“HELL ON earth’.<br />

That is what survivors of<br />

Marylands School told the Royal<br />

Commission of Inquiry into<br />

sexual abuse at the Halswell-based<br />

institution.<br />

Yesterday, the commission<br />

released its interim report, making<br />

48 findings which included:<br />

• Marylands School did not<br />

provide adequate education and<br />

safeguarding of the children sent<br />

there.<br />

• <strong>The</strong> students were abused,<br />

neglected and deprived of their<br />

human rights<br />

• <strong>The</strong> Catholic Church, the<br />

Order and the State have not yet<br />

been found accountable for the<br />

magnitude of the tragedy that<br />

unfolded at Marylands School and<br />

Hebron Trust for failing to address<br />

the tragedy<br />

• <strong>The</strong> (Catholic order) brothers<br />

who inflicted abuse towards the<br />

children sought to actively evade<br />

accountability.<br />

Archbishop Paul Martin said<br />

the Catholic Church “must<br />

continue to confront the difficult<br />

truths of the past, including the<br />

inexcusable abuse and suffering<br />

described in the case study<br />

THE FAMILY of missing real<br />

estate agent Yanfei Bao have<br />

issued a “heartfelt” thank you<br />

to the public, with her husband<br />

urging people to “go home<br />

tonight and tell all those you<br />

hold dear that you love and<br />

cherish them”.<br />

It comes as police resumed<br />

their search of the Halswell River<br />

Lake Te Waihora/Ellesmere<br />

yesterday, two weeks after her<br />

disappearance.<br />

A homicide probe was<br />

launched last Wednesday after<br />

the disturbing disappearance<br />

of the 44-year-old, who was last<br />

seen alive on July 19.<br />

Yesterday, Bao’s family issued<br />

a statement thanking family,<br />

friends and the general public for<br />

the “outpouring of kind words<br />

and unwavering support following<br />

the disappearance of their<br />

beloved wife and mother”.<br />

“<strong>The</strong> love and compassion displayed<br />

by fellow New Zealanders<br />

has been truly humbling, and the<br />

Bao family cannot express how<br />

grateful they are for all the generous<br />

donations made through<br />

‘Givealittle’.”<br />

<strong>The</strong> family also expressed their<br />

“sincere appreciation” to the police<br />

for their “invaluable support<br />

and relentless dedication” in the<br />

search for Bao.<br />

“<strong>The</strong> family urges anyone with<br />

information that could assist the<br />

police in locating Yanfei to come<br />

forward as soon as possible.<br />

“<strong>The</strong>ir only desire is to have<br />

her returned to them, so they can<br />

find closure and begin the grieving<br />

Govt offers teachers 14.5% pay rise<br />

THE GOVERNMENT has<br />

agreed to fund a $4.4 billion<br />

package to settle teachers’ and<br />

principals’ agreements.<br />

An arbitration panel recommended<br />

secondary teachers get<br />

a 14.5 per cent pay rise spread<br />

over three instalments.<br />

Education Minister Jan Tinetti<br />

said the Government offer<br />

would see beginner teachers<br />

receive an annual increase of almost<br />

$10,000, in addition up to<br />

the $7210 lump sum payment.<br />

If accepted by both parties<br />

the recommended settlement is<br />

likely to have knock-on effects<br />

for early childhood and primary<br />

school teachers. Under pay parity<br />

rules, the Ministry of Education<br />

must offer any changes to<br />

teachers’ unified base salary<br />

scale to primary teachers and<br />

then in turn to kindergarten<br />

teachers.<br />

<strong>The</strong> increase would shift<br />

starting pay for most new secondary<br />

teachers from $55,948<br />

to $64,082 by the start of 2025,<br />

while pay rates for teachers at<br />

the top of the scale would increase<br />

from $90,000 to $1<strong>03</strong>,085.<br />

That appeared to be better<br />

than the pay scale recently<br />

agreed by primary teachers<br />

where the equivalent points on<br />

the pay scale would increase to<br />

$63,187 and $100,000.<br />

<strong>The</strong> panel said the term of<br />

the new collective agreement<br />

should be three years, from July<br />

3, 2022, to July 2, 2025.<br />

Bao was last seen about 10am<br />

on Trevor St, Hornby, where<br />

she was due to show a potential<br />

buyer through a home.<br />

<strong>The</strong> 52-year-old man charged<br />

with kidnapping Bao appeared<br />

in court last week.<br />

He had only been living in<br />

Gloriavale’s overseeing<br />

shepherd Howard Temple is<br />

facing 27 charges of sexual<br />

offending over more than 23<br />

years against 10 alleged victims.<br />

Temple faces multiple counts of<br />

committing an indecent act on<br />

a young person and of indecent<br />

assault. <strong>The</strong>re are 10 female<br />

complainants, aged from 9 to<br />

20 at the time of the alleged<br />

offending. Temple was given<br />

interim name suppression when<br />

he was charged in July, but did<br />

not reapply for it during an<br />

appearance in the Greymouth<br />

District Court yesterday. He<br />

pleaded not guilty, elected judge<br />

alone trial and was remanded<br />

on bail to reappear in October.<br />

drinks” were stolen before<br />

the fog cannon scared the<br />

thieves off. Earlier yesterday,<br />

a commercial premises on<br />

Riccarton Rd had its front<br />

A police spokesperson said<br />

some goods were taken in the<br />

burglary. Police have begun<br />

Pedersen bought their property,<br />

lakeside views were not on the<br />

listing.<br />

A month of rain fell across<br />

Canterbury from July 22-23,<br />

forcing the couple to move out<br />

of their Tancreds Rd, Ladbrooks,<br />

property, just south of Halswell,<br />

with their three young children<br />

for the second winter in a row.<br />

“We have been in this property<br />

three years now – this is the second<br />

winter we have had a moat<br />

around our house,” Anna said.<br />

“This year in particular is<br />

worse. It has gone over our septic<br />

tank, we have to move the kids<br />

out and we can’t currently live<br />

where we are.”<br />

Anna said it can take up to<br />

six weeks for their 4ha property<br />

to drain completely. <strong>The</strong>y keep<br />

some animals on the property,<br />

including 12 cattle, sheep, and<br />

pigs. When the flooding hits,<br />

the cattle and sheep have to be<br />

moved.<br />

Said Josh: “All our animals as<br />

well, they are currently at the<br />

neighbour’s place, we can’t feed<br />

and hold them here.”<br />

Anna said they won’t be able to<br />

bring their cattle back for at least<br />

a month to six weeks.<br />

She said if a solution is not<br />

found they may have to sell the<br />

animals.<br />

<strong>The</strong> couple say the water comes<br />

from the Halswell River, which is<br />

2.5km from their property.<br />

Said Anna: “We have a big<br />

drainage system behind us. <strong>The</strong><br />

Halswell River starts increasing<br />

in flow and actually comes up<br />

our drainage system.<br />

“It comes over the banks and<br />

floods our area. <strong>The</strong> rain stopped<br />

on the Sunday and (the water)<br />

kept rising until (Tuesday).”<br />

<strong>The</strong> family blames<br />

Environment Canterbury<br />

which they say is not listening to<br />

their concerns over the flooding.<br />

Said Anna: “We have had some<br />

dealings with ECan on these<br />

issues and they are telling us that<br />

our drainage system is working<br />

correctly. But this is not okay.<br />

“I feel like they are just<br />

expecting us to put our heads in<br />

the sand and go away.”<br />

Aires said the drainage system is<br />

in good condition.<br />

“<strong>The</strong> condition of<br />

Blacklers drain prior to this<br />

rain period could not have been<br />

better.<br />

“Weed-cutting had just<br />

been completed in the<br />

Halswell River, improving<br />

flood-carrying capacity and there<br />

was a relatively low lake level at<br />

Te Waihora/Lake Ellesmere.”<br />

Aires said it was possible<br />

for water to flow back up the<br />

drainage system when the river<br />

was in high flood.<br />

“This property, along with<br />

others, is located in an area<br />

called Blacklers drain/Lethams<br />

swamp,” Aires said.<br />

Aires said it is a low-lying<br />

natural ponding basin, prone to<br />

surface flooding in significant<br />

rain events.<br />

“As ground conditions have<br />

been wet to saturated for some<br />

time, even moderate rainfall<br />

is likely to cause surface water<br />

flooding.”<br />

Aires said there was “no<br />

immediate long-term plan” to<br />

address flooding in the area.<br />

When the Pedersens bought the<br />

property in 2020, they weren’t<br />

aware of the issues but knew the<br />

area was a floodplain.<br />

Said Anna: “We understand<br />

that we live in the lower area, we<br />

understand flooding and surface<br />

flooding, but we are getting a<br />

phenomenal amount of rain<br />

and flooding and it’s not going<br />

away.”<br />

Anna said flooding like this<br />

was expected once every 50<br />

years in the area but “for the<br />

last two out three years we have<br />

flooded”.<br />

Said Josh: “I think the obvious<br />

solution is a one-way floodgate<br />

on the Halswell River to stop the<br />

water coming up the drainage<br />

system,” he said.<br />

“<strong>The</strong> Halswell River is full<br />

but not overflowing so there is<br />

capacity within to handle water.”<br />

<strong>The</strong> Pedersens also found an<br />

ECan storm water discharge<br />

report from 2018, pointing<br />

towards increased development<br />

causing more water drainage<br />

issues in low-lying areas around<br />

the Halswell River.<br />

Said Anna: “ECan knows<br />

about this because we have<br />

found a report online and<br />

it’s saying that all the new<br />

developments in Lincoln,<br />

Halswell, Prebbleton are raising<br />

their levels causing more<br />

flooding.”<br />

<strong>The</strong> report points to<br />

subdivisions having an impact<br />

on drainage systems as the water<br />

flow increases.<br />

But Aires said a Halswell<br />

drainage scheme review was<br />

completed in 2019 after the<br />

report was written. <strong>The</strong> review<br />

investigated drainage and<br />

flooding in the catchment but<br />

put no firm proposals forward<br />

to improve it. <strong>The</strong> review also<br />

showed protecting one area<br />

would displace floodwaters to<br />

other areas.<br />

“To avoid this impact, any<br />

flood protection proposal would<br />

likely require a multimilliondollar<br />

solution. <strong>The</strong> main<br />

strategy for new development<br />

in the catchment is to avoid<br />

building in high-hazard areas,”<br />

Aires said.<br />

Aires said ECan would need<br />

to investigate the merits of a<br />

floodgate. He said the Halswell<br />

drainage network remains very<br />

sensitive to additional flow.<br />

“New urban developments<br />

have to put in a high degree of<br />

attenuation for stormwater to<br />

avoid increasing flood flows,<br />

either as part of a consented<br />

stormwater management plan.”<br />

‘Hell on Earth’: Report finds Catholic<br />

TWO DAYS after his arrival at<br />

Marylands School, a young boy<br />

was taken to the church and<br />

forced to perform sexual acts on<br />

two brothers entrusted to care for<br />

him.<br />

<strong>The</strong>y pulled out a bible and told<br />

the boy “This is what God means<br />

by love”.<br />

A week later he was taken back<br />

to the church and raped on the<br />

marble altar.<br />

This is one of countless cases of<br />

horrific historical abuse against<br />

young boys at the Christchurch<br />

school which has been referred<br />

to by survivors during the Royal<br />

Commission of Inquiry as “hell<br />

on earth”.<br />

In an interim report released<br />

yesterday, the inquiry has made<br />

48 findings. <strong>The</strong>y include:<br />

Marylands School did not<br />

provide adequate education and<br />

safeguarding of the children<br />

sent there. <strong>The</strong> students were<br />

abused, neglected and deprived<br />

of their human rights. <strong>The</strong><br />

brothers who inflicted abuse<br />

towards the children sought to<br />

actively evade accountability. <strong>The</strong><br />

Catholic Church, the Order and<br />

the State have not yet been found<br />

Marylands School and Hebron<br />

Trust for failing to address the<br />

tragedy.<br />

As part of its investigation into<br />

abuse in the care of the Catholic<br />

Church, the commission undertook<br />

a case study, including a<br />

public hearing, into abuse in the<br />

care of the Order of St John of<br />

God.<br />

<strong>The</strong> Hospitaller Brothers of St<br />

John of God (Order of St John of<br />

God) is a religious order of the<br />

Catholic Church whose members<br />

cared for children and young<br />

people in Christchurch from the<br />

early 1950s onwards.<br />

Marylands School and the<br />

Hebron Trust were established in<br />

Christchurch in 1955 and 1984 by<br />

the Order of St John of God.<br />

Up until the late 1980s<br />

successive governments deemed<br />

it appropriate to place disabled<br />

children and young people in the<br />

facilities to be trained. Marylands<br />

was designed for boys, as young<br />

as six, who had disabilities<br />

or learning and behavioural<br />

problems to support and educate<br />

them.<br />

Five brothers were sent from<br />

Australia to staff the school,<br />

most were untrained as teachers<br />

without specialist skills to<br />

educate disabled children.<br />

Within the first year of the<br />

school’s operation, all five<br />

brothers had been accused of<br />

abusing the children.<br />

<strong>The</strong> brothers routinely raped,<br />

sexually assaulted and beat the<br />

boys. <strong>The</strong> children were forced<br />

to perform sexual acts on the<br />

brothers, sometimes more than<br />

one at a time, as well as other<br />

boys.<br />

One survivor was made to<br />

have sex with a younger boy. A<br />

brother then told the boy that<br />

he was “like him”, an abuser,<br />

and he would get in trouble if he<br />

disclosed the abuse.<br />

Sometimes the abuse would<br />

happen behind closed doors,<br />

other times in plain sight of<br />

everyone as a punishment.<br />

Abuse was so normalised, the<br />

boys started sexually abusing<br />

each other.<br />

Some brothers held negative<br />

racist attitudes toward Māori<br />

students, often calling them<br />

“n******”.<br />

A boy known to have been<br />

abused by one brother became<br />

“easier prey” for another brother.<br />

One boy who had an<br />

intellectual disability was sent to<br />

Marylands when he was 10 years<br />

old. He spent three days in school<br />

and then was put in the kitchen,<br />

made to wash dishes for the next<br />

four years.<br />

He recalled being separated<br />

from the other boys, unable to<br />

play with or eat meals with them.<br />

He was sexually assaulted while<br />

in the swimming pool by himself<br />

by one of the brothers.<br />

On one occasion he was made<br />

to gas puppies to death with a<br />

brother. He was then instructed<br />

to take the dead puppies to the<br />

dump.<br />

Another Marylands survivor<br />

spoke about being gathered into a<br />

room with a group of other boys<br />

and forced to perform oral sex<br />

on one of the brothers. When he<br />

tried to pull away he was hit with<br />

a baseball bat so hard his nose<br />

bled.<br />

He described the brothers<br />

getting angry while they were<br />

abusing him as he often wouldn’t<br />

hold still but he soon “adapted’ to<br />

the abuse.<br />

He was taken to the hospital<br />

morgue on one occasion and<br />

forced to see a dead body as a<br />

scare tactic by the brothers.<br />

<strong>The</strong> boy told multiple teachers,<br />

social workers and even police<br />

when he was caught running<br />

away but no one believed him.<br />

Church failed to act on horrific abuse<br />

His teenage years were<br />

horrible, and it wasn’t until he<br />

went to prison that he learned<br />

to read and write and by the<br />

time he was 25 he was a patched<br />

member of a gang.<br />

“It is sad to say that the only<br />

sense of belonging and support<br />

I ever felt was being part of a<br />

gang.”<br />

Another survivor recalled a<br />

boy being forced to strip naked<br />

outside in front of others and<br />

was sexually assaulted as punishment.<br />

After the Order left Marylands<br />

in 1984 the Bishop of Christchurch<br />

invited brothers to establish<br />

a youth ministry to support<br />

at-risk people, often “street kids”,<br />

many of whom were Māori.<br />

Despite the allegations of his<br />

abuse at Marylands, Brother<br />

Bernard McGrath, one of the Order’s<br />

most prolific serial rapists,<br />

was appointed the sole brother<br />

of the ministry, named Hebron<br />

Trust.<br />

From there his “reign of terror”<br />

only escalated.<br />

Boys as young as eight went to<br />

Hebron, although it was mostly<br />

aimed at teenagers who were<br />

homeless, referred by social service<br />

agencies or by the criminal<br />

and youth justice system.<br />

About three-quarters of survivors<br />

turned to drugs or alcohol<br />

as a way of coping with the abuse<br />

they endured. Many had contemplated<br />

or attempted suicide,<br />

others had died this way.<br />

One survivor began getting<br />

in trouble with the police in his<br />

early teens but instead of being<br />

dealt with by the court, he was<br />

sent to McGrath’s house to do<br />

community work such as gardening<br />

and chores.<br />

He said McGrath routinely<br />

sexually assaulted him in his<br />

office. On one occasion when he<br />

raped the boy, he said he “was<br />

in with the police” and no one<br />

would believe him if he spoke up<br />

about the abuse.<br />

the deaths of other boys.<br />

Another survivor described<br />

a brother rushing at one boy<br />

who had trouble understanding<br />

things. He said the brother<br />

pushed the boy over and he<br />

smacked his head on the concrete<br />

and began bleeding heavily.<br />

He was then taken to the medical<br />

room, never to be seen again.<br />

“<strong>The</strong> way he was just hit I<br />

knew he wouldn’t make it. He<br />

was helpless.”<br />

One survivor spoke of a<br />

brother who pushed a boy into<br />

the pool and sank to the bottom.<br />

Soon after a funeral was held for<br />

the boy.<br />

Police said they “have not<br />

located any records of death of<br />

children while at Marylands”<br />

and do not “hold any information<br />

about the circumstances of<br />

these deaths”.<br />

• McGrath was extradited to<br />

Australia in 2014 to face more<br />

than 250 charges, and is serving<br />

33 years jail for abusing 30 boys<br />

at Kendall Grange in New South<br />

Wales.<br />

A BROUGHT-forward auction delivered<br />

a Halswell couple a “life-changing” result<br />

after their home sold for $70,000 more<br />

than what they had already agreed to sell<br />

it for.<br />

While more properties were passed in<br />

than those that were sold at some of the<br />

city’s auction rooms last week, most of the<br />

brought-forward auctions not only sold,<br />

but also netted their owners the equivalent<br />

of some people’s annual salaries as<br />

competition for limited stock ramps up.<br />

<strong>The</strong> auction for a modern four-bedroom,<br />

two-bathroom home on Whitnall St,<br />

Halswell, opened and was announced on<br />

the market at $940,000 before five bidders<br />

pushed it up to $1.01 million in Harcourts<br />

Gold’s auction room last Thursday.<br />

<strong>The</strong>re were 50 groups through the<br />

Whitnall St property in the first week of<br />

open homes and about six pre-auction<br />

offers were made, which Harcourts Gold<br />

auctioneer Mark Morrison said was almost<br />

unheard of.<br />

He said brought-forward auctions where<br />

the properties sell for more than what the<br />

owners have already agreed to sell for can<br />

be life-changing.<br />

“It can be hugely life-altering. I don’t<br />

know about you, but if you thought you<br />

were going to have $940,000 and then<br />

10 minutes later you have got another<br />

$70,000.”<br />

<strong>The</strong> Whitnall St owners had already<br />

made an offer on another house so having<br />

an extra $70,000 made the equation much<br />

more comfortable for them, he said.<br />

an opportunity to voice their<br />

concerns about the upcoming<br />

cruise ship season and the<br />

impact it may have on the<br />

deprived areas have a higher<br />

prevalence of people living with<br />

obesity. We are hoping we can<br />

use this evidence to advocate for<br />

healthier food environments,”<br />

“A global rise in obesity since<br />

1980 is too rapid for genetic or<br />

biological factors to be the root<br />

cause. While individual risk factors<br />

such as genetic makeup explain<br />

some differences between<br />

individuals, it was reasonable to<br />

suggest the rise in obesity seems<br />

to be fuelled by the coincidental<br />

increased supply of cheap, palatable,<br />

energy-dense foods that are<br />

accessible, convenient, and effectively<br />

marketed,” Hobbs said.<br />

<strong>The</strong> CHDS is a birth cohort<br />

study using a group of people<br />

born in 1977, with data collected<br />

until they turned 40 in 2017.<br />

“Living with obesity is known<br />

to lessen life expectancy markedly<br />

and what happens during<br />

early- to mid-adulthood has<br />

profound and long-lasting implications<br />

for future health. We<br />

looked at details about each person’s<br />

change in BMI and waist<br />

circumference from age 30 to<br />

age 40 years. We wanted to know<br />

how a change in people’s ‘food<br />

Robertson opens up<br />

– and says goodbye<br />

A DEPARTING Scott Robertson<br />

has opened up on his career<br />

as Crusaders coach in his final<br />

interview before taking on the<br />

All Blacks role in November.<br />

Robertson won seven Super<br />

Rugby titles as coach and four as<br />

a player. He takes over from Ian<br />

Foster as All Blacks coach after<br />

the Rugby World Cup. In a video<br />

posted by the Crusaders, an<br />

emotional Robertson looks back<br />

on his time with the franchise<br />

and how much it has meant to<br />

him.<br />

“To give back to a jersey that<br />

has given me so much . . . it’s<br />

special that I can walk away and<br />

go ‘thanks for everything, I’m<br />

a better man for it. And thank<br />

you’,” he said in the video.<br />

Robertson also got emotional<br />

while reflecting on his final game<br />

in Christchurch – the 52-15 semifinal<br />

thrashing of the Blues. He<br />

admitted being nervous about<br />

the potential of ending his stint<br />

with a semi-final defeat and went<br />

onto the ground and revved up<br />

the home crowd before the game.<br />

“Probably that moment was<br />

my last time at Orangetheory, at<br />

the home ground . . . I just felt we<br />

needed it. I just thought it was<br />

going to be a special moment. A<br />

chance to bring us all together.<br />

It was a chance to get our people<br />

on our feet but also a thank<br />

you from me. To say ‘let’s enjoy<br />

this – this is our moment. Stay<br />

here now, we’re on’. And the<br />

performance probably reflected<br />

that,” he says.<br />

“I was pretty nervous too. I<br />

thought we needed the crowd<br />

that night. It was the end of a<br />

career, if you end on a semifinal<br />

at home, at a place you’ve never<br />

lost in a final ... I thought we’re<br />

all in. It was a pretty special<br />

moment.”<br />

Leslie Park, at 2.45pm in what<br />

will be their fourth encounter<br />

this season. Hornby emerged<br />

victorious in the last two 42-28<br />

But Robinson had a unique<br />

problem earlier this season –<br />

Marist were winning games<br />

by large margins but not<br />

performing to the standard they<br />

could.<br />

“After the Old Boys round<br />

robin game which we won 46-<br />

28, it was frustrating as we felt<br />

we could’ve been scoring more<br />

points than we were,” he said.<br />

“We were brave enough to<br />

want to push our team further.”<br />

This included a number of<br />

“tough” conversations with<br />

players, which Robinson felt the<br />

coaching staff could do because<br />

they knew each other so well.<br />

<strong>The</strong>ir trainings during the<br />

season were physical, with all but<br />

one on the field.<br />

Robinson said the team now<br />

has a “special” cohesion.<br />

“We’ve had continuity in our<br />

coaching team and looking at<br />

the team list, probably nine or 10<br />

players who have played in four<br />

finals now.<br />

“I can’t overstate how important<br />

team cohesion is in the<br />

game.”<br />

On Sunday, the team’s connections<br />

were on full display.<br />

Although HSOB were patient<br />

in possession, Marist’s slick<br />

backline stood out.<br />

Despite a few ball-handling errors,<br />

Robinson believed the win<br />

was down to their experienced<br />

players stepping up in the big<br />

moments.<br />

But when the score was locked<br />

at 21-21 with 20 minutes to go,<br />

Robinson admits he had trouble<br />

staying calm: “All you can do is<br />

breathe – and it’s hard.”<br />

match to narrow Marist’s winning<br />

margin.<br />

HSOB captain Alex Grogan<br />

said he was proud of his team’s<br />

“hell of a season” after many<br />

wrote them off.<br />

“We’ll come back better next<br />

year,” he said.<br />

After going down to Sydenham<br />

in the final last year, Marist<br />

captain Elliot Smith said he<br />

knew how HSOB were feeling<br />

after the match.<br />

“You’ve been on an awesome<br />

run,” he told them.<br />

“It’s been a very tight competition<br />

– and anyone from one to<br />

nine could’ve taken it.<br />

“But to my boys – hell of a<br />

shift. We really ground it out and<br />

swung momentum to us there at<br />

the end.”<br />

Marist’s celebrations may<br />

continue for the next few weeks,<br />

but Robinson is already eyeing<br />

next year.<br />

“We don’t want to push it too<br />

soon, but we want to make it five<br />

(finals) in a row.”<br />

CBHS chase 12th<br />

CHRISTCHURCH Boys’ High<br />

will look to add to their 11 Miles<br />

Toyota Premiership titles when<br />

they meet Nelson College in the<br />

final on Saturday.<br />

Despite their dominance in<br />

the competition, CBHS have not<br />

won the title since 2018 when<br />

they beat Christ’s College after<br />

the game finished 18-18 but<br />

CBHS had scored more tries.<br />

CBHS and Nelson last clashed<br />

in May, when Nelson won 14-10<br />

in trying conditions at Straven<br />

Rd.<br />

CBHS progressed to the final<br />

with a 27-17 win over St Thomas<br />

of Canterbury College last<br />

weekend. Loosehead prop Sam<br />

Giltrap was first to crash over<br />

the tryline for CBHS before St<br />

Thomas’ crossed for an equaliser<br />

minutes later. Two quick CBHS<br />

tries saw the home side extend<br />

their lead to 12-5 before Ollie<br />

Singleton touched down for their<br />

fourth.<br />

St Thomas’ dominated the play<br />

either side of halftime, and were<br />

able to draw even with CBHS 17-<br />

17 just minutes into the second<br />

half.<br />

But the remainder of the<br />

match belonged to CBHS. Tries<br />

to hooker Manumaua Letiu and<br />

No 8 James Moore pushed their<br />

lead out to 27-17, which they held<br />

onto for the win.<br />

In the other semi-final, a<br />

strong second half saw Nelson<br />

hold off a persistent St Bede’s<br />

College side. Although they led<br />

19-17 shortly after halftime, St<br />

Bede’s were unable to avenge<br />

last year’s final loss, with Nelson<br />

scoring two more tries to secure<br />

a 31-19 win.<br />

Nelson have featured in four<br />

finals in the last five years. <strong>The</strong>y<br />

last met CBHS in the final in<br />

2019 which they won 35-31.<br />

Nelson haven’t lost a game this<br />

season and will be the favourites<br />

on Saturday. <strong>The</strong> match kicks off<br />

to deliver the core services that<br />

keep Christchurch and Banks<br />

Peninsula ticking,” says city<br />

council chief executive Dawn<br />

Baxendale.<br />

“Everyone in the city has<br />

different priorities, and this<br />

exercise will help us see where<br />

each of our core services rank<br />

in the discussion, as we prepare<br />

to allocate our resources for the<br />

next 10 years.”<br />

“My Go-to After Exercise” Judy Bailey Recollects...<br />

Bailey found herself wrestling<br />

Challenging Wills – the<br />

Family Protection Act<br />

Family relationships have become<br />

more complex over the years. As a result<br />

challenges to Wills have also become<br />

more common. One way of challenging<br />

a Will is under the Family Protection Act<br />

1955. A spouse, de facto partner, child<br />

or grandchild of a deceased person is<br />

entitled to claim provision from an estate<br />

if adequate provision has not been made<br />

for their proper maintenance and support.<br />

<strong>The</strong> Courts often refer to this as a failure of<br />

“a moral duty” on the part of the deceased<br />

person. In rare circumstances, where a<br />

stepchild or parent was being financially<br />

supported by the deceased person they can<br />

also make a claim.<br />

Claims are often made by adult children.<br />

A breach of moral duty is judged by the<br />

standards of a wise and just deceased<br />

at the time of his or her passing. <strong>The</strong><br />

Courts adopt a broad approach and each<br />

case is decided on its own particular<br />

facts. Financial need and the health of<br />

the child making the claim are often the<br />

most important factors. However even if<br />

an adult child is in good health and in a<br />

good financial position they may still have<br />

a valid claim. <strong>The</strong> Courts point out that<br />

a child’s path through life is recognised<br />

in a Will not only through financial<br />

provision to meet financial needs but also<br />

to recognise a child as belonging to the<br />

family and of having been an important<br />

part in the overall life of the deceased<br />

person.<br />

<strong>The</strong>re are other factors which a Court<br />

will consider. <strong>The</strong> relationship which the<br />

child had with the deceased person will<br />

always be important. However the fact that<br />

a child was estranged from their deceased<br />

parent does not disqualify a child from<br />

making a claim. Sometimes the Court will<br />

find that it was up to the parent to be the<br />

“bigger person” and mend the relationship.<br />

Grandchildren are not usually<br />

considered by the Court as requiring<br />

an award unless there are special<br />

circumstances such as their own parent<br />

dying before the deceased grandparent.<br />

<strong>The</strong> Court is not restricted to particular<br />

considerations and must be aware of<br />

changing social attitudes over time. Due to<br />

the infinite variety of fact situations there<br />

can be no firm benchmark percentages for<br />

claims by surviving children. Where there<br />

is a large estate the Court is more likely<br />

to make a larger award. However where a<br />

child is well off and in good health awards<br />

are typically modest.<br />

A person making a Will may wish to<br />

consider persons beyond family members.<br />

Bearing in mind that a Will is often the<br />

last message that a person will give to<br />

their loved ones careful consideration is<br />

required particularly if children are to be<br />

treated unequally. Written reasons often<br />

help in this regard.<br />

<strong>The</strong>re are other ways in which spouses,<br />

children and non-family members can<br />

challenge wills. As family relationships<br />

become more complex Wills need to be<br />

drafted to deal with those complexities.<br />

A carefully crafted Will by a lawyer can<br />

minimise the risks of a later challenge.<br />

Six Extinctions<br />

Canterbury Museum will open its pop-up<br />

museum at CoCA on Matariki with a free<br />

temporary exhibition – Six Extinctions,<br />

featuring a 13-metre T-rex skeleton –<br />

alongside displays of collection highlights<br />

and visitor favourites.<br />

Visitors to Six Extinctions will come<br />

face to face with some of the top predators<br />

of each geological period including<br />

Dunkleosteus, a giant armoured fish that<br />

terrorised the seas and Inostrancevia, a<br />

tiger-sized sabre-toothed beast.<br />

From there they will explore the five mass<br />

extinction events in the Earth’s history, and<br />

the sixth and current extinction crisis –<br />

climate change – which is the first caused by<br />

a single species, humans.<br />

Joint issues will affect most of us at some time.<br />

is constantly worn away and needs to be rebuilt<br />

constantly. This repair process slows down for most<br />

smooth. This is the most common form of arthritis,<br />

called osteoarthritis, and it leads to inflammation,<br />

pain, stiffness and reduced joint mobility.<br />

Joint pain can also be a factor in falls. Generally,<br />

joints with the most use or stress show problems<br />

first.<br />

Many people seek pain relief from their doctor.<br />

<strong>The</strong> usual prescription is non-steroidal antiinflammatory<br />

drugs, or NSAIDs, which offer pain<br />

relief but do nothing to stop the progression of<br />

arthritis.<br />

According to the British Journal of General<br />

Practice, NSAIDs are not recommended for longterm<br />

use and are responsible for 30% of hospital<br />

admissions, mainly due to internal bleeding, heart<br />

attack, stroke and renal damage. Research shows<br />

that all NSAIDs double the risk of hospitalization<br />

due to heart failure.<br />

IF THE weather seems to promise an early<br />

spring, it is tempting to rush into seed<br />

sowing, but a cautious approach will pay<br />

off later, with fewer plant losses.<br />

Vegetables<br />

In warm corners, in the greenhouse<br />

or under glass, a few seeds of cabbages,<br />

cauliflower and brussels sprouts can be<br />

sown. Bolder gardeners may also want to<br />

try their luck with lettuce, spinach and<br />

carrots, but the weather will determine<br />

success.<br />

Brussels sprouts should have priority in<br />

terms of seed sowing, as they require the<br />

longest growing season of the brassicas,<br />

which include cabbage and cauliflower.<br />

Sprouts will take two to three months<br />

from sowing to transplanting into the<br />

garden where they are to mature. Plants<br />

will grow to 1m or more and may need<br />

soil mounded firmly around their bases to<br />

hold them in the ground.<br />

<strong>The</strong> earliest potatoes may be planted<br />

now, but will need protection from frost<br />

when shoots come through.<br />

Covering plants with frost cloth, or pea<br />

straw piled loosely over the rows and held<br />

in place with netting, are alternatives to<br />

using newspaper when frost looks likely.<br />

Rhubarb, jerusalem artichokes and<br />

asparagus can be planted now. <strong>The</strong> site<br />

for jerusalem artichokes should be chosen<br />

with care; these tough relatives of the<br />

sunflower can be invasive.<br />

With no sign of growth in the lawn,<br />

have your mower serviced and blades<br />

sharpened now. Check garden tools and<br />

sharpen secateurs, loppers and spades.<br />

Always clean garden tools after use and<br />

wipe blades of secateurs and loppers.<br />

Flowers<br />

Although sowing may be weeks or even<br />

months away, do not delay buying seed, as<br />

popular varieties are the first to go. Store<br />

seed in airtight containers in a cool place.<br />

Delphiniums are among the easiest<br />

perennials to grow from seed. Pacific<br />

Giants and Shogun will grow to 1m or<br />

more, while Delphinium grandiflorum will<br />

reach just 30cm.<br />

Delphiniums come in shades of blue,<br />

pinks and mauves, as well as white.<br />

Generally, they come into their own a<br />

year after planting out. Seed needs warm<br />

conditions (18 deg C to 20 deg C) to<br />

germinate, so do not rush to sow it.<br />

If the weather is fine and the soil<br />

not waterlogged, michaelmas daisies,<br />

penstemons and phlox can be broken up<br />

then replanted in well-composted soil to<br />

give better flowers over the next two or<br />

three seasons. If slugs and snails attack<br />

young shoots, protect by surrounding the<br />

plants with dry sawdust.<br />

To divide these hardy perennials, lift the<br />

clumps with a fork, then use a sharp spade<br />

to slice through the plant.<br />

Cleaning flower pots is a tedious task but<br />

worth the effort to prevent the possibility<br />

of disease. Scrub pots then dunk them in<br />

boiling water.<br />

When selecting a building site weigh up your lifestyle, family<br />

needs and aspirations before signing up for any section.<br />

Those purchasing early on in the<br />

development of a subdivision will<br />

have more choice of section size and<br />

orientation to the street and sun. As<br />

the individual sites are sold, there may<br />

be less availability though this need<br />

not be a deterrent. With good design<br />

any building site can be made to work.<br />

<strong>The</strong> size of the house and amount<br />

of yard desired will influence the<br />

feasibility of some building sites as<br />

will sun and wind direction, bearing<br />

in mind that a house can be designed<br />

is north/north west, incorporating<br />

fenced or planted courtyards can offer<br />

private places to entertain and bask in<br />

He remembers desperate<br />

Chinese, trying to capture Hook<br />

valley territory before the July<br />

ceasefire was called.<br />

During this time repairs<br />

were needed on the telephone<br />

lines. <strong>The</strong> Chinese were repelled<br />

by United Nations forces, he<br />

said.<br />

On one frontline occasion, a<br />

shell exploded about 40 yards<br />

(36.5 metres) away. But it could<br />

have easily been much, much<br />

closer.<br />
