Thinking Democratically: A Comprehensive Approach to Countering and Preventing Shrinking Space

Pol<strong>and</strong> LGBTQI people have suffered from increased physical <strong>and</strong> verbal attacks, including with<br />

‘LGBTI free zones’ in an increasing number of municipalities. More widely, smear campaigns have<br />

served <strong>to</strong> delegitimise civil society organisations across Europe. The anti-Soros campaign in Hungary<br />

is the most obvious example, however, the narrative on civil society is also being reshaped on an EU<br />

level, with several MEPs questioning the integrity <strong>and</strong> legitimacy of CSOs in the European Parliament.<br />

The independence of the judiciary has been most at risk in Europe, with legislation that compromises<br />

the separation of powers in Hungary <strong>and</strong> Pol<strong>and</strong>. In both cases, the appointment procedures of judges<br />

<strong>and</strong> budget decisions were used as a tactic <strong>to</strong> undermine the independence of the judiciary, <strong>and</strong><br />

thereby close democratic space. 78 The EU is investigating breaches of the rule of law in both<br />

countries, with Hungary withdrawing the law in response <strong>to</strong> EU pressure.<br />

The political playing field has thus far not been subject <strong>to</strong> major restrictions <strong>to</strong> democratic space in<br />

Europe, with the exception of Hungary. The 2018 elections in Hungary saw restricted freedom of<br />

media <strong>and</strong> association, an abuse of state resources by the ruling party, opaque campaign financing,<br />

media bias, <strong>and</strong> xenophobic <strong>and</strong> intimidating rhe<strong>to</strong>ric. 79 More generally in Europe, a worrying trend<br />

is that restrictions in democratic space are implemented by democratically elected governments,<br />

using their democratic m<strong>and</strong>ate <strong>to</strong> undermine democratic institutions, thereby ensuring their own<br />

re-election <strong>and</strong> limiting space for contestation.<br />
