PERPETRATORS<br />

When working with the police, public health experts<br />

discovered that 79% of gun crimes are committed by<br />

individuals who are not the legal owners of the gun. This<br />

means that responsible gun ownership is not the cause of<br />

gun crime. Research professionals found that in about 8 out<br />

of 10 cases, the perpetrator had illegal possession of a gun<br />

that belonged to someone else. Law enforcement personnel<br />

are significantly outnumbered compared to the general<br />

population. Taking guns away from responsible owners puts<br />

millions of Americans at risk of being harmed by gun crime<br />

perpetrators.<br />

LAW IS SEPARATE FROM PUBLIC POLICY<br />

Guns laws and public policy have intersected in the modern<br />

world and social understanding. However, it is important to<br />

separate the two because there is a clear distinction<br />

between law and policy. The Constitution serves as the<br />

foundation for all laws and those laws form the basis of<br />

public opinion. Public policy heavily relies on public<br />

opinion. But law is superior to them both and the<br />

Constitution is supreme. For these reasons, it is not wise to<br />

mix up law with policy like many politicians, lobbyists, and<br />

grassroots often do.<br />

LAW IS ABOVE PUBLIC OPINION<br />

Any legal professional can confirm that law is based on<br />

facts, not emotions or personal beliefs. It is a technical field<br />

that solely relies on legal facts. Living in a society where<br />

public opinion heavily influences public policy may lead<br />

one to believe that it holds the same power in Law.<br />

However, this is not the case. The law is based solely on the<br />

Constitution, which remains unaffected by emotions or<br />

personal sentiments. Hence, it is advisable to politely<br />

decline engaging with individuals who fail to comprehend<br />

this concept.<br />

LEGAL FACTS ARE FOUND IN HISTORY<br />

It is important to understand that early American history<br />

holds great relevance in today's world, contrary to the<br />

mistaken belief held by many. The act of manipulating a<br />

will to align with contemporary values and standards is<br />

both unattainable and unlawful. Similarly, distorting the<br />

meaning of the U.S. Constitution to conform to the presentday<br />

society is an impossibility and a violation of the law. The<br />

meaning of the Constitution may appear to have changed<br />

due to amendments, but that is not the case. Instead, the<br />

amendments have created a special class of law that only<br />

applies under specific circumstances. Those details are<br />

STUDY COURT CASES FOR INSIGHT<br />

Judicial rulings from closer time periods to the adoption of<br />

the Second Amendment give the most accurate legal<br />

context. This is because they show what it meant when it<br />

was adopted, rather than how public policy interprets it<br />

today. Since all laws and amendments must align with the<br />

original intent of the Constitution, there are many different<br />

types of law to accommodate social diversity. In other<br />

words, not every law applies in every instance. The rights of<br />

those who the Second Amendment applied to at the time it<br />

was adopted have not changed. It is the duty of every<br />

citizen to be aware of their rights.<br />

WITHSTANDING THE TEST OF TIME<br />

The body of the Constitution has remained unchanged since<br />

its drafting in 1787. Even with the addition of the first 10<br />

Amendments known as the Bill of Rights in 1789, its<br />

fundamental meaning remains unaffected. This still holds<br />

true today because the original meaning has not been<br />

altered, even with the additional Amendments since then.<br />

LIMITATION ON FEDERAL GOVERNMENT<br />

The Second Amendment of the Federal Constitution is only<br />

a limitation on the Federal Government. In the words of the<br />

U.S. Supreme Court: The provision in the Second<br />

Amendment to the Constitution, that “the right of the<br />

people to keep and bear arms shall not be infringed,” is a<br />

limitation only on the power of Congress and the national<br />

government, and not of the States. Presser v. Illinois, 116 U.S.<br />

252, 253 (1886). State laws concerning gun rights are an<br />

extension of federal law. They are the enforcement of<br />

federal laws and policies within state boundaries, which is<br />

explained in the legislative intent of each statute. This<br />

makes them unconstitutional under the Second<br />

Amendment because it is Congress infringing the rights of<br />

the people via state proxies.<br />

CITIZEN REQUIRED TO BEAR ARMS<br />

Infringing the rights of the people to keep and bear arms<br />

poses a threat to national security. From the country’s<br />

founding, it was always understood that citizens are legally<br />

required to bear arms. This was the reason for adopting the<br />

Second Amendment. The U.S. Supreme Court explains it as<br />

follows: “That it is the duty of citizens by force of arms to<br />

defend our government against all enemies whenever<br />

necessity arises is a fundamental principle of the<br />

Constitution. The common defense was one of the purposes<br />

for which the people ordained and established the<br />

Constitution…Whatever tends to lessen the willingness of<br />

citizens to discharge their duty to bear arms in the country’s<br />

defense detracts from the strength and safety of the<br />

Government. ” United States v. Schwimmer, 279 U.S. 644,<br />

650 (1929). Under the Second Amendment, the ATF<br />

activities interfering with the fundamental civic duties of<br />

the citizen are unconstitutional because Congress was<br />

specifically denied that power.<br />

ABOLISH ILLEGAL ACTIVITY NOW<br />

Anything that goes against the Constitution must be<br />

stopped immediately. Just because something is<br />

happening does not make it right or legal. However, it is<br />

important to note that our rights cannot protect<br />

themselves. It is not the government's responsibility to<br />

educate us on our rights. As citizens, we have a duty to<br />

know our rights and to speak out in their defense. Politicists<br />

advocate for the fair treatment of all Americans. But<br />

because extensive legal research and education require a<br />

significant amount of time and resources, some services are<br />

only available to members who wish to invest in them for<br />

their benefits.<br />
