Terms & Conditions Of Employment Relationships<br />

Leave is governed by the Basic Conditions of<br />

Employment Act which sets out the types of leave.<br />

Namely annual leave, sick leave, maternity leave and<br />

family responsibility leave, which we have briefly<br />

summarised below. It is always a good idea to have<br />

a leave policy in place to avoid any misunderstanding<br />

or confusion.<br />

ANNUAL LEAVE<br />

Annual leave applies when an employee<br />

works more than 24 hours a month for<br />

an employer and is calculated from the<br />

commencement date of employment. Leave is<br />

accumulated as follows: 1 day for every 17 days<br />

worked, or 1 hour for every 17 hours worked.<br />

Leave can only be taken when the employer<br />

agrees to such leave and may be refused with<br />

just cause. Employers, due to operational<br />

requirements such as shutdowns and/or busy periods, may<br />

require leave to be taken at specific times during the year. When<br />

an employee is on leave they must receive full remuneration for<br />

such days. On the termination of the employment relationship,<br />

any outstanding leave owed to the employee must be paid out<br />

to them.<br />

SICK LEAVE<br />

Sick leave is calculated from the<br />

commencement date of employment and<br />

over a 3-year cycle. During the first 6 months,<br />

an employee may only take 1 day’s paid sick<br />

leave for every 26 days worked. The employee<br />

is entitled to the equivalent of six weeks off<br />

work. For example, employees that work a<br />

5-day week will be granted 30 days sick leave<br />

per cycle and employees that work a 6-day<br />

week will be granted 36 days sick leave per cycle. Sick leave is<br />

paid leave, however, the employer is entitled to request proof of<br />

illness, if the employee is absent for longer than 2 consecutive<br />

days or if there is a pattern of illness (the employee is often sick<br />

on a Friday). If a medical certificate is not submitted the employer<br />

is not obliged to pay for the sick leave.<br />

MATERNITY / PATERNITY LEAVE<br />

A female employee is entitled to 4<br />

months unpaid maternity leave, which<br />

can commence four weeks before<br />

the expected date of birth or on the<br />

written recommendation of a doctor/<br />

midwife. Employees may not return<br />

to work within 6 weeks of having the<br />

baby unless supported by a written<br />

recommendation of a doctor/midwife.<br />

The employee needs to notify her employer of her intended<br />

leave dates. Some companies subsidise maternity leave,<br />

however, this is not an obligation. The employee may make a<br />

claim from the Department of Labour and Unemployment Fund<br />

for her maternity leave. A male employee is entitled to 10-days<br />

unpaid paternity leave. Employees will need to provide a birth<br />

certificate as proof of birth. Again, similarly to female employees,<br />

the employee may make a claim from the Department of Labour<br />

and Unemployment Fund for his paternity leave.<br />

FAMILY RESPONSIBILITY LEAVE<br />

Employees employed for over 4<br />

months, working more than 4 days<br />

a week, will be entitled to 3 days<br />

paid family responsibility leave, per<br />

leave cycle. The employee is only<br />

entitled leave under the following<br />

circumstances (1) The birth of an<br />

employee’s child (2) Illness of an<br />

employee’s child (3) In the event of<br />

the death of the employee’s: (a) Spouse (b) Partner (c) Parent<br />

(d) Adoptive parent (e) Grandfather/grandmother (f ) Child<br />

(g) Adopted child (h) Brother/sister. As with sick/paternity<br />

leave the employee will need to provide proof (eg. a medical/<br />

death certificate).<br />
