Supreme Court upholds Haryana Sikh Gurdwara (Management) Act Separate
committee was formed under the Act to manage affairs of gurdwaras in state
New Delhi, (ATB) The Supreme Court
upheld the validity of the Haryana Sikh
Gurdwara (Management) Act, 2014, under
which a separate committee was formed to
manage the affairs of gurdwaras in the state.
Since the affairs of the Sikh minority
in the state are to be managed by the Sikhs
alone, the Act cannot be said to be violative of
any of the fundamental rights conferred under
Articles 25 and 26 of the Constitution. Bench
“Since the affairs of the Sikh minority

25 and 26 of the Constitution,” said a
Bench led by Justice Hemant Gupta, dismissing
two petitions filed eight years ago seeking
quashing of the Haryana Sikh Gurdwara Act,
2014.
The Bench, which also included Justice
Vikram Nath, noted that the Haryana Act
was similar to the Sikh Gurdwaras Act, 1925,
having similar provisions of constituting a committee
to manage gurdwara affairs under Section
3 of the Haryana Act. “The gurdwara property
in terms of Section 2(f) of the Haryana
Act means all movable and immovable properties
of a gurdwara or any institution which,
immediately before the appointed day, vested
or was kept in deposit in the name of any
board, trust, committee, gurdwara management
or was being regulated under the provisions
of the 1925 Act. The members of the
committee have to be elected from the eligible
voters who are Amritdhari Sikh... The co-option
is from the members of the community
alone,” the Bench said.
“The 2014 Act also provides for the
Haryana Sikh Gurdwara Judicial Commission
in the same manner as is provided under the
1925 Act. The affairs of the gurdwara are again
required to be managed by the local gurdwara
committee,” it pointed out. There were two petitions
against the Haryana Act – first by
Harbhajan Singh – an elected SGPC representative
from Kurukshetra and the second one
by the SGPC.
The petitioners contended that under
Section 72 of the Punjab Reorganisation Act,
1966, the power to make laws in respect of
the SGPC as an inter-state body corporate had
been reserved with the Central Government only
and there was no provision in law for any bifurcation
by enacting a state legislation.
Terming it a hasty enactment, the petitioners
had submitted that it’s not only against
the provisions of the Punjab Reorganisation Act,
but was also divisive in its intention to create
dissension among the followers of the Sikh religion.
The Centre had contended that only
Parliament had the exclusive power to enact
law on the subject. “There is no justification
for the Haryana State Legislature to have
passed a law on the same subject matter,
taking away the jurisdiction of the board constituted
under the 1925 Act.”The top court,
however, dismissed the petitions, saying the
Haryana Assembly had the legislative competence
to enact the law in question.
“The SGPC became inter-state body
corporate not because of Entry 44 List I (Union
List under Seventh Schedule) but because
of reorganisation of the territories of the erstwhile
state of Punjab. Therefore, Entry 44
would have no applicability in respect of legislative
competence of the state of Haryana
to enact the Haryana Act,” the top court said.
Holding that incorporation of a statutory
body fell in Entry 32 of List II (State List
under Seventh Schedule), as also unincorporated
religious and other societies,” the top
court concluded that the Haryana Act was
within the legislative competence of the state.

My parents were both born in Punjab, India.
My father was born in villageRatainda, District
Shaheed Bhagat Singh Nagar and my mother
was born in a village called Thanowali, District
Jalandhar, Punjab, India.
Your Early Education
I attended Stanley Jones Elementary, followed
by Colonel Macleod Junior High in Renfrew. I
continued my education at Crescent Heights
High School, completing an Advanced High
School Diploma. After high school, I attended
university and graduated from University of
Calgary with a Bachelor of Arts degree in
Economics.
When & Why You came to Canada
My parents immigrated from the United
Kingdom in the early 1960s, and I was born in
Calgary. They felt Canada could providebetter
opportunities for their children, and they
wanted to be closer to their family.
Your career advancement initiatives,
volunteer work and present occupation
Throughout my youth, I volunteered with
senior centres, nursing homes, and hospitals.
Over the past several years, I have volunteered
as a coach forU12, U10, and U8 soccer teams.
I am also the director and one of the founding
members of the Punjabi Athletic Group. In
2016, I was a member of the Provincial Gold
medalist Calgary Phantoms at the Provincial
Ball Hockey Championships, and Master’s
National Gold medalists with Team Alberta.
After university I worked as a Financial Advisor
with the Canadian Imperial Bank of Commerce
at the Falconridge Branch. In 2002, I entered
the Real Estate and Development Industry. I
remain a member of several professional
associations including the Calgary Real Estate
Board (CREB), Urban Land Institute (ULI), and
Certified Commercial Investment
Management Institute (CCIM).
While working full time, I continued my
education in the faculty of Environmental
Design Planning program at the University of
Calgaryin 2003. I was then awarded a grant
from the City of Calgary to conduct research
on ethnic diversity and affordable housing. I
expanded on the research and in the fall of
2006 presented my thesis on Planning for
Ethnic Diversity. In November 2006, I
graduated with a Master’s degree in
Environmental Design (Planning). In 2017, I
was elected City Councilor for Ward 5 in the
Northeast. Presently, I am Memberof
Parliament from Calgary-Skyview riding.
Your Regret in Life
I regret not taking advantage of travel
opportunities as a student.
Pick Any One of Your Best Achievements
Professional – Being elected as a Councillor and
subsequently as member of Parliament.
Personal – getting married having kids and
finishing masters and working full time all in
the same year.
Were You Ever Discriminated?
Yes. From a young age to the present day, I
have been subjected to racial slurs.
Are You Happy in Canada?
Yes. I have been blessed with many
opportunities in Canada. I entered politics to
serve and help improve our City and Country to
the best of my abilities.
Any Comments on Canada’s Culture
This is a country where people from around the
world can live freely as Canadians,while
retaining their ethno-cultural origins and
communities.
Any Comments on Canada’s Weather
I lovethe winters because I like to ski and play
ice hockey. In Calgary, we get to see four distinct
seasons, sometimes all in a single day!
What Brought You Success in Canada?
My parents always provided the conditions for
me to succeed, including a stable home life,
emotional support, healthy meals, and so much
more. Growing up in Calgary also offered
manyopportunities to learn, contribute and
achieve my goals in school, sports, and work.
Are You Willing to Help New Immigrants and
How?
It is a priority of mine. I did my Master’s thesis
on planning for ethnic diversity. I have brought
forward Notices of Motions to City Council,such
as the Multilingual Communications and
Engagement,to help support the integration
of new immigrants in Calgary and Canada. I
will continue to advocate for
furtheropportunities and supports for new
immigrants.

PM’s homily to Putin
PM Narendra Modi caused a
stir last week when he publicly expressed
his concerns over the Ukraine
conflict. With Russian President
Vladimir Putin seated beside him in
Samarkand, the PM said he knew that
today’s era was not of war and flagged
the problems of food and fuel security,
and the fertiliser shortage confronting
developing countries. The PM’s concerns
over the impact of the Covid pandemic
and the Ukraine conflict are legitimate.
At the same time, his subsequent
observations hardly suggest that
India wants to distance itself from Russia.
For, the PM also said that India
‘valued this relationship’ and ‘the world
also knows that it is an unbreakable
friendship’. It was in sync with his September
7 speech advocating stronger
ties with the Russian Far East and the
Arctic.
There have been other straws
in the wind. After abstaining earlier,
India surprisingly voted against Russia
in the last UNSC meeting on
Ukraine. India has also twice spoken
on the Bucha massacres, uncovered
in April after the Ukrainian forces had
wrested a Russian town. India will be
compelled to take a similar stance
when the UN will inevitably take up the
issue of mass civilian graves in Izyum,
a town recently taken by the Ukrainians.
After the Russian retreat in
Kharkiv and Chinese President Xi
Jinping’s ambiguous stance at
Samarkand, the optics don’t look
good for the Kremlin.
But for New Delhi, there has
been no looking back on Indo-Russian
trade. In the strategic domain, Russia
continues to build Kudankulam nuclear
power plant’s units; S-400 missile defence
system supplies have continued.
India is also acutely aware of the
continuing need of Russia as an allweather
friend despite its own growing
strategic closeness with the US.
Washington’s policies for the region
have vacillated and recently, it resumed
its dalliance with Pakistan. Notwithstanding
the sabre-rattling, its
trade with China has risen. PM Modi’s
‘no war’ remark may have tickled the
vanity of some players in the West, but
toxicity is unlikely to colour India’s viewing
of Russia in this unsettled global
milieu.
