<strong>Swissmedic</strong> controls and monitors the<br />

advertising of medicinal products and is<br />

responsible for the risk-based processing of<br />

infringements of advertising rules involving<br />

authorised medicinal products that are reported<br />

to it or which it identifies by screening advertising<br />

destined for the public. This includes checking<br />

printed, TV and other electronic advertising<br />

destined for the public with the specific aim of<br />

identifying and banning misleading advertising<br />

that could induce people to take excessive<br />

quantities of medicinal products or lead them to<br />

believe that medicinal products are safer than they<br />

are. <strong>Swissmedic</strong> responds to infringements that<br />

jeopardise patient safety by initiating relevant<br />

procedures to enforce corrective actions. Publications,<br />

information sheets and presentations are<br />

used to inform stakeholders of the current<br />

requirements governing medicinal product<br />

advertising.<br />

Activities:<br />

A total of 47 (previous year: 24) cases were dealt with<br />

as part of post-publication advertising inspection activities<br />

during <strong>2021</strong>. Administrative proceedings had to be<br />

opened in 37 cases for the purpose of restoring legal<br />

compliance. 31 cases involved print advertising, while<br />

six involved advertising on electronic media, including<br />

TV commercials. In the remaining ten cases, <strong>Swissmedic</strong><br />

found no infringements of advertising rules or was not<br />

responsible for enforcement and therefore forwarded<br />

the reports to the relevant agency.<br />

<strong>Swissmedic</strong> sensitises the public to the risks<br />

associated with using illegal medicinal<br />

products. It maintains dialogue with other<br />

authorities and promotes effective national and<br />

international networking. <strong>Swissmedic</strong> receives<br />

reports of counterfeit medicinal products, illegal<br />

activities and illegal distribution, examines them<br />

and initiates corrective action where necessary.<br />

<strong>Swissmedic</strong> works closely with the customs<br />

authorities to control medicine imports and<br />

orders the destruction of illegal packages.
