I am thrilled to announce<br />

that the Grueninger Travel Group<br />

is celebrating its 70 th anniversary this year!<br />

It has been an incredible journey, and we could not have done it without<br />

you. We are grateful for your loyalty and trust in us.<br />

As many are aware, our company was founded by two passionate travelers<br />

– Othmar and Libby Grueninger, my mom and dad, who met on our<br />

inagural tour in June 1954. What started as a vision to share the world<br />

with their Hoosier community has evolved into an enduring platform that<br />

inspires all of us to explore the world, engage with, and learn from people<br />

from every corner of the globe.<br />

The connection with individuals extends to our interactions with our<br />

guests. My parents thoroughly enjoyed going on trips with you and being<br />

intricately involved in the planning of every detail to ensure that the trip


would come to life, just as they planned right from the start. The final tour<br />

led by Othmar and Libby was a cruise from Venice to Istanbul in 2015,<br />

however, that wasn’t their final trip as they seized every opportunity to travel<br />

as guests right alongside you. I share the same enthusiasm. My wife and I are<br />

excited to be hosting a Portugal River Cruise this spring. Seven decades later,<br />

maintaining connections with our clientele remains an essential part of who<br />

we are. This industry and our business are a calling that we cherish every day.<br />

Travel) (collectively “Grueninger”)<br />

By registering for a trip and/or making a payment for the trip, you, as the Traveler<br />

or Parent/Legal Guardian of Traveler (the “Traveler”, “You”), hereby accept the<br />

following Terms and Conditions and agree to be bound by them. You represent<br />

that you are 18 years of age or older. Grueninger Cruises and Tours, Inc., d/b/a<br />

Ambassadair, Grueninger Music Tours, Ambassadair Groups and Incentives,<br />

Grueninger Tours, Grueninger Travel Group, Amber Travel (“Grueninger”) provides<br />

you the detailed travel plans per the trip pages on our website, ambassadair.com,<br />

conditioned on your acceptance, without modification of the terms, conditions and<br />

notices contained herein. Traveler acknowledges and agrees that Grueninger may<br />

change these General Terms and Conditions at any time and those changes become<br />

effective immediately. Grueninger is not responsible for any traveler’s unawareness<br />

of the General Terms and Conditions. Traveler agrees to be bound by the General<br />

Terms and Conditions that are in effect at the time of travel or by cancellation.<br />

PRICE Prices are in U.S. dollars and are based on operating costs, fuel prices, taxes,<br />

and exchange rates at the time of contracting with vendor partners. Should these<br />

increase, you may be notified and asked to pay these additional costs. All prices are<br />

subject to change without notice. Prices listed in this publication are per person based<br />

on two people sharing a room (double occupancy) or one person (single occupancy).<br />

For triple, child, and other pricing, refer to our website or contact a Grueninger Travel<br />

Counselor. Room occupancy limits vary among hotel properties and/or destinations.<br />

Triple rooms are based on three people sharing two beds; rollaway beds are not<br />

The “Package with Air” price includes round trip economy class airfare from<br />

Indianapolis (unless otherwise noted), all accommodations, airport transfers or<br />

motorcoach transportation, sightseeing and admissions, meals, hotel baggage<br />

handling (one suitcase per person), and gratuities as noted in the itinerary. All airfare<br />

and departure taxes are included unless this is not allowed by the country to be<br />

visited. If there is an increase, you will be notified prior to departure. “Land Only”<br />

prices can be found online at ambassadair.com and do not include air travel, airline<br />

fees, airport or departure taxes, or transfers. Single occupancy packages are available<br />

as listed on ambassadair.com but in limited quantity.<br />

Cruise pricing includes all inclusions per the trip page at ambassadair.com and all<br />

taxes and fees at the time of print. Complete pricing may be found at ambassadair.<br />

com or by calling a Grueninger Travel Counselor.<br />

We reserve the right to re-invoice you in case an error is made in computing your<br />

price. We cannot be responsible for typographical errors, misprints, and misquotes.<br />

We are not responsible for travel arrangements you have made on your own.<br />

Grueninger reserves the right to cancel or re-schedule any trip departure.<br />

Grueninger’s only liability will be to refund to the traveler the amount it has<br />

received for the “Land Only” reservation (less any applicable fees). Any air tickets or<br />

other travel arrangements purchased outside of the trip package purchased from<br />

Grueninger will not be the liability of Grueninger in the case of trip cancellation,<br />

schedule change or itinerary change.<br />

PRICE EXCLUSIONS Package prices do not include any items other than those<br />

listed in the trip itinerary. Visas, passport fees, incidental charges (snacks, laundry,<br />

phone calls, internet access, etc.), beverages, meals not mentioned, medical testing,<br />

immunizations, inoculations, a travel protection plan, items of a personal nature and<br />

gratuities for your travel director, motorcoach driver, hotel staff, cruise ship staff or<br />

other service provider are not included. Airline fees such as checked and/or excess<br />

baggage or seat selections and /or upgrades are not included. The price does not<br />

cover costs and travel expenses if you leave the trip whether of your own volition,<br />

our decision based on behavior that disrupts the trip, due to illness, action by any<br />

government or other reason. This list is illustrative and not a complete list of every<br />

item not included.<br />

RESERVATIONS & PAYMENT A per person deposit is required to confirm your<br />

reservation. Upon confirmation of reservation, balance of payment is due 60 to 90<br />

days prior to departure date, or earlier if specified. Deposit amounts, final payment<br />

dates and cancellation dates and fees vary by trip, and details can be found on<br />

the specific trip page at ambassadair.com. For reservations made within the final<br />

payment date, full payment is due immediately; a deposit or full payment may be<br />

taken if you are placed on a waitlist. All personal checks should be made payable<br />

to Ambassadair or Grueninger Travel Group. We also accept MasterCard, Visa,<br />

and Discover. Grueninger reserves the right to cancel any reservation and impose<br />

cancellation fees if any payment Is not received per the payment schedule found on<br />

the specific trip page at ambassadair.com.<br />

CANCELLATION & REFUND You have the right to cancel your reservation and receive<br />

a full refund, less the per person cancellation fee if applicable, any time prior to final<br />

payment. Trip cancellation fees and final payment dates vary by trip, and details can<br />

be found on the specific trip page at ambassadair.com. Travelers who cancel after<br />

final payment will forfeit the total amount of the reservation, unless otherwise stated<br />

on the trip page. All refunds will be processed according to the manner in which you<br />

paid; some exceptions may apply per the guidelines of the processing merchant.<br />

Unless stated otherwise in these terms and conditions, please allow thirty (30) days<br />

for refunds to be processed. Grueninger reserves the right to cancel any reservation<br />

and impose cancellation fees if any payment is not received per the payment<br />

schedule found on the specific trip page at ambassadair.com. To avoid cancellation<br />

fees, we recommend optional travel protection or Cancellation Waiver.<br />

TRAVEL PROTECTION/CANCELLATION WAIVER Grueninger strongly recommends<br />

that travelers purchase a travel protection plan. Travel protection safeguards<br />

your travel investment, your belongings, and most importantly, you. Your travel<br />

protection plan should cover at a minimum, cancellation, curtailment, medical,<br />

emergency travel and personal accidents, and damage or loss to personal belongings.<br />

Travel protection with Cancel for Any Reason coverage is available and Grueninger<br />

recommends you research this coverage prior to purchasing travel protection.<br />

Grueninger is not qualified to answer technical questions about the benefits,<br />

exclusions, and conditions of travel protection plans. Grueninger cannot evaluate the<br />

adequacy of the prospective insured’s existing insurance coverage. If you have any<br />

questions about your travel protection, call the travel protection company directly.<br />

Declining travel protection plan coverage could result in the loss of your travel<br />

cost and/or require more money to correct the situation. You also acknowledge<br />

that without this coverage, there may be no way to recoup any losses, costs or<br />

expenses incurred. If a traveler chooses to travel without adequate travel protection,<br />

Grueninger will not be liable for any of your losses howsoever arising, which would<br />

have been covered by adequate travel protection.<br />

For some trips, a Cancellation Waiver may be offered. This covers any cancellation<br />

fees incurred by changes or cancellation up to 48 hours prior to departure of air and/<br />

or ground components. It does not cover the Cancellation Waiver premium, nonrefundable<br />

optional tours, one-way travel, or voluntary changes made to your plans<br />

that result in a price increase. The Cancellation Waiver may only be purchased at the<br />

time of reservation and deposit and is valid for new bookings only on selected trips<br />

per the trip page on ambassadair.com. If the Cancellation Waiver is desired, it must<br />

be purchased by each paying passenger on the reservation and each person sharing<br />

accommodations.<br />

CHANGES Any changes you make regarding your reservation are subject to a per<br />

person change fee plus any applicable cancellation charges or increases in the<br />

package price.<br />

ITINERARIES Grueninger continually strives to improve travel itineraries. If such<br />

improvements can be made, we reserve the right to vary itineraries and to substitute<br />

accommodations. Grueninger strives to operate trips as advertised, but if unforeseen<br />

circumstances beyond our control make changes necessary, we will make every effort<br />

to substitute accommodations, sightseeing or other inclusions with options of a<br />

similar standard and location whenever possible.<br />

CANCELLATION BY GRUENINGER Grueninger reserves the right to cancel any<br />

trip at its sole discretion. In the unlikely event a trip is canceled by Grueninger and<br />

Grueninger is unable to reschedule, all funds collected from any traveler will be<br />

refunded or credit provided. Money is refunded to the original payer. Grueninger<br />

shall not be responsible for any refund and will pay no damages in the event of<br />

cancellation due to Force Majeure.<br />

FORCE MAJEURE Grueninger shall not be responsible for, and shall make no refund<br />

for, events beyond its control, such as, without limitation, acts of God, strikes, acts of<br />

war, terrorism or civil disturbance, government restrictions, changes of schedules or<br />

operational decisions of air carriers, terrorist activity or the threat thereof, industrial<br />

action, natural or nuclear activity, epidemic and/or pandemic or the threat thereof,<br />

illness, physical injury, quarantine, medical or customs or immigration regulation,<br />

delay, or cancellation, adverse weather conditions, fire, or for acts or omission of Third<br />

Parties or other parties not under the control of Grueninger and all similar events<br />

outside Grueninger’s control.<br />

TRIP DOCUMENTS Final documents will be issued electronically or by mail<br />

approximately 10-14 days prior to departure. Documents will not be delivered<br />

without full payment on a reservation.<br />

Grueninger issues airline tickets, hotel confirmations and other travel documents<br />

for such services as an agent for the companies that provided these services directly.<br />

Group airline tickets and group hotel accommodations are subject to all terms and<br />

conditions of the respective vendor partners (airlines, hotel chains, etc.) regarding<br />

group travel. These vendor partners may limit or exclude the accrual of frequent<br />

flyer or reward program points. It is the traveler’s sole responsibility to review these<br />

documents for accuracy. Grueninger will not be liable for inaccuracies in any travel<br />

documents.<br />

DESTINATIONS AND REQUIRED TRAVEL DOCUMENTS Obtaining and carrying<br />

the appropriate travel documentation is the sole responsibility of the traveler.<br />

Grueninger bears no responsibility for such information and will not be responsible<br />

for advising and/or obtaining required travel documentation for any guests, or<br />

for any delays, damages and/or losses including missed portions of the trip due to<br />

improper documentation. Prior to planning a trip, travelers should always visit http://<br />

www.travel.state.gov and look at the specific destination information and current<br />

requirements.<br />

Travel to and from certain destinations may involve greater risk than others.<br />

Grueninger urges traveler to remain informed on a daily basis as to current news<br />

events, as well as to review travel prohibitions, warnings, announcements and<br />

advisories issued by the United States Government prior to booking travel to<br />

international destinations. Information on conditions in various countries and the<br />

level of risk associated with travel to particular international destinations can be<br />

found at http://www.travel.state.gov. In addition, Traveler should consult with<br />

government websites to ensure that you are in compliance with all requirements for<br />

admittance into that country as well as understanding local laws that govern travel<br />

within a country.<br />

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, GRUENINGER DOES<br />

NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR<br />

WITHOUT RISK. SHOULD TRAVELER CHOOSE TO TRAVEL TO A COUNTRY THAT HAS<br />

BEEN ISSUED A TRAVEL WARNING OR ADVISORY, INCLUDING COVID OR OTHER<br />

DISEASE OR PANDEMIC WARNINGS, GRUENINGER SHALL NOT BE LIABLE FOR COSTS,<br />

DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.<br />

TRAVELER’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT<br />

TRAVELER’S OWN RISK.<br />

In the case of international travel, traveler and any minors traveling with traveler<br />

must be in possession of a machine-readable passport valid for 6 months after their<br />

trip return date along with applicable visas. Some countries require that traveler<br />

passports have two to four blank visa/stamp pages. Some airlines will not allow<br />

traveler to board if this requirement is not met. For information about passport<br />

requirements, traveler can visit the State Department’s website at https://travel.<br />

state.gov/content/travel/en/passports.html. It is traveler’s sole responsibility to<br />

understand specific passport requirements and to secure and/or pay for any and all<br />

visas, reciprocity fees, affidavits, immunizations, inoculations, vaccinations, medical<br />

testing or other Items that are required to be permitted entry into each destination.<br />

In some countries traveler may be subject to entry (reciprocity) fees and/or departure<br />

taxes/ exit fees which will be collected at the airports upon entry/departure by<br />

local government authorities. Please note that entry to any country may be refused<br />

even if the required information and travel documents are complete. For additional<br />

requirements to travel to international destinations, traveler can visit https://travel.<br />

state.gov/content/travel/en/international-travel.html.<br />

Some countries require visas to enter. Without a valid visa, traveler may be denied<br />

entry into the country. Traveler can find out if a visa is required by visiting the<br />

embassy website of the country traveler will be traveling to. Although traveler can<br />

always contact Grueninger with questions, it is traveler’s responsibility to ensure<br />

traveler has all the proper travel documents, to include traveler visa(s). Grueninger is<br />

happy to refer to traveler a third-party visa processing company if traveler so desires.<br />

Children traveling with one parent, or someone who is not a parent/legal guardian,<br />

or children traveling in a group may require additional travel documentation. Foreign<br />

border officials may require custody documents or written consent from the other<br />

parent/both parents. Requirements vary by country; visit website at https://travel.<br />

state.gov/ for detailed information. It is the traveler’s responsibility to understand<br />

all requirements and have the appropriate documentation.<br />

When travelling domestically or internationally, the U.S. Transportation Security<br />

Administration (TSA) and U.S. Department of Homeland Security (DHS) advises<br />

that everyone carry at least two forms of acceptable identification in order to board<br />

a flight. Examples include but are not limited to government issued in-state, fully<br />

valid driver’s license, DHS designated enhanced driver’s license, US Passport or a<br />

foreign government passport. The name, date of birth and gender that appears on<br />

the identification card must exactly match the same such data that is listed on airline<br />

ticket(s) and reservation records. For more information, traveler can visit the TSA<br />

website at https://www.tsa.gov/travel/security-screening/identification.<br />

Obtaining and carrying the appropriate travel documentation is the sole<br />

responsibility of the traveler. Grueninger bears no responsibility for such information<br />

and will not be responsible for advising and/or obtaining required travel<br />

documentation for any guests, or for any delays, damages and/or losses including<br />

missed portions of the trip due to improper documentation.<br />

Recommended immunizations, inoculations and medical testing for travel may<br />

change and traveler should consult their provider for current recommendations<br />

before traveler’s departure. It is traveler’s responsibility to ensure that traveler meets<br />

all health entry requirements, obtain the recommended immunizations, inoculations,<br />

and medical testing, take all recommended medication, and follow all medical advice<br />

in relation to traveler’s trip. Some locations may require you to have a vaccination<br />

or proof of specific medical testing. Traveler must be aware of restrictions and have<br />

all appropriate documentation for any stopover destinations. On return home, there<br />

may be additional requirements. Traveler is responsible for understanding all of<br />

these requirements and must not rely on Grueninger to provide information. More<br />

cdc.gov/ and at the U.S. Department of State website https://www.travel.state.gov/.<br />

BAGGAGE ALLOWANCE & LIABILITY Baggage allowance and fees vary and are not<br />

covered in the cost of the trip. For specific allowances and fees, see specific airlines or<br />

cruise lines and refer to Grueninger’s documents, issued approximately 10-14 days<br />

before the trip. Questions regarding baggage restrictions on commercial carriers<br />

should be directed to that particular airline or cruise line.<br />

Although every effort is made to handle traveler’s luggage as carefully as possible,<br />

Grueninger is not responsible for and does not assume liability or accept claims for<br />

loss of or damage to luggage due to breakage, theft or tear through handling by<br />

various vendor partners. It is recommended for your own self-interest and protection<br />

that you have adequate insurance to cover these eventualities.<br />

AIR CARRIERS All trips are via commercial air carriers unless otherwise noted.<br />

Grueninger acts as a sales agent for air carriers and reserves the right to designate<br />

any air carrier, including commuters and charter services, connecting routing and<br />

schedule. Tickets issued are highly restrictive and may not be reissued, revalidated,<br />

or exchanged for another carrier or routing.<br />

AIR SCHEDULE Flight schedules are confirmed by Grueninger as early as 60 days<br />

prior to departure date. A tentative flight schedule may be given. You will receive<br />

your air schedule with your final documents approximately 10-14 days prior to<br />

departure. However, these schedules and air carriers are subject to change without<br />

notice prior to departure.<br />

SEAT AND ROOM ASSIGNMENTS Airline seating and hotel room type requests<br />

made at the time of booking will be considered; however, these are requests, not<br />

guarantees. Although your preferences are forwarded to our vendor partners, they<br />

cannot always honor these requests and pricing does not include assigned, purchased<br />

or upgraded seats or room types.<br />

TRAVEL DIRECTORS All departures designated as “Escorted” and with 20 travelers or<br />

more will have a Grueninger Travel Director throughout the trip.<br />

ACTIVITY LEVEL The amount of activity varies according to the trip. In general,<br />

European destinations require more walking over uneven surfaces. Please call a<br />

Grueninger Travel Counselor who can answer questions regarding the activity level<br />

per trip. By taking part in such activities, you incur and assume all of the risks that<br />

such activities present. Grueninger is not qualified to evaluate your fitness; you must<br />

evaluate your fitness for any given trip or activity. Grueninger assumes no liability<br />

or responsibility for any damages which may result from your participation in any<br />

activity during the trip.<br />

TRAVELERS NEEDING SPECIAL ASSISTANCE Travelers needing special assistance<br />

are welcome and must always be accompanied by a companion capable of providing<br />

all required and needed assistance and must not require assistance from Grueninger<br />

or its vendor partners. The traveler must notify Grueninger of any special assistance<br />

needed, in writing no later than the payment of the first deposit, and of status and<br />

identity of the non-discounted, paid travel companion who will be responsible for<br />

providing all necessary assistance. The traveler should notify Grueninger if ADA<br />

accessible accommodations and/or transportation are needed as soon as possible but<br />

no later than the payment of the first deposit. Grueninger will make all reasonable<br />

efforts to accommodate this request but cannot be responsible if ADA transportation<br />

and/or accommodations are not available. Any accommodations provided will be at<br />

the sole expense of the traveler.<br />

Neither Grueninger nor its vendor partners may physically lift or assist traveler into<br />

transportation vehicles. Any traveler that uses oxygen must work with the airline or<br />

other vendor partners directly to obtain approval.<br />

SPECIAL DIETARY REQUIREMENTS Grueninger, its representatives and its vendor<br />

partners will do their best to accommodate special dietary requests. However, for<br />

safety and liability reasons, Grueninger and its representatives cannot be responsible<br />

for directly accommodating any food allergies, or dietary requirements and<br />

restrictions, and is not responsible for any issues or problems associated with the<br />

same. All scenarios and special dietary requests regarding food and drink, including<br />

allergies, or dietary requirements and restrictions, are the sole responsibility of the<br />

traveler. While most meal establishments can offer general options, Grueninger<br />

cannot guarantee that options will be available. Just in case, Grueninger recommends<br />

packing extra food/snacks if special dietary needs cannot be met.<br />

HEALTH AND SAFETY For the safety of our travelers, Grueninger reserves the right to<br />

request health information prior to travel and to exclude any travelers it deems unfit<br />

for travel at its sole discretion.<br />

PERSONAL CONDUCT Grueninger and its vendor partners reserve the right in its<br />

or their sole discretion to terminate any traveler who does not abide by its or their<br />

rules and regulations, and/or whose conduct is deemed to be such as to endanger<br />

the traveler, the welfare of other travelers, staff members and/or third parties or the<br />

success of the program. In the event of such termination, traveler will be required to<br />

leave the trip at the expense of the traveler. In the event of such termination, there<br />

will be no refund whatsoever.<br />

When you book with Grueninger, traveler accepts responsibility for any damage<br />

or loss caused by traveler. Full payment for any such damage or loss (reasonably<br />

estimated if not precisely known) must be paid directly at the time to the<br />

accommodation owner or manager or other supplier. Traveler must indemnify<br />

Grueninger for the full amount of any claim (also including legal costs) made against<br />

Grueninger. Traveler agrees to and shall indemnify and hold harmless Grueninger<br />

and each of Grueninger’s officers, directors, employees and agents, from any<br />

expenses, losses, liabilities, damages, judgments, settlements and costs (collectively,<br />

“damages”) involved with or incurred by Grueninger (including, without limitation,<br />

reasonable attorneys’ fees and the advancement of same) with respect to any claims,<br />

law suits, arbitrations, or other causes of action, which result, directly or indirectly,<br />

from any traveler’s breach or violation, or threatened breach or violation, of this<br />

Agreement.<br />

PHOTOGRAPHY ON TOUR Unless an opt-out waiver is requested, all travelers assign<br />

permission to Grueninger, and its photographer(s), to use the images in any media<br />

for any purpose (except pornographic, defamatory, libelous or otherwise unlawful)<br />

which may include, among others, advertising, promotion, marketing and packaging<br />

for any product or service. Images may be combined with other images, text and<br />

graphics, and cropped, altered or modified. All paid and complimentary travelers<br />

acknowledge and agree with consent to publication. Traveler’s retention of tickets,<br />

reservations, or bookings after issuance shall constitute consent to the above, as well<br />

as an agreement on traveler’s part to convey the contents hereof to his or her travel<br />

companions or group members.<br />

VENDOR PARTNERS’ LIABILITIES Grueninger makes arrangements with air carriers,<br />

hotels, cruise lines, car rental companies, and other independent parties to provide<br />

you with travel services you purchase. These services are subject to the conditions<br />

imposed by these vendor partners, and their liability may be limited by their tariffs,<br />

conditions of carriage, and international agreements.<br />

RESPONSIBILITY CLAUSE Grueninger Cruises and Tours, Inc., (d/b/a Ambassadair,<br />

Grueninger Music Tours, Ambassadair Groups and Incentives, Grueninger Tours,<br />

Grueninger Travel Group, Amber Travel) its employees, shareholders, subsidiaries,<br />

affiliates, officers and directors, (collectively “Grueninger”) does not own or operate<br />

any person or entity which is to or does provide goods or services for traveler’s trip,<br />

including, for example, lodging facilities, transportation companies, local ground<br />

handlers, food service or entertainment providers, etc. All tickets, receipts, coupons,<br />

and vouchers are issued subject to the terms and conditions specified by each<br />

vendor partner, and by accepting the coupons, vouchers, and tickets, or utilizing the<br />

services, all customers agree that neither Grueninger, nor its employees, agents, or<br />

representatives are or may be liable for any loss, injury, or damage to any traveler<br />

or their belongings, or otherwise, in connection with any service supplied or not<br />

supplied resulting directly or indirectly from any occurrence beyond the control of<br />

Grueninger. Grueninger is not liable for any negligent or willful act or failure to act of<br />

any such person or entity, or of any act of any other third party not under its control.<br />

Grueninger in its sole discretion reserves the right to decline to accept any traveler as<br />

a member of Grueninger trip.<br />

Without limiting the foregoing, Grueninger is not responsible for injury, delay,<br />

inconvenience, damage, or death which results from criminal activity, weather or<br />

other acts of God, acts of government, disease, epidemics and/or pandemics or the<br />

threat thereof, illness, the provision of inappropriate or no medical attention or<br />

delayed access to appropriate medical attention, the demands of indoor or outdoor<br />

activities, strikes, political or civil unrest, overbooking, structural or other defective<br />

conditions in hotels or other lodging facilities, acts of terrorism or the threat thereof,<br />

attacks from or bites by animals, insects or pests, transportation failures of any kind<br />

or the failure of any transportation mechanism to arrive or depart timely or safely,<br />

insurrection or revolt, or any other event beyond its direct control. Additionally,<br />

both the U.S. State Department and the Centers for Disease Control publish and<br />

update important country-specific information for travelers. Grueninger strongly<br />

recommends that all travelers review these notices currently located at https://travel.<br />

state.gov/content/passports/en/alertswarnings.html and https://www.cdc.gov/<br />

travel/notices.<br />

No refunds will be made for features on the trip not utilized. The cost of replacing<br />

lost or stolen coupons, vouchers or tickets is the responsibility of the traveler. If a<br />

flight or transfer by other means of transportation is missed, whether by weather or<br />

other conditions beyond Grueninger’s control, traveler is responsible to make his or<br />

her own arrangements and to pay all charges associated therewith. Grueninger may<br />

cancel any trip because of insufficient enrollment or for any other reason. The terms<br />

set forth in this agreement constitute the entire agreement between the traveler<br />

and Grueninger.<br />

ADDITIONAL RISK Traveler expressly acknowledges that naturally occurring<br />

diseases and viruses (including, but not limited to, COVID-19) may be present and<br />

actively occurring in all environments in which this trip will take place. Traveler also<br />

understands that if they are older or have underlying conditions, the traveler may<br />

be more prone to serious infection and death due to COVID-19 or other naturally<br />

occurring diseases and viruses. As a result of the highly infectious nature of these<br />

diseases, federal, state, and local governments and federal and state health agencies<br />

may recommend social distancing, wearing of PPE (including masks), and may, in<br />

many locations, prohibit the congregation of groups of people. Grueninger may<br />

require the completion of a waiver(s) stating that the traveler understands and<br />

accepts the risk of traveling in such environments.<br />

Traveler, any minors traveling with traveler, and on behalf of any traveler and their<br />

heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY,<br />

AND HOLD HARMLESS Grueninger Cruises and Tours, Inc., (d/b/a Ambassadair,<br />

Grueninger Music Tours, Ambassadair Groups and Incentives, Grueninger Tours,<br />

Grueninger Travel Group, Amber Travel), its officers, agents, and/or employees,<br />

vendor partners, and other travelers (RELEASEES), from any and all claims, demands,<br />

losses, and liability arising out of or related to any INJURY, DISABILITY, DEATH OR ANY<br />

OTHER LOSS traveler may suffer due to exposure, infection, or spread of COVID- 19<br />

or any other naturally occurring disease and virus, WHETHER ARISING FROM THE<br />

NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by<br />

law.<br />

Traveler assumes all inherent risks involved in the use of any exercise equipment and/<br />

or swimming pool and/or any other body of water, which risks include, but are not<br />

limited to bodily injury, sickness, disease or death from using the exercise equipment,<br />

swimming pool or body of water. Travelers also acknowledge and understand that<br />

use of any exercise equipment, swimming pool or other body of water is potentially<br />

dangerous and that there exists a risk of injury or death when using any equipment,<br />

swimming pool or any other body of water. TRAVELER UNDERSTANDS THERE WILL BE<br />

NO LIFEGUARD ON DUTY AND IF THE TRAVELER CHOOSES TO SWIM OR USE A HOT TUB<br />

OR SPA, TRAVELER WILL DO SO AT THEIR OWN RISK.<br />

Additional risks and dangers may arise including, but not limited to, hazards of<br />

travel by train, automobile, motorcoach, aircraft and other means of conveyance,<br />

animal interactions, swimming, forces of nature, political unrest, other unrest,<br />

risks associated with water, food, plants, insects and differing animal regulation,<br />

and acts of national and local governments and unrest and acts of others against<br />

governments. These risks are not an exhaustive list but are examples of many kinds<br />

of risks. Traveler is voluntarily participating in these activities with the knowledge<br />

that there are significant dangers involved, and traveler hereby agrees to accept<br />

any and all risks. As lawful consideration for the agreement with Grueninger to<br />

participate in such trips and activities traveler agrees traveler will not make a claim<br />

against Grueninger, its related companies or its personnel or sue for bodily injury,<br />

emotional trauma, death, property loss or damage or other loss, cost or expense,<br />

however caused, as a result of or related to traveler contracting for, traveling to<br />

or from, or in any and every other way participating in the trip. Traveler releases<br />

Grueninger, its related companies and its personnel from any and all claims, known<br />

or unknown, arising from contracting for, traveling to or from, and in any and every<br />

way participating in a trip. This release of liability and assumption of risk agreement<br />

is entered into on behalf of you and all members of your family and party, also<br />

including minors. This agreement also binds your heirs, legal representatives and<br />

assigns.<br />

Where the traveler occupies a motorcoach seat fitted with a safety belt, neither<br />

Grueninger nor the Operator nor its agents or co-operating organizations or service<br />

providers will be liable for any injury, illness or death or for any loss or damages or<br />

claims whatsoever arising from any accident or incident, if the safety belt is not being<br />

worn at the time of such an accident or incident. This exclusion and limitation of<br />

liability shall not be used to imply that the Operator or its agents or affiliated entities<br />

are liable in other circumstances.<br />

ERRORS AND OMMISSIONS While every effort is made to ensure the accuracy of<br />

information in Grueninger brochures, on Grueninger websites or communicated by<br />

Grueninger staff, errors and omissions are possible and Grueninger is not responsible<br />

for such errors. If a mistake is made in price and/or inclusion quoting or billing,<br />

Grueninger reserves the right to correct the invoice and you will be responsible for<br />

proper payment. Grueninger also reserves the right to amend these Terms of Service<br />

at any time. All amended Terms of Service shall automatically be effective upon being<br />

posted by Grueninger to its websites. Accordingly, guests should check the website<br />

ambassadair.com or grueningertravelgroup.com prior to travel in order to ensure the<br />

most updated terms of service.<br />

SEVERABILITY If any provision of these terms and conditions shall be held<br />

unenforceable, such provision shall be struck and the remainder shall remain<br />

enforceable.<br />

CHOICE OF LAW This agreement is governed in all respects by the laws of the state<br />

of Indiana without regard to conflicts of law principles. In no event shall Grueninger<br />

be liable for other than compensatory damages, and you hereby waive all rights to<br />

punitive damages. You agree that you will only bring claims against Grueninger in<br />

your individual capacity and not as a plaintiff or class member in any purported class<br />

action or representative proceeding. All traveler claims must be submitted in writing<br />

and received by Grueninger no later than thirty (30) days after the completion of the<br />

Grueninger trip. Traveler claims not submitted and received within this time shall be<br />

deemed waived and barred.<br />
