cruising destination. And that’s all about to change.
Wedged between Costa Rica to the northwest and Colombia to the
southeast where Central and South America meet, Panama has all its life
been synonymous with transition. It was regularly ransacked by Spanish
conquistadors, was once made a province of Colombia and finally succumbed
to American control of what we know today as the Canal Zone
following a 10-year dig by the U.S. Army Corps of Engineers. During
the past quarter-century, Panama has established itself as an independent
nation with a flourishing economy, a stable political landscape and a government
eager to expand the canal’s capacity along with Panama City’s
waterfront of high-rise hotels and nearby tourist attractions such as zip
lines and ATV scrambles. This is all good news for the cruising yachtsman,
who now can enjoy destinations on land as well as fun in the cruising areas
that Panama offers on its Caribbean side.

Approaching from the Caribbean, you’ll find the San Blas archipelago
south of the canal entrance. It is home to the indigenous Kuna
Indians, who preserve their heritage by keeping their customs, village
structures and dress unchanged. The women wear traditional, colorful
handmade blouses called molas and often adorn their faces with nose
rings and primitive painted designs. On occasion, they will approach
cruising boats to sell the molas—which are handmade, one-of-a-kind
souvenirs well worth buying.
The approach to the canal from the San Blas side is anything but primitive.
Dozens of modern cargo ships swing at anchor awaiting their turn.
Canal operations run 24/7, but a daylight passage is the preferred timing
for yachts. Passing under the Bridge of the Americas (Puente de las
Americas) signals the approach to Panama City, a booming metropolis
with a Latin beat. The old city, with narrow stone streets, charming
cafés and historical churches, is an easy walking experience. The Encima
Rooftop Bar atop the Tántalo Hotel is a good place to enjoy a beverage and
the ocean breeze. Look for transient dockage at the Flamenco Marina on
Flamenco Island, where Yachts International affiliate and Fort Lauderdale
International Boat Show producer Show Management will host the first
Panama International Boat Show this year. The marina is minutes from
restaurants, shopping, hotels, casinos, bars and nightlife.
Arguably some of the best of these are found at the Hard Rock Hotel
Panama Megapolis, a 66-story glass tower with four restaurants, seven
clubs and the ultimate Rock Star Suites, complete with a Fender electric
guitar delivered to your room. If you can’t find music to your
liking there, try the Panama City districts of Casco Viejo, Calzada de
Amador and Calle Uruguay for classical music, jazz, theater, dancing,
an intimate romantic oceanside dinner or state-of-the-art night clubs.
If it’s your time to check another item off the bucket list, or better

meets south and east meets west.

LOVE YOUR YACHT? WHY NOT BECOME A SHAREHOLDER
in the company that built it? That is exactly what the owner of the
new 138-foot (42-meter) custom-built Moonen Sofia did. To say he
is enthusiastic about Moonen is an understatement. Sofia is his third
consecutive yacht from the yard, and because of his directives, the
yacht is the largest and most technologically advanced that Moonen
has delivered. Sofia stood apart from the crowd at the Cannes,
Monaco and Fort Lauderdale boat shows. It was impossible to pass by
her without noticing the flamboyantly yellow submarine perched on
her aft deck. The sub certainly caught my attention, and when interior
designer Frank Pieterse treated me to a tour of the yacht, I discovered
the sub was merely a tease to the surprises within.
Sofia is built to Lloyd’s and MCA specifications with naval architecture
by Stolk Marimecs. Moonen masterminded her engineering
in-house, and René van der Velden styled her no-nonsense exterior.
The captivating interior styling is the handiwork of Art-Line, the
Netherlands-based design firm headed by Pieterse and Marilyn de
Vaal, who were responsible for the interior design of the two previous
Sofias. Art-Line worked closely with the owner and the Moonen team
to get every detail just right.
Sofia’s owner is a gregarious and affable gentleman of Mexican
heritage with dual Mexican and American citizenship. He has global
business interests and claims to live in a jet—when he’s not on his
yacht, that is. Flying and boating are two of his hobbies. He pilots
small planes and helicopters, and likes to helm his own boats when
the mood strikes him. He has owned a number of yachts beginning
with a 34-foot (10.3-meter) composite powerboat. He has moved on
to increasingly larger boats, and today he maintains a 61-foot (18.5-
meter) sailing yacht in addition to Sofia.
In 2005, he decided he wanted a steel-hulled yacht. An 84-foot
(25.6-meter) Moonen captured his imagination. After spending
time on Sofia number one, he determined he needed more space and
commissioned his second Sofia, a 97-footer (29.5-meter) that was
stretched to 100 feet (30.5 meters) by the time she launched in 2008.
“We traveled extensively with it and never had any problems whatsoever—great
quality build and engineering,” he says.
He says he has complete trust in Moonen and the design team, but
he enjoys influencing much of the decision making. During the twoand-a-half
year build, he and his wife flew to the yard every couple
of months.
“We wanted the yacht to yield as much volume as possible while
keeping it under 500 gross tons,” says Moonen Managing Director
Emile Bilterijst. “Partway through the build, it was decided to have a
three-person submarine instead of a two-man one, and the added size

and weight created quite a challenge as we had to make major accommodations
to support it.”
“I wanted a boat capable of carrying a submarine,” the owner told
me in an interview on board. “I love to scuba dive, but in cold waters,
you need a thick wet suit. I want to be very comfortable when I go
underwater to see whales, and I hate putting on a wet suit. When you
get old, it’s like putting on a corset.”
The owner has a playful personality and likes to joke. When I asked
about the name Sofia, assuming it was his wife’s, he smiled and said,
“No, it is my daughter’s name. You can change a wife, but you can’t
change your daughter.”
He says the boat lets his family enjoy quality time together. He also
winked and said that with a yacht such as Sofia, it isn’t hard to get his
teenage daughter to want to spend time aboard, especially because she
can bring her friends along. Since the launch of this Sofia, the family
has enjoyed a summer of travel in Morocco, Gibraltar and Spain, and
a winter in the Bahamas and Caribbean. The boat is laid out for maximum
comfort for entertaining, relaxing and having fun, and she is
extremely quiet under way.
The yacht’s overall length had to be extended and a new swim platform
engineered to handle the 4.5-ton C-Quester 3 submarine from
U-Boat Worx and the crane to launch it. The resulting yacht shape
and volume then dictated the interior design. The sturdy expeditionstyle
exterior, with its wheelhouse relatively far forward, belies the
contemporary interior. The entire accommodations plan is decidedly
different from a traditional explorer vessel.
“The challenge was to bring 50-meter spaces to a 42-meter yacht
through the use of light shapes and sophisticated materials,” says
Pieterse. Art-Line avoided a linear layout with corridors. Instead,
there is circular fluidity. The main salon is a large, open plan that flows

unrestricted by bulkheads. So many rounded spaces invoke the feeling
of a cocoon. The curvaceous shapes of the furniture—a cylindrical
coffee table, a beveled bar and an oval dining table—echo the sweeping
lines of the entry and overhead. The focal point of the main deck
interior is a central oval atrium, which has a stunning spiral staircase
with a backlit column made from concetto stone fabricated in Israel.
Stainless steel vertical supports ascend three stories. A skylight at the
top bathes the atrium in natural light. There is a distinct absence of
any doors or walls. A sculptural element hides the ceiling air outlets
and the engine and ventilation room shafts.
Art-Line, in consultation with the owner, was responsible for the fabrics
and thematic colors throughout the yacht. The overall serenity of
the interior is balanced with a riot of texture: stone, steel, wood and
leather. The palm-leaf wallpaper, Pieterse says, has a non-reflective softness
to it that creates a nice contrast with the high-gloss wood finish.
Sofia’s interior is exotic and eclectic. The main-deck master stateroom
takes advantage of the full beam forward with a private seating
area and a generous head. The woods used, oak and zebrano, create
a palette of brown and beige tones: cocoa, caramel, cinnamon and
clove. A horizontal grain runs along the wood paneling and is mirrored
by the horizontal cane wicker in the bed frames and the slats
on the window treatments. Small artistic touches were sourced worldwide.
For instance, instead of retaining rails on the desk, Art-Line
sourced leather trays in Brazil and embedded them into the counters.
The guest cabins on the lower deck spiral off the central staircase,
again, without the intrusion of corridors.
The bridge deck is uniquely laid out so that it is visually connected

to the other decks. While sitting in the portside upper salon, one
can watch the flow from the central staircase. This upper salon also
includes a gym and a lounge. The gym can be completely closed off
and, with a pull-down bed, used as an extra guest room.
A sitting area on the bridge deck can be fully opened to the fresh
air or remain enclosed if guests prefer air conditioning. The owner is
fond of cigars with his cognac, so he wanted to appease his wife with
the option of fresh air. He can puff away to his heart’s content on the
sundeck, which is the communal gathering spot for bar, barbecue,
lounging and partaking of the spa pool.
Sofia sets a new benchmark for Moonen. There is no greater testament
to a builder than a content repeat owner, except maybe one who
invests in the company’s future, as this owner did late in 2013.

“Prioritization” is important, as the amount of bandwidth
needed just to open a website can be dizzying,

Says Soleto: “Service plans depend on speed, ratio,
allocation and contention—how fast, how much and
how many vessels are competing for bandwidth.”
Dedicated bandwidth is available from some providers,
but at a premium price, so it is wise to do some research

SITTING AT A SALON TABLE, TAKING NOTES AND MUSING ON AN INTOXICATING
combination of high living and hard horsepower, I was enjoying an espresso and chatting with
the captain and the shipyard staff when it struck me: This was a pretty strange situation. All was
quiet, comfortable and relaxed, yet a glance out the window suggested that the world was flying
by at a phenomenal rate, and the log confirmed it: 35 knots. But there were no raised voices, no
white knuckles, and my handwriting was no more illegible than usual.
The vessel I was on was making her way from Cannes back to her homeport in the only
fashion she knew—at high speed. Beaulieu-sur-Mer is barely 30 miles down the coast from
Cannes. That’s a pleasant afternoon cruise for many boats, but for the Mangusta 94, it was a
rapid passage that began and ended in the time it normally takes me to coil the lines and stow
the fenders.
The benign conditions certainly helped, with barely a breath of breeze and just a light lop,
which the 94 sliced through imperiously. Like surface drives, jets are optimized for high performance,
and if the weather allows it, you might as well hammer the throttles, as moderation
brings little in the way of efficiency gains. With about one-third fuel and full water tanks, plus a
full inventory of cruising stores and a RIB in the stern garage, we recorded a 37-knot maximum

speed. Not bad at all. Even more impressive was the 94’s handling.
Her orb-like fly-by-wire controls may look weird, but they are totally
intuitive and the yacht responded willingly to the lightest inputs from
throttle and helm. Not even in the hardest high-speed turns did the
hull threaten to lose its grip on the water, thanks to a pair of small fins
at the stern not much bigger than the ones on your surfboard.
The Overmarine shipyard in Viareggio, with nearly 30 years under
its belt, knows a thing or two about building yachts like this.
Mangusta (it means mongoose; the boat to beat when the shipyard
started was Technomarine’s Cobra) has become a byword for big,
fast and luxurious boats. As for luxury, the yard has long made a reputation
for itself as a purveyor of the shortest options lists in yachtbuilding.
The 94’s list comprises just three items: gyro stabilizers, an
upper helm station and an electrical frequency converter. Everything
else is included in the price, even a custom layout. Overmarine has
a remarkably relaxed attitude regarding these things, and while the

standard published plans illustrate a
fairly conventional four-cabin arrangement
below, the first 94 had just two
cabins. This particular yacht, the second
off the line, had three. The port guest
twin was sacrificed for a fantastic private
lounge on the lower deck with a desk
and sofa, and a large TV on the forward
bulkhead. It’s an idyllic place to sit and read, or to quietly socialize
while the bustle of real life continues upstairs.
With 6 feet 9 inches of headroom, the master suite amidships feels
exceptionally spacious. Huge hull windows accentuate the effect. The
VIP in the bow, by contrast, feels much more compact, although
headroom is still generous both there and in the starboard guest cabin,
and the berths are full-size.

freestanding dining table aft. Four LED skylights allow you to turn
the sky on or off, and the side windows offer excellent views. Keeping
the galley out of sight and out of mind—it’s down the aft companionway,
in the crew area—ensures that the main-deck relaxation and
entertaining spaces breathe easily and feel luxuriously expansive.
The interior décor is tailored to order by the shipyard’s designers. This
particular 94’s owner opted for decapé oak and wenge, white leather
deckheads, contrasting trim in brown leather, detailing in lizard skin
and stainless steel, and mosaic tiles and travertine marble for the heads.
It worked for me, but you can request pretty much whatever you like.
While the new Mangusta 94 shares the same hull design and propulsion
engineering as the earlier 92, of which 28 were built over
a 10-year period, the deck and superstructure moldings are entirely
new. The sundeck is also a new feature that comes with the option of
an upper helm station, and the foredeck seating area is far more elaborate
than on earlier models with a sofa, adjustable tables and lounging
areas taking the place of a simple sunpad.
But at 35 knots, with the Côte d’Azur rolling past off the port beam
and the concrete breakwater of Beaulieu-sur-Mer coming rapidly into
view ahead, it was a little too breezy to sit up there. So I hunkered
down at the salon table, taking notes, drinking coffee and really
appreciating this yacht’s combination of luxury and horsepower.
After only just stepping aboard, Cannes already seemed a distant
memory, thanks to the sheer passagemaking competence of this powerful
yacht. And while the peace and quiet I enjoyed below might
have seemed incongruous to the exhilaration happening just outside
the window, it sure hadn’t taken me very long to get used to it.

VAT RATES AND RULES ARE CHANGING JUST IN TIME
FOR THE SUMMER CHARTER SEASON.

At this time last year, the system of value-added
tax in some Mediterranean cruising areas was so
unclear that charter clients were being asked to
sign contract addenda that pretty much stated,
“We don’t know which government is actually
going to charge what percentage, but be aware
that you may be obligated to pay a lot more in
taxes than the contract mentions.” Talk about a
way to drive prospective clients off the water and
into the fiscal comfort of oceanfront villas.
Thankfully, things are a bit clearer this year as
the Mediterranean season approaches, but stillevolving
rules for determining and collecting VAT
from Spain all the way across to Croatia have the
world’s top brokers attending seminars, asking
questions and hoping clients won’t be spooked
into staying ashore as the tax implications
for chartering become ever more Byzantine.
Separating rumor from fact is the order of the
day, and as senior charter agent James Graham-
Cloete of Ocean Independence recently put it,
“With all of these things, there’s always the possibility
that things can change.” Sometimes, the
reality will be determined not by what any given
government says, but by whether officials have
put organizations in place to match newly passed
rules—literally, whether there’s a guy at a desk in
a port to collect paperwork and money.
As best as anyone can tell right now, the current
tax situation for charter is easiest in Turkey, which
is not part of the European Union and thus has no
VAT. Chartering in neighboring Greece will cost
you a VAT of 5 percent to 6.5 percent depending
on the yacht, unless you start your charter in
Turkey and then cruise into Greece, in which case
there should be no Greek VAT due at all.
Croatia has changed things this year by installing
a 13-percent VAT when there used to be
none, but neighboring Montenegro still charges
zero (like Turkey, it’s not a member of the
European Union). That means a charter starting
in Montenegro and then moving into Croatia
should not be subject to any VAT.
Italy hasn’t changed its VAT structure from last
year. It’s still 22 percent, but you can get that
bumped down to an effective tax rate of 6.6
percent if your charter itinerary includes time in
international waters. The rule is that you have to
cruise at least 12 nautical miles offshore, say from
Porto Cervo to the Aeolian Islands. France has a
similar deal, with its VAT as of January rising to 20
percent and the possibility of a reduction to 10
percent for an itinerary that starts in France and
includes international waters.
“A five-minute loop to go 13 nautical miles offshore
won’t be accepted,” Graham-Cloete says.
“You can’t say you were in international waters
for a few minutes of fishing. A few hours of whale
watching, though, that should be acceptable. The
point is that if you’re starting in Italy or France
but not going into international waters, you’re
not going to get the reduced rate.”
Spain has yet to introduce the option of a
reduced rate on its 21-percent VAT, but expectations
are for more boats to be available there
this summer thanks to an end of the matriculation
tax, which charged yacht owners 12 percent of
the yacht’s value for the privilege of doing charter
business in Spanish waters. With that tax gone,
more yacht owners may apply for Spanish cruising
permits, creating new options for charter clients.
The question remaining is whether clients will be
willing to pay a 21-percent VAT to cruise in the
Balearics when they can pay 6.6 or 10 percent to
cruise between Corsica and Sardinia.
“If anybody thinks it’s getting easier, it’s not,”
says Barbara Müller, who is based in the Palma
de Mallorca office of Ocean Independence. “We
hope we will get the same system as France or
Italy where there is a reduction in VAT if you go
to international waters, but it will not be this year
in Spain. We are working on it.”
The long and the short of the situation this
summer across the Mediterranean is to once
again be prepared for some confusion, and to
take an interest in what is sure to be the year’s
most popular activity: looking for whales about
13 nautical miles offshore.

It’s uncommon to see a truly custom build in the charter market.
Interiors may be fully personalized, of course, but hull molds are re-used
and designs are tweaked and before you know it, what was once an
original yacht is hull number one in a series of 15. That will never be
the case with Inukshuk, the new 107 from Baltic Yachts in Finland. She
is unique and brand-new for charter, having launched in May 2013. She
was used exclusively by her owner until a couple of months ago, when
she opened for bookings in the Caribbean. Inukshuk is built for high-performance
sailing with carbon fiber everywhere. Her crew hit 18 knots
on the yacht’s first Atlantic crossing. The Adam Lay interior, inspired by
northeast Canada, is refreshing in its originality with oak floors and walls
stained metallic gray and details such as lampshades made from mapleleaf
cloth. Inukshuk is moving to New England this summer, taking as
many as eight guests at a weekly base rate of $70,000.

The Buyer’s Deposit: Making Legal Sense of Your Dollars and Cents

The majority of yacht purchase
offers are tendered with a
deposit. As a buyer, you can better
protect yourself by understanding
who holds this deposit and what
might happen to it in the event of
a contract breach.
At the time a buyer makes a
written offer to a yacht owner,
the buyer is often expected to
submit a good faith deposit of
10 percent. This deposit should be placed
in a third party’s escrow account. It is
commonplace for the buyer’s yacht broker or
an attorney to hold the escrow funds.
When held by an attorney, the funds
are placed into a trust account, not to be
comingled with other client funds or used in
a general account. Trust accounts are closely
monitored by the state bar association in
which the attorney holds their law license.
For example, The Florida Bar has the authority
to audit an attorney’s trust account upon
notification of misappropriation of attorney
trust funds. In addition, an attorney found
to be in violation of The Florida Bar rules
regarding attorney trust accounts may be
fined, censured, suspended for a period of
time and/or disbarred.
Most brokers also maintain trust accounts,
but save for the FDIC protections afforded to
a lending institution trust account, there are
no other protections for the escrowed funds.
A Florida licensed yacht broker is required to
be bonded, but only up to $25,000, which,
considering the large amount of the deposit
in most yacht transactions, also does not
afford much protection for
the escrowed funds. Before
lodging a deposit with a broker,
the buyer should have a clear
understanding of whom the
broker is working for, as the
broker could be representing
both the buyer and seller in the
same transaction. If a broker
holds the buyer’s deposit, then
regardless of whom the broker
represents, the broker has a legal duty to
act as a neutral third party concerning the
deposit. If the broker is acting on behalf of
both parties, then the buyer might want to
consider electing another escrow agent.
Most purchase and sales agreements used
by yacht brokers contain standard language
appointing the buyer’s broker as the escrow
agent. Therefore, if the buyer will be using
someone other than the broker as the escrow
agent, this language must be modified before
submitting the offer to the seller. It is typical
that a buyer’s written offer is drafted by the
buyer’s broker and submitted to the seller’s
broker without an attorney review. If the seller
accepts and signs off on the buyer’s offer, then
the parties have a binding agreement that can
only be modified in writing as negotiated by
both parties.
Other methods of holding a buyer’s deposit
include both parties opening a joint bank
account and having the buyer wire the deposit
there; using an escrow service, such as a
bank, to hold the buyer’s funds; or the buyer
giving the deposit directly to the seller, which
obviously leaves it much less protected should
a dispute arise between the parties.
Regardless of how the deposit is made, the
buyer’s written offer or purchase agreement
needs to have clear terms and conditions about
how the sale is predicated and how the deposit
is to be treated upon a party’s default. The
escrow agent will require explicit instructions
that must be signed by both parties, and will
follow those instructions concerning the
disbursement of escrowed funds.
Most purchase agreements make an offer
contingent upon a buyer’s personal inspection,
survey and sea trial of the yacht. If any one
of those items is unsatisfactory and the buyer
notifies the seller within the contractual
time period, then the escrow agent must
immediately refund the buyer’s deposit.
With most failed transactions, litigation
ensues to determine who breached the
agreement and what becomes of the buyer’s
deposit. If there is a conflict regarding who
has defaulted, then an escrow agent should
do one of two things: hold the deposit until
he receives mutually-agreed-to written
instructions signed by both parties, or lodge
the deposit with the local court. Once the
deposit is lodged with the court, the parties
can fight over the deposit using attorneys.
Because the closing proceedings of most
yacht transactions occur over a relatively
brief amount of time compared with other
business deals—within weeks from start to
close—it’s essential to consider the legal
significance of a deposit. Take a moment to
understand what will happen to your deposit
and ensure that it is being held in a secured
escrow account.
