Measures underway to optimize immigration from<br />
third countries<br />
Based on the submitted postulate Nantermod (19.3651) and on the meeting of the Federal Council on March 4, 2022,<br />
the Federal Council has decided to remove various obstacles to the local employment of third-country nationals.<br />
The following 4 aspects are subject to the relaxation of the Swiss Foreigners and Integration Act:<br />
National Interest:<br />
For Swiss nationals, EU/EFTA nationals, lawful residents: in the case of a proven shortage of skilled manpower, the<br />
national interest should not be reviewed in each individual case. This measure will be implemented directly<br />
through directives.<br />
Personal qualification:<br />
Persons without academic qualifications may also be granted a residence permit if they are engaged in a qualified<br />
activity and in the event of a proven shortage of skilled workers. The implementation with the concrete definition<br />
of these terms will take place in the directives with immediate effect.<br />
Self-employment:<br />
The change from employment to self-employment is currently associated with very high requirements. By the end<br />
of 2022, the change is to be simplified and by the end of 2023, it is to become permit-free.<br />
Quotas: The quota system is to be improved in cooperation with various stakeholders at the federal and cantonal<br />
levels. The Federal Council expects a proposal by the end of March 2023.<br />
Introduction of an express fee:<br />
In practice, the duration of the procedure for a work permit for third-country nationals varies from 3 to 6 months<br />
until the actual start of the job (depending on the working canton). The Federal Council wants to change this with<br />
the introduction of an express fee in the sense of an expedited procedure at the federal and cantonal level. A<br />
proposal is also expected in this regard by the end of March 2023.<br />

Massnahmen zur Optimierung der Zuwanderung aus<br />
Drittstaaten im Gang<br />
Angesichts des eingereichten Postulats Nantermod (19.3651) und anlässlich der Bundesratssitzung vom 4. März<br />
2022 hat der Bundesrat beschlossen, diverse Hürden bei der lokalen Anstellung von Drittstaatsangehörigen<br />
abzubauen.<br />
Die folgenden 4 Aspekte sind Gegenstand der Erleichterung des Schweizer Ausländer- und Integrationsgesetzes:<br />
Inländervorrang:<br />
Für Schweizer, EU/EFTA Staatsbürger, rechtmässige Aufenthalter: Bei ausgewiesenem Fachkräftemangel soll der<br />
Inländervorrang nicht in jedem Einzelfall überprüft werden. Diese Massnahme wird direkt durch Weisungen<br />
umgesetzt.<br />
Persönliche Qualifikation:<br />
Auch Personen ohne akademische Ausbildung dürfen eine Aufenthaltsbewilligung erhalten, wenn es sich dabei um<br />
eine qualifizierte Tätigkeit handelt sowie ausgewiesener Fachkräftemangel vorliegt. Die Umsetzung mit der<br />
konkreten Definition dieser Begriffe erfolgt in den Weisungen mit sofortiger Wirkung.<br />
Selbständige Erwerbstätigkeit: Der Wechsel von einer unselbständigen Erwerbstätigkeit zu einer selbständigen<br />
Erwerbstätigkeit ist zurzeit mit sehr hohen Auflagen verbunden. Bis Ende 2022 soll der Wechsel vereinfacht bzw.<br />
bis Ende 2023 bewilligungsfrei werden.<br />
Kontingente:<br />
Das Kontingentsystem soll in Zusammenarbeit mit diversen Akteuren auf Bundesebene und kantonaler Ebene<br />
verbessert werden. Der Bundesrat erwartet einen Vorschlag bis Ende März 2023.<br />
Einführung einer Expressgebühr: In der Praxis dauert das Verfahren für eine Arbeitsbewilligung für<br />
Drittstaatsangehörige abhängig vom Arbeitskanton 3 bis 6 Monate bis zum tatsächlichen Stellenantritt. Das will<br />
der Bundesrat mit der Einführung einer Expressgebühr im Sinne eines Beschleunigungsverfahrens auf Stufe Bund<br />
und Kanton ändern. Ein Vorschlag wird auch in diesem Zusammenhang bis Ende März 2023 erwartet.<br />

New regulations for international workforce<br />
On February 2, 2022, the Turkish Ministry of Labor and Social Services introduced a new Regulation No. 31738,<br />
which implements new regulations of the “Law on International Labor Force”. With the new regulation, the<br />
procedure and responsibilities related to the issuance of work permits, among other things, have been newly<br />
regulated. The new regulation brings - among others - the following rules and changes with it:<br />
Certain workers now have the possibility to apply for a work permit within Turkey without being required to<br />
have a valid residence permit.<br />
Once an application for extension of a work permit has been submitted and the extension is still pending with<br />
the competent authority, the worker remains entitled to work for up to 90 days.<br />
In the event of a temporary suspension of the work (e.g. unpaid holiday), the worker and employer are free to<br />
mutually agree on a suspension of the work permit for up to 90 days.<br />
Indefinite work permits must be renewed every five years. In addition, workers in possession of an indefinite<br />
work permit can work independently or for several employers.<br />
Türkei / 10. März 2022<br />
Neuregelung des Gesetzes über internationale<br />
Arbeitskräfte<br />
Das türkische Ministerium für Arbeit und Soziales hat am 2. Februar 2022 eine neue Verordnung Nr. 31738 erlassen,<br />
mit welchen neuen Bestimmungen des Gesetzes über internationale Arbeitskräfte umgesetzt werden. Mit der<br />
neuen Verordnung wurden u.a. das Verfahren und die Zuständigkeiten bei der Erteilung von Arbeitsbewilligungen<br />
neu geregelt. Die neue Verordnung bringt unter anderem die folgenden Regeln und Änderungen mit sich:<br />
Bestimmte Arbeitnehmer haben nun die Möglichkeit, eine Arbeitsbewilligung in der Türkei zu beantragen, ohne<br />
eine gültige Aufenthaltsbewilligung zu benötigen.<br />
Nach der Einreichung des Gesuchs um Verlängerung einer Arbeitsbewilligung und solange die Verlängerung<br />
noch bei der zuständigen Behörde pendent ist, bleibt der Arbeitnehmer bis zu 90 Tage arbeitsberechtigt.<br />
Im Falle einer Aussetzung der Arbeit (z.B. durch unbezahlten Urlaub) können Arbeitnehmer und Arbeitgeber<br />
einvernehmlich eine Aussetzung der Arbeitsbewilligung für bis zu 90 Tage vereinbaren.<br />
Unbefristete Arbeitsbewilligungen müssen alle fünf Jahre erneuert werden. Arbeitnehmer, welche im Besitz<br />
einer unbefristeten Arbeitsbewilligung sind, können unabhängig oder für mehrere Arbeitgeber arbeiten.<br />

Taxation of persons liable to withholding tax -<br />
deadline 31 March 2022<br />
Foreign nationals subject to withholding tax who are resident in the Canton of Zurich or abroad and gainfully<br />
employed in the Canton of Zurich may submit an application for either a subsequent ordinary tax return or a<br />
withholding tax correction from the 2021 tax period onwards. This application must be submitted by 31 March 2022.<br />
This deadline cannot be extended<br />
If the taxpayer has additional income of more than CHF 3,000 or assets of CHF 80,000 (single) / CHF 160,000<br />
(married), an application for retroactive ordinary tax return must be submitted.<br />
Otherwise, you can submit a voluntary application if you wish to claim additional costs such as purchases into the<br />
pension fund, contributions to pillar 3a, weekly commuting costs.<br />
An application for withholding tax correction can only be submitted if the taxable or rate-determining gross<br />
income was incorrectly determined or the tax tariff was incorrectly applied.<br />
As before, taxpayers with a gross income of more than CHF 120,000 must file a tax return by 31 March of the<br />
following year, unless the taxpayer is resident abroad. In these cases, at least 90% of the worldwide family income<br />
must be earned in Switzerland.<br />
Schweiz - Zürich / 10. März 2022<br />
Besteuerung von quellensteuerpflichtigen Personen<br />
– Frist 31. März 2022<br />
Quellensteuerpflichtige Ausländer mit Wohnsitz im Kanton Zürich oder im Ausland mit Erwerbstätigkeit im Kanton<br />
Zürich können ab der Steuerperiode 2021 entweder einen Antrag auf nachträgliche ordentliche Veranlagung oder<br />
Quellensteuerkorrektur stellen. Dieser Antrag muss bis am 31. März 2022 eingereicht sein. Diese Frist ist nicht<br />
erstreckbar, wenn der Steuerpflichtige über zusätzliche Einkünfte von über CHF 3'000 oder Vermögenswerte von<br />
CHF 80'000 (Ledige) / CHF 160'000 (Verheiratete) verfügt, muss ein Antrag auf nachträglich ordentliche Veranlagung<br />
gestellt werden.<br />
Ansonsten kann man freiwillig einen Antrag stellen, wenn man zusätzliche Kosten wie bspw. Einkäufe in die<br />
Pensionskasse, Beiträge in die Säule 3a, Wochenaufenthaltskosten geltend machen möchte.<br />
Ein Antrag auf Quellensteuerkorrektur kann nur eingereicht werden, wenn das steuerbare oder satzbestimmende<br />
Bruttoeinkommen falsch ermittelt oder der Tarif falsch angewendet wurde.<br />
Nach wie vor gilt, dass Steuerpflichtige mit einem Bruttoeinkommen von über CHF 120'000 eine Steuererklärung bis<br />
zum 31. März des Folgejahres eingereicht werden muss, es sei denn, der Steuerpflichtige hat seinen Wohnsitz im<br />
Ausland. In diesen Fällen muss mindestens 90% des weltweiten Familieneinkommens in der Schweiz verdient<br />
werden.<br />

International Remote Work, Hybrid Work, Working from<br />
Anywhere - A Question of Definition.<br />
The change in the work environment has been tremendous in the last 2 years due to the pandemic. From one moment to the<br />
next, employers created the necessary infrastructure to enable a large part of their employees with "screen jobs" to work from<br />
home. This not only led to widespread acceptance of the home office, but also to the desire of employees to be able to work<br />
more flexibly in the future.<br />
"Dream Office", "Workation", "Working from anywhere", but also "International Remote Working", "Virtual Assignments" and<br />
"Hybrid Work" found their way into business terminology. However, there is still no uniform definition of these terms.<br />
Therefore, the understanding of these concepts varies not only from one company to another but also among (HR) employees.<br />
We will, therefore, attempt a definition of selected terms:<br />
Hybrid Work:<br />
Employees work both in the home office and in the employer's office. "Hybrid teams" work either on the same days in the<br />
office or in the home office, or also opposite in location to make maximum use of office space.<br />
(International) Remote Work:<br />
The definition of "remote work" goes beyond the actual work in the home office at the place of residence. Remote work can<br />
(but does not have to) take place at foreign destinations. Employers often limit remote work to the domestic territory to avoid<br />
difficulties regarding social security, taxes, work permits, and possible permanent establishments.<br />
Virtual Assignments:<br />
In virtual assignments, the employee temporarily takes a new job abroad for the same employer, but the employee does not<br />
move abroad. He or she performs the new activity almost exclusively "virtually," i.e., with the help of the appropriate IT<br />
infrastructure at his or her previous place of residence or work.<br />
Workation:<br />
Working at vacation locations at the request of the employee is also called "workation". While many employers would like to<br />
accommodate this request, at least temporarily, they face many administrative and legal hurdles in this regard.<br />
Dreamoffice & Working from Anywhere: Similar to “Workation”, the employee sets up his or her desired workplace at his or her<br />
favorite work location. Depending on the employee's wishes, this could be a permanent or changing solution at home or<br />
abroad.<br />
Many employers are reluctant - and rightly so - to completely relocate jobs to the "dream office" or arbitrary locations, as this<br />
can involve, among other things, considerable pitfalls in terms of income taxes, social security, payroll, permanent<br />
establishments, and work permits. For important key functions, however, this is an excellent way to attract qualified<br />
employees, provided the initial efforts of legal clarifications and implementations within the company are not shied away<br />
from.<br />

<strong>Global</strong> <strong>Mobility</strong>:<br />
International Remote Work, Hybrid Work, Working from<br />
Anywhere – Eine Frage der Definition.<br />
<br />
Der Wandel in der Arbeitswelt war in den letzten 2 Jahren aufgrund der Pandemie gewaltig. Von jetzt auf gleich schafften<br />
Arbeitgeber die notwendige Infrastruktur, damit ein Grossteil ihrer Mitarbeiter mit „Bildschirmtätigkeiten“ von zu Hause aus<br />
arbeiten konnte. Dies führte nicht nur zu einer breiten Akzeptanz des Homeoffice, sondern auch zum Wunsch der Mitarbeiter,<br />
zukünftig flexibler arbeiten zu können.<br />
“Dream Office”, “Workation”, “Working from anywhere”, aber auch “International Remote Working”, “Virtual Assignments” und<br />
“Hybrid Work” hielten als Begrifflichkeiten in die Unternehmen Einzug. Eine einheitliche Definition gibt es hierfür allerdings bis<br />
heute nicht. Daher dürfte das Verständnis in Bezug auf diese Wortschöpfungen nicht nur von Unternehmen zu Unternehmen,<br />
sondern auch unter den (HR-) Mitarbeitern unterschiedlich ausfallen. Wir versuchen uns daher an einer Definition ausgewählter<br />
Begriffe:<br />
Hybrid Work:<br />
Die Arbeitnehmer arbeiten sowohl im Homeoffice als auch im Büro des Arbeitgebers. «Hybride Teams» arbeiten entweder an den<br />
gleichen Tagen im Büro bzw. im Homeoffice oder auch ortsversetzt, um zum Beispiel Büroräumlichkeiten bestmöglich zu nutzen.<br />
(International) Remote Work:<br />
Die Definition von «Remote Work” geht über das eigentliche Arbeiten im Homeoffice am Wohnort hinaus. Remote Work kann<br />
(aber muss nicht) auch an ausländischen Destinationen stattfinden. Arbeitgeber beschränken oft den Radius von Remote Work<br />
auf das Inland, um Schwierigkeiten in Bezug auf die Sozialversicherungsunterstellung, Steuern, Arbeitsbewilligungen sowie<br />
etwaige Betriebsstätten zu vermeiden.<br />
Virtual Assignments:<br />
Bei virtuellen Entsendungen nimmt der Arbeitnehmer für den gleichen Arbeitgeber zwar temporär eine neue Stelle im Ausland an,<br />
aber der Mitarbeiter zieht nicht ins Ausland um. Er geht der neuen Tätigkeit nahezu ausschliesslich «virtuell», d.h. mit Hilfe der<br />
entsprechenden IT-Infrastruktur an seinem bisherigen Wohn- bzw. Arbeitswort, nach.<br />
Workation:<br />
Das Arbeiten an Urlaubsorten auf Wunsch des Arbeitnehmers wird auch «Workation» genannt. Der Kunstbegriff setzt sich aus<br />
den Worten «work» und «vacation» zusammen. Viele Arbeitgeber möchten diesen Wunsch zwar mindestens temporär<br />
nachkommen, stehen diesbezüglich aber vor vielen administrativen und rechtlichen Hürden.<br />
Dreamoffice & Working from Anywhere: Ähnlich wie bei Workation richtet sich der Mitarbeiter seinen Wunscharbeitsplatz an<br />
seinem Wunscharbeitsort ein. Je nach Wunsch des Arbeitnehmers könnte es sich hier um eine dauerhafte oder sich permanent<br />
wandelnde Lösung im In- oder Ausland handeln.<br />
Viele Arbeitgeber schrecken – zu Recht – vor einer völligen Verlagerung der Arbeitsplätze ins «Dreamoffice» oder beliebige Orte<br />
zurück, da dies unter anderem beträchtliche Fallstricke in Bezug auf Steuern, Sozialversicherungen, Payroll, Betriebsstätten und<br />
Arbeitsbewilligungen mit sich bringen kann. Für wichtige Schlüsselfunktionen ist dies jedoch eine hervorragende Möglichkeit,<br />
qualifizierte Mitarbeiter zu gewinnen, sofern der initiale Aufwand der rechtlichen Abklärungen und Umsetzung im Unternehmen<br />
nicht gescheut wird.<br />
