Ordinance 2 regarding the measurements of the<br />
combat of coronavirus (status 11 May 2020)<br />
Entering Switzerland based on current ordinance 2<br />
• In principle forbidden, if entering from a high risk<br />
country (all countries except Liechtenstein) with<br />
some exceptions<br />
Decided phases on the lockdown:<br />
• 27 April: 1st phase<br />
• 11 May: schools, any other store – slightly<br />
opening the border<br />
• 8 June: leisure activities, eg. museum, libaries,<br />
zoos – opening the border for EU/EFTA<br />
nationals<br />
• 15 June: all applications will be reviewed again<br />
and visas will be issued again<br />
• No decision on the final opening of the border<br />
Main changes in regard to:<br />
• Family reunification for Swiss and<br />
EU/EFTA nationals with a L, B or C<br />
• Non-EU/EFTA nationals with a filed<br />
application before <strong>19</strong> March 2020<br />
• EU/EFTA nationals with a filed<br />
application before 25 March 2020<br />
• EU/EFTA nationals with an employment<br />
contract issued before 25 March 2020<br />
(and rental agreement starting at least as<br />
of 1 April)<br />

application before <strong>19</strong> March 2020: 1 July<br />
• For non-EU/EFTA nationals with not<br />
filed application before <strong>19</strong> March 2020:<br />

<strong>FAQ</strong>: new joiner<br />
YOU asked:<br />
EU national shall start new in<br />
Lucerne. He is married and has<br />
a child, both are Japanese<br />
nationals.<br />
Can he only enter on his own,<br />
or together with the family.<br />
CONVINUS replies<br />
• If the employment contract has been signed prior<br />
to 25 March 2020 and he has a rental agreement<br />
starting 1 April, he can just enter Switzerland.<br />
• If there is no rental agreement with start date 1<br />
April: the notification can be done, so that he can<br />
start now<br />
• If the employment contract also has not been<br />
signed before 25 March: he can only enter as of 8<br />
June<br />
• Family: he first needs to register and then an<br />
application for family reunification neesds to be<br />
filed<br />

When can he enter<br />
Switzerland?<br />

• He can enter Switzerland as<br />
of 8 June.<br />
• If he already wants to enter<br />
before then, a notification<br />
needs to be done. However,<br />
this is only possible with an<br />
employment contract signed<br />
prior to 25 March 2020.<br />

EU national is since April 2020<br />
in Switzerland registered and<br />
started to work then.<br />
He is married to Ukrainian<br />
spouse, who currently lives in<br />
Poland and has a Polish<br />
residence permit.<br />
Can she just enter Switzerland?<br />
• If he has a B-permit card,<br />
then an application for<br />
family reunification can be<br />
filed since this week.<br />
• She will need to wait for the<br />
final approval from the Swiss<br />
authority and then claim the<br />
visa at the embassy.<br />

YOU asked:<br />
An employee is since March 2020 in<br />
the home office and intends to stay in<br />
the home office until end of June or<br />
later. The employee is employed in<br />
Zurich and his home office is in<br />
Konstanz, where his family lives. He<br />
usually commuted daily to Zurich.<br />
What are the tax and social security<br />
implications?<br />
CONVINUS replies:<br />
• recommendation: wait until the<br />
employee is returning to his work<br />
place and then checking the situation<br />
about tax and social security.<br />
• The authorities of the neighbouring<br />
countries informed about the<br />
intention to not switch the tax<br />
regime or the enrolment of security<br />
based on home office.<br />
