Bench“Since the affairs of the Sikh minorityin the state are to be managed by the Sikhsalone, it cannot be said to be violative of anyof the fundamental rights conferred under Articles25 and 26 of the Constitution,” said aBench led by Justice Hemant Gupta, dismissingtwo petitions filed eight years ago seekingquashing of the Haryana Sikh Gurdwara Act,2014.The Bench, which also included JusticeVikram Nath, noted that the Haryana Actwas similar to the Sikh Gurdwaras Act, 1925,having similar provisions of constituting a committeeto manage gurdwara affairs under Section3 of the Haryana Act. “The gurdwara propertyin terms of Section 2(f) of the HaryanaAct means all movable and immovable propertiesof a gurdwara or any institution which,immediately before the appointed day, vestedor was kept in deposit in the name of anyboard, trust, committee, gurdwara managementor was being regulated under the provisionsof the 1925 Act. The members of thecommittee have to be elected from the eligiblevoters who are Amritdhari Sikh... The co-optionis from the members of the communityalone,” the Bench said.“The 2014 Act also provides for theHaryana Sikh Gurdwara Judicial Commissionin the same manner as is provided under the1925 Act. The affairs of the gurdwara are againrequired to be managed by the local gurdwaracommittee,” it pointed out. There were two petitionsagainst the Haryana Act – first byHarbhajan Singh – an elected SGPC representativefrom Kurukshetra and the second oneby the SGPC.The petitioners contended that underSection 72 of the Punjab Reorganisation Act,1966, the power to make laws in respect ofthe SGPC as an inter-state body corporate hadbeen reserved with the Central Government onlyand there was no provision in law for any bifurcationby enacting a state legislation.Terming it a hasty enactment, the petitionershad submitted that it’s not only againstthe provisions of the Punjab Reorganisation Act,but was also divisive in its intention to createdissension among the followers of the Sikh religion.The Centre had contended that onlyParliament had the exclusive power to enactlaw on the subject. “There is no justificationfor the Haryana State Legislature to havepassed a law on the same subject matter,taking away the jurisdiction of the board constitutedunder the 1925 Act.”The top court,however, dismissed the petitions, saying theHaryana Assembly had the legislative competenceto enact the law in question.“The SGPC became inter-state bodycorporate not because of Entry 44 List I (UnionList under Seventh Schedule) but becauseof reorganisation of the territories of the erstwhilestate of Punjab. Therefore, Entry 44would have no applicability in respect of legislativecompetence of the state of Haryanato enact the Haryana Act,” the top court said.Holding that incorporation of a statutorybody fell in Entry 32 of List II (State Listunder Seventh Schedule), as also unincorporatedreligious and other societies,” the topcourt concluded that the Haryana Act waswithin the legislative competence of the state.
