Smith is wrong about the constitution

Edmonton(ATB); UCP

leadership candidate

Danielle Smith’s

promised Alberta

sovereignty act has

“ d u b i o u s

constitutionality,” law

experts say.

This week, Smith

released an overview of

the proposed act,

which she says would

be used to defend the

province from “Ottawa’s

continuous economic

and constitutional

attacks.”

further delay,” Smith

“The majority of said in a news

Albertans are frustrated

with the ineffective

release.

“Tens of thousands of

letter writing Albertans have

campaigns and empty embraced the idea of

rhetoric employed by the Alberta

past premiers in Sovereignty Act, and

dealing with attacks on

Alberta by our federal

government, and want

many more are open

to learning more about

how it could be

effective action to deal practically and

with the ‘Ottawa effectively deployed.”

Problem’ without According to the

overview, the act would

affirm the authority of

the legislature to refuse

provincial enforcement

of specific federal laws

or policies “that violate

the jurisdictional rights

of Alberta” under the

Constitution of Canada

or Charter of Rights and

Freedoms.

The act’s objective is

not to separate from

Canada but to assert

Alberta’s constitutional

rights “to the furthest

extent possible by

effectively governing

itself as a nation within

a nation.”

University of Alberta

professor and

constitutional law

expert Eric Adams has

concerns with the

proposed legislation.

“I think the concept in

and of itself, is of

d u b i o u s

constitutionality,” said

Adam”It’s all well and

fine for Ms. Smith to

declare that it is

constitutional, but any

time you have one level

of government claiming

that it has the power to

refuse the lawful

enactments of another

level of government or

to be the institution in

charge of determining

what’s constitutional or

not, then you raise a

number

of

constitutional problems

that the details

probably can’t save.”

If the federal

government institutes a

law or policy that

appears to violate

Alberta’s jurisdiction

rights, according to

Smith’s overview, the

Alberta government

may introduce a

“special motion” for a

free vote of all MLAs.

The special motion

would identify the law

or policy believed to be

in violation of the

Constitution or Charter,

include an explanation

of the harms it would

inflict on Albertans,

and detail specific

actions the province

and its agencies will

take to refuse or

otherwise oppose

enforcement in Alberta.

parent’s background

I was born in a small town in Uttar

Pradesh, India. It was notorious for

many bandits and was a relatively

unsafe and volatile area. My father

was a news reporter for the Dainik

paper of Uttar Pradesh published

through Kanpur. My mother was a

traditional Indian housewife.

Your Early Education

I studied all my life at Jalaun, my

Jalaun, Uttar Pradesh.

When & Why You came to

Canada

I came to Canada in 2013 looking

for a better future for my son and

to explore the land of

Your career advancement

present

Occupation

I tried many start-ups in India and

in Surat I finally found success with

my greeting card business, of course

when I moved to Canada I had to leave all

of it behind, but it was quite successful in

breaking into the market. In Canada I held

multiple occupations in Walmart, even

worked as a subcontractor for Amazon,

and now I’m currently employed in Canada

Post and also designated as Social Shop

Steward by the Union. I volunteer lots to

give back to society. It was through

volunteering I connected many folks which

enable me to lead contented, happy and

meaningful life.

Your Regret in Life

I had a well established business in India

which I built from scratch. I abandoned that

to enter Canada and always remember

Were You Ever Discriminated?

I’m pretty sure every immigrant has faced

discrimination at some point in their lives.

However, over all, the countrymen are

welcoming, compassionate and try to help

at every step of the way.

Are You Happy in Canada?

I would say I’m relatively happy and

content with my life in Canada.

Any Comments on Canada’s Culture

The beauty of Canadian culture stems

from its diversity and acceptance of all

cultures. The vast majority of Canadians

are very respectful and helpful, which

make “Life is Good”.

Any Comments on Canada’s Weather

It’s rather unpredictable and volatile so

it’s best to be prepared for anything. I

personally keep a hoodie in my car 24/7.

As saying goes, work, woman and

weather can U-turn anytime.

What Brought You Success in

Canada?

I think it’s my ability to participate and

network. I’m relatively active in my

community and try to volunteer at every

given opportunity. It is through my

connections that I find fellowship and

support from people around me. Hard

work and focussed approach is very much

desired to achieve personal and

professional goals. Yes, family support is

the essence of success. Also, I give full

credit to my significant half, Arpana

UK gets new PM

Liz Truss faces a slew of

economic challenges

Two months after Boris Johnson

announced his resignation as British

Prime Minister in the wake of a string of

controversies, Liz Truss has been

named his successor. Truss, who

served as Foreign Minister under

Johnson, outplayed former Finance Minister

Rishi Sunak in the race for the top

post. However, she won’t get much time

to celebrate her triumph as Britain finds

itself knee-deep in a cost-of-living crisis,

with a long recession — sparked

by spiralling inflation which touched 10.1

per cent in July — looming large.

Truss’ functioning as PM will

come under intense scrutiny right from

Day One as she has promised to unveil

a plan within a week to deal with rising

energy bills and secure future fuel supplies.

Direct support to households and

tax cuts are high on her to-do list; how

these steps will help reduce inflation is

a moot point. Britain’s economic woes

can be gauged from the fact that India

has overtaken it to become the world’s

fifth largest economy; what’s more,

India’s lead over the UK is expected to

widen in the next few years. On the

bright side, Britain’s debt-to-gross-domestic-product

ratio is lower than that

of other Group of Seven nations, except

Germany. This might give the Truss government

some leeway to help out millions

of cash-strapped people, even as

the responsible use of public finances

will count in the long run.

What Britain direly needs is a

stable, sincere and strong leadership,

something which was conspicuous by

its absence during Johnson’s scandaltainted

tenure. The UK has had enough

of a PM who remained in the news

mostly for the wrong reasons. Truss

would have to adopt a no-nonsense approach

to running the government. As

far as foreign policy is concerned, she

will be under pressure to scale down

Britain’s involvement in the Ukraine-Russia

conflict so that the domestic problems

are tackled on priority. New Delhi

has much to look forward to during

Truss’ term, starting with the India-Britain

free trade agreement which seems

on course to meet its October deadline.

Effective implementation of the defence

cooperation pact, signed in April, is also

critical for India.
