Smear-campaigns <strong>and</strong> the strategic undermining of democratic ac<strong>to</strong>rs’ credibility disrupts civic space<br />

<strong>and</strong> creates an unlevel playing field (<strong>to</strong> which the next section turns). As smear campaigns are often<br />

not illegal <strong>and</strong> spread at an incredibly fast pace, they are very difficult <strong>to</strong> counter for both activists,<br />

CSOs, political parties or c<strong>and</strong>idates, <strong>and</strong> other civic ac<strong>to</strong>rs. A lot of this takes place on social media,<br />

focused on delegitimising the person’s work, the people they are associated with, or attacking them<br />

through their private life. Women are particularly at risk. Evidence suggests that there may be a<br />

connection between hostile discourse <strong>and</strong> physical attacks. 43 44 In addition <strong>to</strong> the physical harms<br />

associated with this, it is clear from interviews <strong>and</strong> legal evidence that smear campaigns have a<br />

chilling effect on activists.<br />

In other cases, fundamental freedoms may be guaranteed but are not enjoyed by particular groups<br />

in society. In Indonesia, religious minorities, atheists, LGBTQ+ <strong>and</strong> Papuans do not enjoy the same<br />

level of protection <strong>and</strong> the same civil rights <strong>and</strong> freedoms as Muslim Indonesians. In 2016,<br />

demonstrations in Papua dem<strong>and</strong>ing an independence referendum saw thous<strong>and</strong>s of Papuans arrested<br />

<strong>and</strong> several charged with treason. LGBTQ+ people <strong>and</strong> activists, Ahmadis <strong>and</strong> Shi’ites face an<br />

increasing number of religiously motivated attacks, <strong>and</strong> do not enjoy the same protection by the<br />

police. 45 Amnesty International similarly finds that certain voices, often of activists, women HRDs,<br />

LGBTI groups <strong>and</strong> certain minorities, are being silenced as part of a strategy <strong>to</strong> shrink civic space. 46<br />

Generally, the government in power is the main perpetra<strong>to</strong>r of such attacks on civic space. Political<br />

strategies can, however, also be deployed by non-governmental groups, such as private companies,<br />

anti-pluralist civil society <strong>and</strong> opposition groups. In Europe, for instance, far right parties – even when<br />

not in power – have used political strategies <strong>to</strong> limit civic space, through an anti-pluralist narrative<br />

that attacks the legitimacy of CSOs. In other cases, violent non-state ac<strong>to</strong>rs are the main perpetra<strong>to</strong>rs<br />

of attacks on fundamental freedoms. In El Salvador, freedom of association <strong>and</strong> assembly are<br />

guaranteed by law, but in practice restricted by illegal armed groups who operate as ve<strong>to</strong> ac<strong>to</strong>rs in<br />

the terri<strong>to</strong>ries they control. They thereby directly restrict the exercise of freedoms <strong>and</strong> indirectly<br />

impose limitations through intimidation <strong>and</strong> fear-mongering.<br />
