15COMMUNITY CLOSED CIRCUITTELEVISION (CCTV)SURVEILLANCE CAMERASClosed-Circuit Television(CCTV) surveillance camerasare widely used in policing.The CCTV has been useful incrime investigations, in manycircumstances. CCTV hasseveral potential applicationsfor public safety and has beendeployed with the intentionvariously of preventing crime,detecting offences, improvingthe response to emergencies,assisting in the managementof places and reducing publicfear of crimes. CCTVcan also be used for purposesnot related to public safety,such as monitoring transportpassengerflows and investigatingcomplaints against facilitystaff. Of these potentialapplications, almost all researchattention to date hasconcentrated on the use ofCCTV to prevent crimes.Circular of State PoliceChief, Kerala regardingCCTV CIRCULAR No.17/2016Sub: - Taking of CCTVfootage and call records as evidencein prosecution of cases-Instructions issued- Reg TheHon’ble Supreme court clearlyheld inTomaso Bruno and anotherv. State of UttarPradesh reported in (2015) 7SCC 178 held that: “With theadvancement of Informationtechnology, scientific temperin the individual and at theinstitutional level is to pervadethe methods of investigation.With the increasing impactof technology in everydaylife and as a result, the productionof electronic evidencein cases has become relevantto establish the guilt of theaccused or the liability of thedefendant. Electronic documentsstricto sensu are admittedas material evidence. Secondaryevidence of contentsof document can also be ledunder Section 65 of the EvidenceAct. Production of scientificand electronic evidencein Court as contemplated underSection 65-B of the EvidenceAct is of great help tothe investigating agency anda/so to the prosecution.”It was also held that:“Non-production of CCTVfootage, non- collection of callrecords (details) and SIM detailsof mobile phones seizedfrom the accused cannot besaid to be mere instancesof faulty investigation butamount to withholding of the127best evidence. It is not thecase of the prosecution thatCCTV footage could not belifted or a CD copy could notbe made.” Omission to produceCCTV footage which isthe best evidence raises seriousdoubts about the prosecutioncase. The trial Court aswell as the High Court ignoredthis crucial aspect of nonproductionof CCTV footage.The trial court and the Highcourt erred relying upon theoral evidence of PWs 1 and13 who claim to have seen theCCTV footage and they didnot find anything which maybe of relevance in the case Itwas also held by the Hon’bleSupreme Court that failure toproduce CCTV footage whichwould have proved whetheraccused were present in hotelat material time, createdserious deficiency in prosecutioncase, It was further heldthat the Courts below drewwrong interference by believing,investigating agency’sversion that footage had beenviewed but nothing relevantwas found footage being thebest evidence, ought to havebeen brought on record.”TheHon’ble Supreme Court of In-
