106 9. COURT CRAFTshould be appointed as a liasonofficer for each Court totake care of the Court relatedmatters and report back tothe SHO the progress of thecase in the Court. In Sessionscases, the I.O. shouldbe present in the Court duringthe course of trial in theCourt. This instills great confidencein the witnesses to giveevidence without fear. It eveneffects positively the performanceof the prosecuting officersin the Court. Malpracticesadopted by the CourtCivil Police Officers in manipulatingthe cases by influencingthe witnesses should bechecked.9.12 Court TrialManagementSystem(CTMS)Follow up of Crime cases afterthe final report is submittedto the Court is essentialto ensure proper trial and conviction.Court Trial ManagementSystem ensures this byproviding a web based applicationto enter the details atvarious stages of trial. CTMSreduces the need for physicaltransmission of data andcourt CDs. Users can entercourt duty details on a dailybasis online.Once the Final report isprepared, Investigation officerscan enter on the CTMSwhether the case is Chargesheeted or Referred. Thereafterfrom the stages of allotmentof CC number throughthe trial proceedings till thecompletion of Trial, the dataat each stage is entered bythe Court duty personnel.Thisportal is designed for use byCourt duty personnel, SHOs,Investigation officers, and Superiorofficers to monitor theTrial and assist in successfulprosecution.9.13 Witness protectionduringinvestigationand trialThere have been instanceswhere witnesses have beenthreatened not to give evidencein favour of prosecutionor the witness is pressurizedby the accused to give falseevidence. The witnesses areinduced to turn hostile in theCourt. Hence a witness protectionSystem should be inplace for a fair trial. In foreigncountries like America, witnessprotection is a top priorityin the legal System. Evenunder Indian Law, new provisionslike Section: 195A CrPCand Section: 195A IPC havebeen added to take care ofwitness protection during trialand necessary action is to betaken against the accused whothreatens the witness to givefalse evidence procedural aspectsis provided under Section195A CrPC whereas penalaspects are covered underSection 195A IPC. Section195A IPC provides that whoeverthreatens another withinjury to his person, reputationor property with intent tocause that person to give falseevidence shall be punishedwith imprisonment for a termextending to 7 years or fineor both. If innocent person isconvicted because of false evidencewith death or imprisonmentfor more than sevenyears, the person threateningshall be punished with thesame punishment the innocentconvicted person suffers.Section 195A CrPC procedurefor witnesses in case of threateningetc., A witness or anyother person may file a complaintin relation to offencesunder Section 195A of IPC.The Police can also registercases against accusedwho threatens witnesses notto give true evidence and compelsthe witness to give falseevidence under other provisionsof Indian Penal Codealso.9.14 Reasons forfailure ofcases and acquittalsinCourtsThe Supreme Court hasstated that unmerited acquittalslead to disorder in thesociety. Recently, in KishanBai’s Case, Supreme Courthas observed thatdisciplinaryaction to be initiated againstthe Police for faulty investigationsand the investigatingofficer should be made accountablefor the lapses inthe investigation. Lack ofproper investigation is one ofthe main causes for acquittalof criminal cases in theCourt. Frequent work reviewmeetings should be conductedby superior Police officers toreview the performance of investigatingofficer.When a case ends in an acquittal,it should be probedin the review meeting. Itshould be ascertained whetherthe acquittal is on accountof lapses in the investigationor for other reasons. Whenevera new law is passed havingimplications on the proce-
